2.07 2.7 RESOLUTIONS\LOCAL LAWS R ORDINANCES\SET PUBLIC HEARING\TERMS OF BOARD MEMBERS'OFFICES-8-1-16 RESOLUTION SETTING PUBLIC HEARING ON PROPOSED LOCAL LAW NO. _ OF 2016 INCREASING TERMS OF OFFICE OF TOWN BOARD MEMBERS FROM TWO YEARS TO FOUR YEARS RESOLUTION NO.: , 2016 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board wishes to consider adoption of Local Law No.: of 2016 to increase the terms of office of the Town Board members other than the Town Supervisor from two (2) years to four (4) years commencing with the term that begins January 1, 2018, and WHEREAS, this legislation is authorized in accordance with New York Municipal Home Rule Law §10, and WHEREAS, Municipal Home Rule Law §20 requires the Town Board to hold a Public Hearing prior to the adoption of any Local Law; NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board shall meet and hold a Public Hearing at the Queensbury Activities Center, 742 Bay Road, Queensbury at 7:00 p.m. on Monday, August 15, 2016 to consider proposed Local Law No.: of 2016 and to hear all interested persons, and at that time may take any other actions authorized by law concerning proposed Local Law No.: of 2016, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Queensbury Town Clerk to publish and post a Notice of Public Hearing concerning proposed Local Law No. of 2016 in the manner provided by law. Duly adopted this 1St day of August, 2016, by the following vote: AYES NOES ABSENT: LOCAL LAWS\TERMS OF OFFICE-BOARD-8-15-16 TOWN OF QUEENSBURY LOCAL LAW NO. - 2016 A LOCAL LAW INCREASING TERMS OF OFFICE OF TOWN BOARD MEMBERS FROM TWO YEARS TO FOUR YEARS Be it Enacted by the Queensbury Town Board as Follows: Section 1. Intent, Authority — The purpose of this Local Law is to permit the Town of Queensbury to increase the terms of office of the Town Board members other than the Town Supervisor from two years to four years. It is adopted pursuant to New York Municipal Home Rule Law Section 10. Section 2. Increase Terms of Office — The terms of office of the Town Board members other than the Town Supervisor are hereby increased from two years to four years commencing with the term which begins January 1, 2018. Section 3. Repealer; Supersession — All Local Laws or Ordinances or parts of Local Laws or Ordinances in conflict with any part of this Local law are hereby repealed. In particular, this Local Law is intended to supersede that portion of New York Town Law Section 85 which provides for two year terms of office for Town Councilmen under the ward system. Section 4. Severability — The invalidity of any clause, sentence, paragraph or provision of this Local Law shall not invalidate any other clause, sentence, paragraph or part thereof. Section 5. Effective Date — This Local Law shall be subject to mandatory referendum at a general election and, if approved, shall take effect upon filing by the office of the New York Secretary of State. 6 NOTICES\Terms of Office—Town Board.Clerk and Highway Supt—8-15-16 NOTICE OF PUBLIC HEARINGS ON PROPOSED LOCAL LAWS INCREASING TERMS OF OFFICE OF TOWN OF QUEENSBURY HIGHWAY SUPERINTENDENT, TOWN CLERK AND TOWN BOARD MEMBERS FROM TWO YEARS TO FOUR YEARS NOTICE IS HEREBY GIVEN that the Queensbury Town Board will hold two public hearings on August 15, 2016, beginning at 7:00 p.m. at the Queensbury Activities Center, 742 Bay Road, Queensbury, New York, concerning proposed Local Laws Nos. and of 2016. The proposed Local Laws would increase the terms of office of the Town Highway Superintendent, the Town Clerk and members of the Town Board other than the Town Supervisor from two years to four years. If adopted by the Town Board, the Local Laws will be subject to mandatory referendum at the November 8, 2016 general election. If approved at the November 8, 2016 election, the Local Laws will apply to the Town Highway Superintendent, Town Clerk and Town Board members who are elected for terms of office beginning January 1, 2018 and thereafter. Copies of the proposed Local Laws are on file in the Town Clerk's Office and may be reviewed during normal business hours and are also available on the Town's website at www.queensbury.net.
