Subsequent to that Notice, meetings have occurred between Tim Barber, the; current owner of 35 Jnglee "lo untain Road and the!Town regarding the alleged violations of the: Subdivision and Site Plan Regulations. This application being submitted in consultation.with the Town.of'Queeinsbury Planning:Department seeking to resolve all outstanding issues,. It is noted that the adjoining owner, Jason P. Sankey, is in litigation with the owner of 35 in lee M'ountain Road,, and this application isbeing made by b,oth parties in arra Pt to also settle that litigation. The Town of Queensbury has determined that work on the existing driveway on 35 and 48 Tangle e Mountain Road occurred on slopes over 15%, thus requiring Site Plan Review. As the existing dnveway was not shown on the original, Subdivision Plan, prepared in 20,0 1, that created the lots, a subdivision modi fication is alsR required to be approved.by the Town of Queensbury Planning Board. As part of the agreement between Inglee/Barber and Sankey, aland transfef will occur. That land, transfer will result in the elimination of Lot 3, as shown on the 200 1 Subdivision Plan.
