Conveying also a right-of-way and easement in common with the party of
the first part, its successors and assigns , for •ingress and egress for
all form of motor vehicle and foot traffic over the following described
parcel: BEGINNING at a point on a 50' macadam roadway running easterly
and westerly from Everts Avenue in the Town of Queensbury to Bay Road,
which point marks the northeast corner of a parcel of land conveyed by
John Kubricky & Sons, . Inc. to the Warren and Washington Industrial
Development Agency by deed dated June 30, 1977, which deed was recorded
in the Warren County Clerk' s Office on June 30, 1977 in Book 606 of
Deeds at Page 334 at a concrete monument set in the westerly bounds of
Everts Avenue in the Town of Queensbury; running thence N. 81° 38 ' 20"W.
a distance of 1356 .93 feet to an iron pipe set at the edge of the con-
crete walk on the easterly side of Bay Road in the Town of Queensbury,
which iron pipe is 0. 77 feet from a drill hole in said walk; running
thence N. 07° 50' E. a distance of 50 feet to a railroad spike set;
running thence S. 81° 38 ' 20" E. a distance of 1356 .27 feet to a point
marked by a railroad spike set in the macadam on the westerly side of
Everts Avenue in the Town of Queensbury, which point is alsothe south-
easterly corner of Parcel 1 herein described; running thence S. 07° 04'
40" W. along the westerly side of Everts Avenue a distance of 50 feet
to the point or place of beginning.
Said right-of-way shall be in perpetuity or until said roadway or its
substitution herein provided shall become a town highway and the party
of the first part shall maintain said right-of-warr,for ,Said len .th of
