1975-11-25 1 419 I RESOLUTION TO DENY PERMIT FOR LANDFILL RESOLUTION NO. 210 Introduced by Mr. Robertson who moved its adoption, seconded. by Mr. Robillard, WHEREAS, the City.of Glens Falls made application to this Town Board for a permit to.operate a landfill in. the Townsof Queensbury on premises adjacent to the existing city landfill, and WHEREAS, the Town Board conducted a public hearing upon notice as required by law giving those persons in favor of the proposition and those persons opposed to the.proposition an opportunity to.be heard, now therefore be it RESOLVED, that the application of the City of Glens Falls for `— permission to operate a landfill facility in the Town of Queensbury adjacent to the existing City landfill be denied on the grounds that the same is not in the public interest of the Town of Queensbury, and its inhabitants, and that the materials submitted by the apicant are inconsistent and unclear as to the water conditions affecting the proposed site. There are several trailers in the vicinity. The lot will be conforming." Hearing Opened: Mr. & Mrs. Brown were present. Mrs. Brown stated . that expenses were going up and they could not af6ord this and that she could have a ride to work with a neighbor there as long as she worked. . . No one spoke in opposition to the application Councilman Robillard-questioned if there were other mobile homes and houses in the area. . . Mr. Boynton-there are mobile homes and some houses. . . Councilman Olson-have you bought the lot? Mrs. Brown-not until we can get the permit. . . Councilmen Robillard-noted that he could see the hardship by illness and would not disapprove the application... . also noted that the board will have to take a long hard look at the direction the board will take in the future most the mobile homes do not meet the building code of the town. . . we are defeating the purpose of the ordinance by allowing mobile homes out of the courts. . . Councilman Olson-seconded the motion—also would warn other applicants that they have other expenses outside a court that they do not have in the court such as taxes ect. Councilman Robillard-asked the Building Dept. to discourage people that live in mobile home parks from applying for outside the parks. . . Do not feel that economic reason were not sufficient that they will have to have more of a reason. . .for hardship. . . Councilman Robertson-we have to take a real hard line if someone havr something besides economic hardhhip they I am willing to 1 . . . Councilman Olson-will the building department look into the building code on mobile homes and also the tie down requirements. . . Mr. Liapes- we are enforcing the tie down requirement on the new applications. , Councilman Barber-noted that. the mobile'. home did.not meet the requirements of the building code. . . Brown have made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled; ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home at property situated on Luzerne Road, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it. is hereby determined that the facts presented in said application. and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to Florence and Albert J. Hovey, bequeathed the sum of FIVE HUNDRED DOLLARS ($500.00) to the PineView Cemetery under her Last Will and Testament, to be used for the care and maintenance of specific monuments and graves in the Pine View' Cemetery, and WHEREAS, the Cemetery *Commission of the Town of Queensbury h$s explored the possibility of acceptance of said bequest, but has made the determina- tion that the acceptance of the same, coupled with the provisions provided under the Last Will and Testament of Mazella H. Hovey could not be complied o')"I with, and WHEREAS, the Cemetery Commission of the Town of Queensbury, has recommended and advised its Town Board to renounce the aforesaid bequest. In a discussion,regarding the _bids on Police cars with the Chief it was decided to table the bids at this time for consideration by the Chief and the Committee. There seemed to be a problem with the bids because the VD three lowest bidders did not furnish, a Non-Collusive form with their bids. Town Counsel, David Little informed the Board that the bids without a Non- CV Collusive were not a valid bid.
