The floor elevation of the breezeway would be raised to eliminate steps at both doors, which would comply with the Code requirement to provide a landing on both sides of an outswing door. The residence is used on a temporary basis, and when unoccupied, in winter, snow and ice accumulate on the concrete platform creating a safety hazard and at times prevent opening of the outswing door. Another serious safety hazard and Code violation is the total lack of guardrails at numerous platform and stair locations. The current site was developed beyond the Town's current criteria regarding impervious surface and FAR prior to the DiMartinos' purchase in 1996. A deed survey,prepared by VanDusen& Steves in 1996 is not sealed and signed, a requirement from which a waiver is requested. Side yard setbacks are noted and the proposed breezeway will not encroach on the 12'-0 current side yard requirements Mr. & Mrs. DiMartino are aware of the developed status of the property, therefore, are seeking minimal additional relief to correct an ongoing safety issue.
