RESOLUTION SETTING PUBLIC HEARING ON SEWAGE DISPOSAL
VARIANCE APPLICATION OF CHRIS AND BARBARA BOYD

WHEREAS, the Queensbury Town Board serves as the Town's Local Board of Health and is
authorized by Town Code Chapter 136 to issue variances from the Town's On-Site Sewage Disposal
Ordinance, and
WHEREAS, Chris and Barbara Boyd have applied to the Local Board of Health for variances
from Chapter 136 to install a replacement wastewater treatment system as follows:
1. Absorption field to be 3' from the west property line instead of the required 10'
setback; and
2. Absorption field to be 8' from the south property line instead of the required 10'
setback;
3. Absorption field to be 77' from the well instead of the required 100' setback; and
4. Septic tank to be 4' from the dwelling instead of the required 10' setback;
on property located at 25 Hanneford Road, Queensbury,
NOW, THEREFORE, BE IT
RESOLVED, that the Town of Queensbury's Local Board of Health will hold a public hearing
on Monday, November 16d`, 2015 at 7:00 p.m. at the Queensbury Activities Center, 742 Bay Road,
Queensbury, to consider Chris and Barbara Boyd's sewage disposal variance application concerning
property located at 25 Hanneford Road, Queensbury (Tax Map No.: 240.6-1-17) and at that time all
interested persons will be heard, and
BE IT FURTHER,
RESOLVED, that the Local Board of Health authorizes and directs the Queensbury Town
Clerk to publish the Notice of Public Hearing presented at this meeting and send a copy of the Notice
to neighbors located within 500' of the applicant's property as required by law.

Dear John:
Submitted for your distribution are nine sets of a Board of Health wastewater system variance
application for a single family residence located at 25 Hanneford Road. Chris&Barbara Boyd
are under contract to acquire the property with a closing scheduled by mid-November. Included
with the application is a copy of the real property sales contract and a copy of the proposed deed.
The application documents include the following:

• Variance Request Narrative
The variance request is a result of special circumstances related to the unique conditions on this
property. The parcel is accessed from Hanneford Rd. but has frontage along Pilot Knob Rd.
There is a significant grade change (25'+) from the house area down to the proposed area of the
absorption field and piping between the upper and lower septic tanks will traverse a rather steep
slope. The piping in places will be exposed (not buried)but will be wrapped in insulation and
secured to the rock. This is certainly not conventional but it should be noted that the property to

the south has a similar tank and piping system and an absorption field at the base of the rock
slope. That system was approved by the Town and installed within the past eight years.
I am available to meet with you and/or other Board members to further discuss this proposal prior
to the public hearing. I would suggest a site meeting to fully understand the existing and

VARIANCE REQUEST
Due to the special circumstances of the existing site conditions for this pre-
existing parcel the proposed replacement wastewater system will require
several variances from the Town of Queensbury Sanitary Sewer Ordinance
- Chapter 136. As indicated herein and shown graphically on Sheet V-2 we
request relief from the referenced standards.
