Special Use Permit General Criteria

A. Comment: Harmony with Comprehensive Plan. The proposed use shall be in han-nony with and promote
the general purposes and intent of the Comprehensive Plan, and this chapter and the health, welfare and
safety of the Town and its residents,
Response: The proposed Faden Enterprises Site Plan furthers and is consistent with the policies
of the Town's Comprehensive Plan. The proposed pro ject uses are in accordance with the
underlying Main Street(MS)zoning district and the proposed project expands on the existing
commercial uses along Main Street that are outlined as a goal of the Town's Comprehensive
Platt.
B. Comment: Compatibility, The proposed use shall be compatible with the character of neighborhood,the
area, the zoning district and the community surrounding the location of the proposed use and will not
unduly prohibit or discourage future planned growth in the area.
Response. The Faden Enterprises site plait is in harmony with general purpose and intent of
the underlying Main Street(MS)zoning district and the Towns Comprehensive Plan. The
location, character and size of the proposed uses and structures are in accordance with the
zoning requirements and blend appropriately y ly with the surrounding neighborhood and uses.In
addition to the above the project includes design features such as pedestrian connections and
potential future vehicle interconnections that will help to promote future planned growth in file
area.
C. Comment: Access,circulation and parking. The proposed use shall have safe and efficient access for
pedestrians and vehicles, and shall provide for appropriate off-road parking and loading areas. The interior
circulation system must be adequate to provide safe accessibility to all parking spaces and ensure that
adequate and safe integration of pedestrian and vehicular movement is provided.
Response: The proposed project uses are in accordance with the underlying Main Street(MS)
zoning district and the proposed project expands,on the existing commercial uses along Main
Street that are outlined as a goal of the Town's Comprehensive Plan. The proposedparking and
loading facilities are in accordance with the zoning requirements and blend appropriately with
the surrounding neighborhood and uses. The parking areas and the associated access
management for the project are proposed to provide for th esafe and efficient movement of
vehicle in and out of the site. The proposed parking on the side of the building is consistent with
other uses along the Main Street(MS)zoning district and has no negative effect on the
surrounding areas. The proposed driveways exceed the,minimum twenty foot wide requirement
and potential future linkage opportunities are accoin its odatedfor and available with the
proposed plan. The project will provide additional commercial services without creating a
significant impact on the existing road intersections, road all d driveway widths, and traffic
controls.
D. Comment: Infrastructure and services. There shall be sufficient infrastructure and services, including
utilities, public facilities and services, available for the proposed use or the project shall extend or provide

infrastructure and services for the area where the proposed use is located. There shall also be facilities and
services implemented by the applicant to appropriately control any potential nuisances from the operation
of the use, such as control of litter or trash, loitering and crime prevention, and any other features or
aspects of the operation of the proposed use that may affect the public safety, health and general welfare.
Response: The proposed project provides storrnwater collection, conveyance and infiltration to
the greatest extent practical for the relative small site.Site soils are characterized as sandy soils
which are excellent for infiltration.All aspects of the storntwater design will be adequate and
are proposed in accordance with the drainage standards of Chapter 147 of the Town Code and
the Town of Queensbury Subdivision Regulations where applicable. The proposed project
inchrdes service connections to the public water supply and public sewage disposal facilities. All
aspects of the water supply and sewage disposal facilities will be adequate and are proposed in
accordance with the current requirements set forth by Department of Health regulations and
Chapter 136 of the Town Code. The project includes a waste receptacle area to manage
liter/trash and site lighting clear site lines to deter loitering and crime. It is our opinion that the
project will not have an undue adverse impact on the public safety, health and general welfare
of the overall community.
L. Comment: Environment and nature features. The proposed use shall be compatible with and
appropriately protect environmental and natural resources, including the environmental and physical
suitability of the site for development, and the general landscaping, screening and buffering shall be in
character with the surrounding areas, and the risk of fire, flood or erosion and impacts such as emissions
of electrical charges, dust, light, vibration or noise detrimental to the public health, safety and welfare shall
be minimized to the maximum extent practicable.
Response: The proposed project rises are in accordance with the underlying Main Street(MS)
zoning district and the proposed protect expands on the existing commercial uses along Main
Street that are outlined as a goal of the Town's Comprehensive Platt. All aspects of the site plait
are proposed in accordance with the Town of Queensbury Town Code and the Town of
Queensbury Subdivision Regulations where applicable. It is our opinion that the project design
and regulations provide adequate measures to insure that the proposed use is compatible with
and appropriately protects environmental and natural resources, including the environmental
and physical suitability of the site for development, and the general landscaping,screening and
buffering is in character with the surrounding areas, and the risk offr.re,flood or erosion and
impacts such as entissions of electrical charges, dust, light, vibration or noise detrimental to the
public health,safety and welfare are minimized to the maxirnurn extent practicable.
T. Comment: Long-term effects. The proposed use shall provide positive or beneficial effects on long-term
economic stability, environmental integrity and community character of the Town and surrounding
properties, districts and uses.
Response: The proposed Farlen Enterprises Site Plan furthers and is consistent with the policies
o f the Town's Comprehensive Plan. The proposed project uses are in accordance with the
underlying Main Street(MS) zoning district and the proposed project expandv ort the existing
commercial uses along Main Street that are outlined as a goal of the Town's Comprehensive
Plat.It is our opinion that this project will provide long terur positive and beneficial effects on
long-term economic stability, environmental integrity and community character of the Town
and surrounding properties, districts and uses.
