Your office has requested that we limit our review to the design of stormwater management and erosion and sediment control items as it relates to compliance to local, state or relevant codes and regulations. Based upon our review of the information provided, Chazen offers the following comments for the Town's consideration: Stormwater Management& Erosion and Sediment Control: 1. The proposed site development disturbs less than I acre of land and will not be subject to NYSDEC Phase 11 Stormwater Regulations. However, this project falls within the Lake George watershed and will be subject to the stormwater management requirements set forth In section 147-11 of the Town code, for projects within the Lake George Park. The project proposes to disturb approximately 11,000 square feet and is considered a"minor" project. 'rhe Chown companies�Inc, Town of Qu ecus Brett and Pamela West March 9,2016 Page 2 2, Section 147--11-1(2)(e) of the Town code states that "The bottom of any infiltration device shall be a minimum of two feet above seasonal high groundwater mark and two feet above,bedrock," The Applicant proposes 1-foot of separation and is seeking 1-foot of relief to this requirement, for the stone Infiltration trench and portions of the permeable paver driveway proposed for tile site. Also, Section 147-11-I(2)(c) of the Town code states that "Infiltration devices for roadways, parking lots and other areas subject to vehicle traffic shall not be installed within 100 fleet of any water wett, wedond or water body," The Applicant proposes 50A feet of horizontal separation and Is seeking 49.6-feet of relief from this requirement, This relief Is requested for portions of the proposed permeable paver driveway, which is a proposed replacement of the existing asphalt driveway, generally along the same area and dimensions. It is noted that this office recognizes that the proposed plan reduces the total Impervious area of the parcel when compared to existing conditions, Further, it provides facilities for stormwater management, where no facilities appear to have previously existed (under the existing condltlon).When viewed in those terms,the proposed plan may be considered an improvement in regard to stormwater management over that of the existing site. 1 The Applicant shall ensure neighboring drinking water supplies, if applicable, conform to Section 147-11(i)(2)(c)of the Town code. The Applicant shall determine where, If any, neighboring wells exist, and if so, that the proposed inflItration devices that treat runoff from the roadways/driveways are separated from said wells by 100-feet pursuant to the referenced code provision, 4, The Applicant shall ensure the specific erosion control measures prescribed Section 147-11-1 (i.e. 147-11.J(3)(b)and(c))are Included In the erosion control notes, Conclusions and Recommendations It Is our opinion that the applicant should provide clarification for the above items and incorporate the changes in subsequent plan submissions.
