Petitioner's Agent DECISION On Behalf of Case(s) 1- 2 William Barrett ICR 56 Petitioner in re Premises: Demolished Structure 25 Main Street Glens Falls, NY 12801 Exterior Friable & Non-friable Debris Cleanup & Removal The Petitioner, pursuant to Section 30 of the Labor Law, having filed Petition No. 12-0851 on July 13, 2012 with the Commissioner of Labor for a variance from the provisions of Industrial Code Rule 56 as hereinafter cited on the grounds that there are practical difficulties or unnecessary hardship in carrying out the provisions of said Rule; and the Commissioner of Labor having reviewed the submission of the petitioner dated July 12, 2012; and Upon considering the merits of the alleged practical difficulties or unnecessary hardship and upon the record herein, the Commissioner of Labor does hereby take the following actions: Page 2 of 3 File Number 12-0851 Case No. 1 ICR 56-11.2(f) Case No. 2 ICR 56-11.5 VARIANCE GRANTED. The Petitioner's proposal for cleanup of the exterior friable & non-friable debris on the ground and the dumpster, 600 sq. ft. of debris on the ground, 30 yards on the foundation & 30 yards in the dumpster, at the subject premises in accordance with the attached 6-page stamped copy of the Petitioner's submittal, is accepted; subject to the Conditions noted below: THE CONDITIONS 1. Full time project monitor shall be on site and responsible for oversight of the abatement contractor during all cleanup and abatement activities to ensure compliance with ICR 56 and variance conditions. 2. All provisions of Section 56-11.5 "Controlled Demolition with Asbestos on Place" shall be followed for the removal and cleanup of the exterior debris. The generated ACM waste shall be disposed of as RACM. Dumpster Cleanup: 3. The regulated work areas, decontamination units, airlocks, and dumpster areas shall be cordoned off at a distance of twenty-five feet (25') where possible, and shall remain vacated except for certified workers until satisfactory clearance air monitoring results have been achieved or the abatement project is complete. These areas shall have Signage posted in accordance with Subpart 56-7.4(c) of this Code Rule. 4. No dry disturbance or removal of asbestos material shall be permitted. 5. Transfer of debris from the unprepared dumpster to a double lined dumpster shall take place in a negative pressure tent enclosure with an attached decontamination unit as per 56-7.11 (f) (1) and 56-7.5. The tent shall enclose both dumpsters. 6. A minimum of 4 air changes per hour must be observed once the negative air has been established. A minimum four-hour pre-abatement settling period as per 56-8.2(b) shall elapse once the negative air has been established. 7. Material shall be double bagged prior to being put in the lined dumpster. 8. After transferring the materials out of the dumpster, the dumpster shall be wet-wiped and HEPA vacuumed inside and outside. 9. The Project Monitor shall inspect 25 feet area around the dumpsters to ensure that no visible debris are present around the dumpsters. If visible debris are present, these debris shall be cleaned up. Page 3 of 3 File Number 12-0851 10.The Project Monitor shall perform a visual inspection of the dumpster prior to aggressive final samples in accordance with ICR 56-9.2(d).. 11.Usage of this variance is limited to those asbestos removals identified in this variance or as outlined in the Petitioner's proposal. In addition to the conditions required by the above specific variances, the Petitioner shall also comply with the following general conditions: GENERAL CONDITIONS 1. A copy of this DECISION and the Petitioner's proposals shall be conspicuously displayed at the entrance to the personal decontamination enclosure. 2. This DECISION shall apply only to the removal of asbestos-containing materials from the aforementioned areas of the subject premises. 3. The Petitioner shall comply with all other applicable provisions of Industrial Code Rule 56-1 through 56-12. 4. The NYS Department of Labor Engineering Service Unit retains full authority to interpret this variance for compliance herewith and for compliance with Labor Law Article 30. Any deviation to the conditions leading to this variance shall render this variance Null and Void pursuant to 12NYCRR 56- 12.2. The lawn and driveway has varying amounts of cement board chips and pieces, most likely from the residence siding. This was probably dispersed by the demolition activities. There is a full dumpster at one end of the driveway. No friable materials or obvious friable ACM was located (i.e. pipe or boiler insulation)were located outside the foundation hole and the dumpster. As no pre-demolition survey was performed, and the building is now mostly demolished, we wish to continue the project as ICR-56 11.5"Demolition with Asbestos in Place". Relief Requested Do not wish any relief from ICR-56 11.5"Demolition with Asbestos in Place". The Dumpster is full and ready for disposal. It would be a hardship, and a safety hazard to transfer this waste to a separate unit. We suggest emptying the top layer of debris out to get to the point where a hard top can be placed on the unit (plywood and bracing over 2 layers of 6 mill poly). This unit will then be taken to an appropriate facility, then returned to the site,with the hard top,for cleaning.
