Leigh P. Beeman" Town of Queensbury, Warren County, New York,

1999, and filed in the Warren County Clerk's Office on September
8, 1999 as Map Number 99 in Map Cabinet B, Sleeve 129.
This conveyance is subject to the following covenants,
restrictions and easements, which
shall run with the land:
1. All restrictions, covenants, conditions and easements of •
I record, to the extent they are presently in force and effect, and
zoning and land use regulations.
2. Water line easements benefitting lots 1 and 2 as shown
on a map entitled "Map of a Proposed Subdivision made for Leigh ;
P. Beeman" dated April 25, 1995 and revised on March 23, 1996,
made by Coulter & McCormack, LS, and filed in the Warren County
Clerk's Office on June 6, 1996 in Plat Cabinet B at Slide 68.
3. All conditions of the Town of Queensbury Planning Board
and Zoning Board of Appeals imposed on the 1999 subdivision,
1 which subdivision is shown on said map by VanDusen & Steves,
which conditions shall also be covenants and restrictions running
with the land, including the following:
a. There shall be no further subdivision of the
lakefront, provided however, that the non-lakefront acreage
of Lot A may be further subdivided, upon a proper
application to the Town of Queensbury.
b. There shall be no use of the lakefront for
contractual access to the Lake by the remaining acreage of
Lot A.
c. No new docks maybe
constructed cted on the lakefront,
but the existing docks may be modified, within the allowable
regulatory limits.

e. The existing driveway shall be barricaded at the 1
property line, and neither lot shall have any right-of-way $
over the other.

4. For the benefit of both Grantor and Grantee herein, and t,
their heirs and assigns, all further subdivisions of Lot A shall

be subject to the same covenants and restrictions as Lots 1 and 2
x as shown on a map entitled "Map of a Proposed Subdivision made
for Leigh P. Beeman" dated April 25, 1995 and revised on March
Sae 23, 1996, made by Coulter & McCormack, LS, and filed in the
' Warren County Clerk's Office on June 6, 1996 in Plat Cabinet B at
G Slide 68. excepting covenants #3, #6, and #16, as such covenants
are described in, inter_alia, a deed from Leigh P. Beeman,
GO Executor, to Leigh P. Beeman, dated September 13, 1996 and filed
in the Office of the Warren County Clerk on September 16, 1996 in
Book 993 of Deeds at Page 202 and in a Release of Restrictive
Covenant between Leigh P. Beeman and William A. Wetherbee dated
August 26, 1999 and filed in the office of the Warren County
' Clerk on August 26, 1999 in Book 1129 of Deeds at Page 313 .
Covenant #7 therein shall be modified so as to allow the creation
of four additional lots from Lot A of a minimum size of 1 acre
each, subject to paragraph 3 above.
Being a portion of the premises described in the following
deeds:
1. Colgate Phillips to Leigh P. Beeman, dated December 16,
1980, and recorded in the Warren County Clerk's Office on
December 31, 1980 in Book 636 of Deeds at Page 584.
2 . Leigh P. Beeman, Executor of the Last Will and Testament
of Colgate Phillips to Leigh P. Beeman, dated September 13, 1996,
and recorded in the Warren County Clerk's Office on September 16,
1996 in Book 993 of Deeds at Page 202.
Together with the appurtenances and all the estate and
rights of the Grantor in and to said premises,
To have and to hold the premises herein granted unto the
Grantee, her successors, heirs and assigns forever.
And said Grantor covenant as follows: •

First, That the Grantee shall quietly enjoy the said
premises;
Second, That said Grantor will forever Warrant the title to
said premises.
Third, That in compliance with Section 13 of the Lien Law,
the Grantor will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of
the same for any other purpose. '
