RESOLUTION AUTHORIZING ADVERTISEMENT FOR BIDS FOR DIXON
ROAD CULVERT REPLACEMENT PROJECT, TECHNICAL SERVICES
CHANGE ORDER #3 OF THE CHAZEN COMPANIES AND INCREASE
IN CAPITAL PROJECT FUND #206

WHEREAS, by Resolution No.: 412,2014, the Queensbury Town Board authorized and
approved the Dixon Road Culvert Replacement Project, establishment of the Dixon Road Culvert
Replacement Capital Project Fund #206 in the amount of $40,000, and engagement of The
Chazen Companies (Chazen) for design and construction phase engineering services for an
amount not to exceed $31,240, and
WHEREAS, Chazen has provided such design and construction phase engineering services
authorized by such Resolution including preparation of the culvert replacement construction bid
documents, but as a result of the New York State Department of Environmental Conservation
requiring significant design changes to the culvert and stream armoring design in order to permit the
Project, Chazen has submitted a Technical Services Change Order #3 dated June 21, 2015 (presented
at this meeting) providing for additional and continued professional engineering services related to the
Capital Project for an additional amount of $4,925 for Task 006 — Preparation of Contract
Documents; and $1,600 for Task 007 — Project Coordination, Meetings and Correspondence; for a
total additional amount not to exceed $6,525, and
WHEREAS, the Town Board wishes to accordingly authorize the increase in the Project costs
and supplement Fund#206 in such amount, and
WHEREAS, General Municipal Law §103 requires that the Town advertise for bids and award
the bid to the lowest responsible bidder(s) meeting New York State statutory requirements and the
requirements set forth in the Town's bidding documents,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town's
Purchasing Agent to publish an advertisement for bids for the Dixon Road Culvert Replacement
Project in the official newspaper for the Town of Queensbury, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Purchasing Agent to
open all bids received, read the same aloud and record the bids as is customarily done and present the
bids to the next regular or special meeting of the Town Board, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and accepts Chazen's Technical
Services Change Order #3 dated June 21, 2015 as presented at this meeting providing for Chazen's
continued professional engineering services related to the Capital Project for an additional amount of
$4,925 for Task 006 — preparation of contract documents and $1,600 for Task 007 — Project
Coordination, meetings and correspondence, for a total additional amount not to exceed $6,525, and
authorizes and directs the $6,525 increase in the Dixon Road Culvert Replacement Project Fund
#206, such $6,525 to come from the Town's General Fund unappropriated, undesignated Fund
Balance, and
BE IT FURTHER,
RESOLVED that the Town Board authorizes and directs the Town Budget Officer to
take all action necessary to increase appropriations and revenues in the following accounts as
necessary:
• Revenue Acct No. —206-0000-55031 (Interfund Revenue) $6,525;
• Expense Acct No. —206-8540-4720 (Engineering/Consultants) $6,525;
• Expense Acct No. - 001-9950-9030 Transfer to Capital Project $6,525;
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget
Officer to amend the Town Budget, make any adjustments, budget amendments, transfers or
prepare any documentation necessary to increase such appropriations and estimated revenues, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute Chazen's Technical Services Change Order #3 dated June 21, 2015 substantially in the form
presented at this meeting, as well as any other needed documentation and the Town Supervisor, Town
Budget Officer and/or Purchasing Agent to take any and all actions necessary to effectuate all terms of
this Resolution.

Dear Supervisor Strough:
The Chazen Companies (Chazen) is pleased to provide this Technical Services Change Order outlining
continued professional services associated with the above referenced project. As per our previous
discussions,and as you are aware, NYSDEC required significant design changes to the culvert and stream
armoring design in order to permit the project. As you will recall, we submitted 95% complete
construction documents to NYSDEC for permitting in February of this year, based on the premise that
they would approve directly slip-lining the existing culvert. This premise was developed form verbal
conversations that Warren County Soil and Water had with NYSDEC. Following the initial permitting
application submittal, NYSDEC required a design change to both increase the size of the replacement
culvert (including the removal of the last section of existing culvert) and significant additional stream
armoring at the culvert outlet. As such, our office advanced significant efforts to both redesign the
project and coordinate with NYSDEC to obtain a permit. Most recently we also prepared a final estimate
for the project which was not in the original scope of services.As such, we exceeded the original budget
for the design task (Task 06 Contract Documents) of the project, and expended the majority of the
project coordination/meetings task(Task 007 Project Coordination, Meetings and Correspondence).This
TSCO outlines increases to the budgets for those tasks.
Budget Modifications:
Task 006—Contract Documents
As discussed above, redesign of the project was required to obtain a stream disturbance permit from
NYSDEC for the project. Additionally, we recently prepared a cost e stimate for the project under this
task, which was not previously scoped. As such'we have exceeded the original budget of this task by
$4,925.00, and therefore request the budget be modified by the same for this task. The
Contact Documents are complete and permits have been obtained, therefore following the budget
modification,this task will be closed.

Task 007—Project Coordination,Meetings and Correspondence
As discussed above, significant additional coordination with the NYSDEC, WCSWCD and the Town was
required to redesign the project per NYSDEC request and obtain final permits. As such this task was
nearly exhausted. Therefore, to provide budget for continued project meetings : • a ination and
correspondences through construction,we recommend this budget be increased b $1,600.

#206, AND ENGAGEMENT OF THE CHAZEN COMPANIES FOR
DESIGN AND CONSTRUCTION PHASE ENGINEERING SERVICES

WHEREAS, the Town of Queensbury wishes to establish a Capital Project that will
provide for repairs to the Dixon Road Culvert in the Town of Queensbury, and
WHEREAS, the Town wishes to establish and fund the Revenue and Expense Accounts
for the Capital Project in a total amount of$40,000, and
WHEREAS, The Chazen Companies has submitted a proposal to provide design and
construction phase engineering services related to the Capital Project for an amount not to exceed
$31,420 as set forth in its November 14th,2014 proposal presented at this meeting,and
WHEREAS, The Chazen Companies previously provided certain professional engineering
services associated with the Project and therefore the Town Board wishes to waive the Town
Purchasing Policy's Request for Proposals, self-imposed bidding/purchasing requirement in this
instance, and
WHEREAS,the Town will adhere to all New York State Law bidding requirements, and
WHEREAS, accordingly, the Town Board wishes to establish a Capital Project Fund for
the Project and authorize such engagement of The Chazen Companies,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes the Dixon Road
Culvert Replacement Project and authorizes and directs the establishment of the Dixon Road
Culvert Replacement Capital Project Fund #206 in the amount of$40,000 which will establish
funding for expenses associated with this Capital Project, and
BE IT FURTHER,
RESOLVED, that for the reasons outlined above, in these circumstances the Queensbury
Town Board hereby waives its Request for Proposals self-imposed bidding/purchasing requirement
under the Town of Queensbury's Purchasing Policy in this instance,and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that funding for such
Capital Project shall be by a transfer of$40,000 from Engineering Account No.: 001-1440-4720
to Transfer to Capital Project 001-9950-9030, and
BE IT FURTHER,
RESOLVED that the Town Board authorizes and directs the Town Budget Officer to take
all action necessary to establish the following accounts for such appropriations and revenues as
necessary:
• Revenue Acct No.—206-0000-55031 (Interfund Revenue) $40,000;
• Expense Acct No.—206-8540-4720 (Engineering/Consultants) $40,000
and

BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and accepts the proposal of The
Chazen Companies dated November 14th, 2014 for design and construction phase engineering
services for an amount not to exceed $31,240 substantially in the form presented at this meeting,
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget
Officer to amend the Town Budget, make any adjustments, budget amendments, transfers or
prepare any documentation necessary to establish such appropriations and estimated revenues,
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
sign the proposal of The Chazen Companies substantially in the form presented at this meeting, as
well as any other needed documentation and the Town Supervisor and/or Town Budget Officer to
take any and all actions necessary to effectuate all terms ary rms of this Resolution.
