At the outset, please note that it is our position that the prior site plan review will remain as approved. The Court, in the case of Sonnabend et al v. Town of Queensbury et al, did not challenge the underlying site plan approval, nor did the petitioners challenge the underlying SEQRA negative declaration. The Court evidenced its intention to clarify its prior ruling that the entire site plan review was not overturned. Rather, the granting of approval for residential use within 30,0 feet of Bay Road was overturned. With the Planned Unit Development approval, it is our further position that the PUD legislation will then supersede the Court's decision on the 300 foot issue. Nonetheless, in the interests of moving for-ward in a timely fashion, we are providing the site plan application. Please note that some of the materials from the Planned Unit Development application similarly apply to the site plan. As the planning board is awarefrorn the prior review, long ago the County had approved the road cuts off'of Bay and Blind Rock Roads. Subsequent to the last approval, we net with DOT once again and were ready to proceed with those pen-nits but the Article 78 intervened. The road cuts were acceptable then as well and we will proceed with those pennits as part of the project if or when approved. We appreciate the Planning Board's continued patience and efforts on this project. My clients still firmly believe in the project that all boards helped shape. We are hopeful and confident that we can now proceed with this project for the benefit of everyone involved. The parcel is 34.050 acres as, surveyed, and includes an Army Corps,jurisdictional wetland of 10.55 acres, slopes in excess of 20% of 1.28 acres, and existing easements of 0,393) acres, leaving a buildable area per the Town of Queensbury Zoning Law of 21.827 acres. fhe property is zoned "Oflice (0)". The project as proposed includes I I buildings ranging from mixed use to multifamily residential. All proposed uses are permitted in the zone. Submitted with the narrative and part of the supporting documentation are the development summary statistics for all buildings, and the site in general. For the sake of brevity, we will not set them forth herein. The proposed uses include offices, small retail, food service, etc., supporting the 'village' concept of the project as envisioned through now years of review. Exterior seating will be located along patios and under pergolas that compliment the proposed mixed use structures. Much is made in the Town's 2007 Comprehensive Plan of walkability and inclusion of paths within the Bay Road corridor. That as, incorporating complimentary uses in a project, and including amenities where pedestrian traffic is, pleasing, and incorporated into a project, not just a part of the project. We believe this project is the first of its kind in Queensbury to actually focus oil complimentary uses. On site, pedestrian trails, paths, and connections have been intentionally incorporated into the project, and not a mere afterthought to satisfy some zoning requirement, Multifamily housing to the rear and above the offices and retail along Bay Road creates a sustaining project, and the vision of proper paths integrates the two, The Town can only compliment this project with further direction to any future development in this immediate vicinity, including across Bay Road. In addition, should the Town seek to maximize the benefit of this project on neighboring properties and housing developments, pedestrian improvements such as paths along Bay and Blind Rock Roads should be a focus off Town planning and investment, If you review the plans, you will see that the paths and trails have been placed to compliment the uses and the structures, while also leaving open future potential connection to other development along Bay and Blind Rock Roads. This is the spirit of the Comprehensive Plan. Much has been made in the past with regard to the 300 foot setback along Bay Road. This setback was intended to preserve space for commercial. and office use, a laudable goal for sure. With this proposal and the work of the Planning Board, ZBA, and the joint reviews, we believe the prQject strikes a balance between this goal and a worthwhile project for the Town. Allowing apartments above office and commercial uses is complimentary, and has allowed the project to maximize green space to the extent possible. This creates an economically viable and aesthetically pleasing project, while opening this side of Town to an array of services not otherwise afforded to local residents. It is the applicant's plan that the buildings will be filled with uses that compliment one another, and offer Sustaining services to this area of'rown as well.
