Dear Mr. Brown:
The Chazen Companies (Chazen) has received a submission package from your office for the above
referenced project. The applicant intends to construct a delicatessen on a 1.35 acre parcel. Submitted
information includes the following:
• Site Plans and Details prepared by Nace Engineering, PC,January 15,2016;
• Stormwater Pollution Prevention Plan prepared by Nace Engineering, PC,dated January 2016;
• Architecture Plans by JFM Architect,dated January 14, 2016;
• Site Plan Review Application and Project Narrative;

• Warren County Deed information, and;
• Street lamp information;
Your office has requested that we limit our review to the design of stormwater system as it relates to
compliance to local, state or relevant codes and regulations. Based upon our review, Chazen offers the
following comments for the Town's consideration:
Stormwater Management& Erosion and Sediment Control:
1. The project proposes to disturb over 1 acre of land and requires the preparation of a
Stormwater Pollution Prevention Plan (SWPPP) in accordance with GP-0-15-002 that includes
erosion and sediment controls as well as post construction stormwater management practices.
A Stormwater Pollution Prevention Plan (SWPPP) has been provided. Comments relating to the
Stormwater Management Report and SWPPP are offered below.

2. It does not appear that an NOI was provided with the SWPPP; the Applicant shall provide a
completed NOI with the next submission.
3. It does not appear that the contractors/subcontractors certification statement is included in the
SWPPP. Part III.A.6 of the General Permit describes the contractor/subcontractor certification
requirements,which the Applicant shall include in the SWPPP.
4. The Stormwater Control Facility Easement and Maintenance Agreement appear to reference the
wrong facility owner(Concord Pools);the Applicant to revise.
5. The Applicant shall revise bullet 2 of the Stormwater Control Facility Easement and Maintenance
Agreement to include the subsurface infiltration beds.
6. It does not appear that all of the Required SWPPP Contents as detailed in Part 111.13 of the
General Permit are provided in the SWPPP. For instance,the required contents described in Part
III.B.2.c(i), (iii), (iv), and III.B.2.f do not appear to be provided. These sections refer to the pre-
development model and results, which do not appear to be provided and an operations and
maintenance plan that includes inspection and maintenance schedules and actions to ensure
continuous and effective operation of each post-construction stormwater management
practices.
7. The subsurface infiltration bed detail does not appear to depict an observation well or, in
general, a means of inspecting and/or maintaining the facilities. The Applicant shall include the
manufacturer's maintenance and inspection procedures in the SWPPP and in the subsurface
infiltration bed detail.
8. Section 6.3.6 of the NYS SMDM states that "Infiltration practices shall never serve as a sediment
control device during site construction phase." The erosion plan (SP-5) depicts temporary
sediment basins within infiltration areas 1,2, and 3P. Per Section 6.3.6,the Applicant shall revise
the design so sediment control practices are not located within infiltration practices.
9. The Developed Conditions HydroCAD model does not provide distinct inflow value depths,
which indicates that the time span of 0-20 hours may not be sufficient. Although this may not
affect the results the Applicant shall revise the time span such that the full effects of each storm
are realized.
10. Section 6.3.3 of the NYS SMDM states that if the infiltration rate for the underlying soils is
greater than 5.00 inches per hour, 100% of the WQv shall be pre-treated prior to entry into an
infiltration facility. It does not appear that WQv calculations and pre-treatment calculations
were provided in the SWPPP. It is difficult to discern from the site plan where the pre-treatment
facilities/features are located.The Applicant shall provide WQv calculations per the NYS SMDM.
The Applicant shall revise the design to provide 100%WQv pre-treatment per the NYS SMDM.
11. The proposed grading at the northern entrance of the site on Dix Avenue (N.Y.S. Route 32)
slopes generally towards Dix Avenue and as such stormwater may sheet flow onto Dix Avenue.
Since Dix Avenue/NYS Route 32 is a NYSDOT road, a highway work permit will be required to
construct the entrance. Typically NYSDOT requires that stormwater runoff generated from the

site be managed on site, and not be allowed to drain to the road. As such, it is requested that
the Applicant coordinate with NYSDOT and confirm the final grading at this location.
12. It does not appear that the SWPPP includes information and determinations regarding
endangered or threatened species as well as archeological sensitive areas. It appears that the
EAF states the proposed action is located in an archeological sensitive area. The Applicant shall
provide the town with any documentation regarding the above determinations and incorporate
the same into the SWPPP pursuant to sections Part I.F.4 and I.F.8 of the SPDES General Permit.
13. The Applicant shall depict the stabilized construction entrance on the erosion and sediment
control plan; it appears that only a callout is depicted on the plans.
14. Section 6.3.1 of the NYS SMDM states that, "Infiltration practices cannot be placed in locations
that cause water problems to downgradient properties. Infiltration trenches and basins shall be
setback 25 feet downgradient from structures and septic systems. Dry wells shall be separated a
minimum of 10 feet from structures."The infiltration trench located at the southwest corner of
the site is within 12 feet of the septic system. The subsurface infiltration beds near the garage
are located within 15 feet of the building.The Applicant shall revise the design to conform to the
separation requirements of the NYS SMDM.
