REGULAR TOWN BOARD MEETING, 09-12-2016, MTG#28 646 JOHN SALVADOR, NORTH QUEENSBURY-I am a resident in North Queensbury and a member of the Advisory Board of this North Queensbury Wastewater Disposal District. My only comment tonight is that this public hearing is premature. The Advisory Board is not scheduled to meet until Thursday of this week to set our goals for next year. I would assume that the goals convert to cost. Cost has to be raised through taxes. You have the cart before the horse. We still haven't gotten any reports on progress we were supposed to make this summer on algae inspection. It has been pushed off at this time. I would think there is no way to establish the tax without knowing the scope. The other thing is I know the Town has engaged the services of a Technical Consultant to work on these sorts of projects. This person is going to apply for grants that administer grants. We are working under a grant. It has to be administered. Will this person cost our district anything... What is the Town's intention in this regard? Are you going to continue to absorb the cost of these experts in the general fund? Are you going to begin to back charge them where they belong in the district? Believe me the cost of a Technical Consultant over this minuscule amount of tax that we are collecting isn't going to work. Not only that, if it does work someday, then the tax is going to be onerous with a few participants that we have in the district. SUPERVISOR STROUGH-John for the purposes of setting up the budget for North Queensbury Wastewater Disposal District was a little bit behind in getting the information to us. As far as the leadership knew and at this time the allocated amount for the benefit tax roll seem to be sufficient for what they foresaw as of now. Your concerns and questions are legitimate. I think that if you go beyond you already have eight thousand four hundred ($8,400.00) into the account. If you go beyond that this will add an additional four thousand two hundred ($4,200.00) to that account. If you go beyond that then maybe we could possibly amend this, but there is certain budget chronological order that we have to meet. Approving it as this time does meet that or this. Down the road, like I said, your concerns were legitimate. They need to be addressed, but I think we can address that in terms of amending this if it needs amending in the future. MR. SALVADOR-You should not forget that these seventy two (72)participants in this district agreed to levy a tax of themselves because the tax was insignificant. If we get sucked into financing the services of consultants and everything else whereby the scope of the district is expanding it is not going to work. SUPERVISOR STROUGH-We can talk about that. It might be entirely possible that the consultant you are referring to would be paid through grant funding that is already in place. MR. SALVADOR-Our grant funding has been spent. The Map, Plan, and Report has been completed. COUNCILMAN IRISH-You mean for your district though. I think John is talking about a broader grant, correct? Not just for North Queensbury? MR. SALVADOR-Eventually all of these districts will probably be consolidated into one. I just don't want us to get into bad habits. SUPERVISOR STROUGH-I understand where you are John. I think you are accurate. Anybody else like to speak to North Queensbury Wastewater Disposal District Benefit Tax Roll? Seeing none any questions or thoughts on behalf of the Board? COUNCILMAN CLEMENTS-You are talking about rather than leaving this opened passing it now and then going back and amending it later. SUPERVISOR STROUGH-That is correct if we need to. I am not so sure we will need to because there is grant money out there that I think we can supplement this with, but we will see, but for now we need to get this established. PAUL DERBY, 86 ASH DRIVE-President of Glen Lake Protective Association, I am also Chair of the Glen Lake Advisory with the Town. First, I want to thank the Town for the ongoing investment in the health and welfare of Glen Lake. I also want to thank the County for their invasive species grant funding, which has helped us to offset much of the cost. Generally Glen Lake is in pretty REGULAR TOWN BOARD MEETING, 09-12-2016, MTG#28 648 good shape. The water clarity is very good. Recreation is very good in the summer. Property values are rising. However, we still have problems with invasive species in particular Eurasian water milfoil. Last Friday, five (5) DEC Officials, Supervisor Strough, myself and two (2) Lake Biologists took a float of Glen Lake. To look at the condition, talk about strategies for the future. Everyone agreed that we have Eurasian milfoil at the outlet bay. That is going to need some aggressive treatment next year. Likely that would be herbicides. It was also made very clear that in the future we need to have an integrated approach to managing the lake in addition to herbicides and harvesting, which we have done. Maybe suctioning harvesting ....etc. I thought it was a very useful meeting to get everybody there to see Glen Lake and talk about it. I think that in the future they will be able to get together to have timely treatment of the lake. One of the issues we had is we wanted to do treatments early in late May to early June. So that we can target invasive species, milfoil and still minimize our impact on native plants, which we want to have and continue to have. I thought this was very good. The hundred and thirty ($130.00) rate, which is the same as last year was set by the committee. The reason is to maintain an adequate budget to...at the lake. I can answer any questions if you have them. SUPERVISOR STROUGH-The Lake is looking good. Like they said, they wish there was a little bit more vegetative diversity. You already addressed that an early use of the herbicide would allow the native plants a greater likelihood of expanding. It is just that with the later application of the herbicide it might be even damaging some of the native plants. So we are going to work on improving that. I think overall you have done a nice job with the lake. You have a good management plan in place. I have to give you credit where credit is due. COUNCILMAN IRISH-I think the only question I have Paul is you have said that it is in good shape. Are we ahead of the infestation or are we just keeping our head above water? MR. DERBY-We are maintaining the status quo pretty much. The reasoning is for the last three (3) years; two (2) years ago we couldn't treat until July 4th; due to them getting through DEC regulations. This last year we were pushed to the end of June, the year before it was late. What happens is that the milfoil is already there at the beginning of the season; it doesn't die out. SUPERVISOR STROUGH-Right. MR. DERBY-It is there before the pond... so if we can get at those and treat them we can get them in control better. You would have less effect on the native vegetation. That is really what we are trying to do. We feel that if we do that we would show a better plant diversity. COUNCILMAN CLEMENTS-So are you going to be able to do that next year? MR. DERBY-What I took out of the meeting is that we are going to get together. We are going to do another aquatic vegetation survey probably at the end of October normally that is done in the spring. We just did one. We will do another one to see what the extent of the growth is this year. That will allow us to kind of see the total growth of the year. Then to meet this fall with DEC biologists...Town and get together to work on a plan so it is done ahead of time rather than late in the spring to be able to treat. BOB HUNTZ, 65 SUNNYSIDE ROAD-I serve as the President of the Protective Association for Lake Sunnyside. I am Chairman of the Advisory Council for the Tax District. First, I would like to say thank you to the Board for allowing us to have a tax district. It has been a great benefit to our lake. It has been in place now three (3) or four(4) years. We have the same kind of problems with invasive species, but we did treat aggressively with sonar in 2014. It has had a tremendous impact on the milfoil. We have had two (2) years last summer and this summer of pretty clear lake. The water is clear and the milfoil is almost in my amateur eyes nonexistent. I see a plant here and there. Our long range plan was to do this aggressive treatment in 2014 and then follow through with harvesting any future weeds that develop. We didn't want to continue to be able to treat with herbicides. The problem with that is it is very expensive. However,we are at that point now, in fact REGULAR TOWN BOARD MEETING, 09-12-2016, MTG#28 650 later in your agenda you have a resolution approving a company to do a contract with us to begin suction harvesting on our lake. We have also discovered that while the milfoil is almost gone we have another invasive called, curly leaf pond weed. It is not nearly as aggressive as milfoil, but it does fog up the lake if left to continue. We are hoping to hire this company to come in and harvest any milfoil found left in the lake and begin harvesting any of the curly leaf pond weed that is found in the lake. We do have quite a bit of money in our tax account now. However, we feel that we need to keep the tax rate at this level one more year so that we are assured that we have enough in case we need a really thorough and long range plan to harvest the lake completely. We have had estimates up to seventy five, eighty thousand($75,000-$80,000 thousand dollars)to do that. We are hoping that we are not going to be anywhere near that, but we will be able to harvest the invasive species that are in the lake with the money that is available in our tax account. I would like to say also Mr. Derby mentioned that Glen Lake has received some benefits grants from the County, and Town in order to keep their lake in good condition. Lake Sunnyside has not been the beneficiary of any of those grants that have been handed down to other lakes. The reason, I normally get for it is because we do not have a public access to Lake Sunnyside, which is true. However, we do pay taxes. We do pay larger taxes because we have lake front property. Maybe some consideration should be given to other lakes, although we are in good shape now. The tax district has allowed us to do that. SUPERVISOR STROUGH-Bob I did advocate for you to get some of that money. MR. HUNTZ-I know. SUPERVISOR STROUGH-I put forward the fact that you have one of the best management plans. It not only deals with the current but you have long terms plans and probably one of the most effective in the area. So, I have given kudos. It didn't work. It doesn't mean we can't stop trying and continue trying. MR. HUNTZ-Well maybe if you do something well nobody wants to help you. COUNCILMAN VANNESS-Bob, I'm putting the cart before the horse. I know Resolution four point eight is going to be the suction of the milfoil. MR. HUNTZ-Yes. COUNCILMAN VANNESS-I would be very interested to see what the outcome of it is. We just happened to be talking about it a couple of weeks ago on why somebody wasn't using this. It is kind of like burying straight gold and all this other stuff. I know they are hand harvesting it in Lake George. I see pieces of the milfoil breaking off and floating away. As we know once that happens it goes off and it lands somewhere else. I would be real interested to see when you get down to it how this suction harvesting goes and how it works out. Hopefully you will let us know how it works out. MR. HUNTZ-I think it will be more cost effective as well as more efficient. If you think about a diver under water pulling out a plant, then stuffing it into a bag, pieces will break off more easily than if he just lifts the plant out and puts it near the end of a hose that is down in the water with him and just sucks it right into the boat and then it gets filtered out on the boat. Also he can work much faster as well. I kind of think logically that it makes sense to me. We will find out. COUNCILMAN VANNESS-I will be interested to see how it comes out. MR. HUNTZ-The Company that we have suggested here for you to approve is currently harvesting Minerva Lake, which is up north near North Creek. It is about an eighty (80) acre lake. It is about twice the size of ours and it is full of milfoil to a point where they are not able to harvest at all this year. It is costing them an awful lot of money. Minerva Lake is only about ten (10) to twelve (12) feet deep everywhere. Milfoil can grow in ten (10) to (12) feet of water. It doesn't grow beyond REGULAR TOWN BOARD MEETING, 09-12-2016, MTG#28 651 fifteen(15) feet. They were very very happy with this contractor with what he has done up there so far. They plan to have him back next year. COUNCILMAN VANNESS-Thank you. SUPERVISOR STROUGH-Thank you Bob. Thanks for all you do. I did ask the DEC about suction harvesting. They said it can be effective. It depends on the company and how careful they are and the filtration system they use. A lot of eyes are going to be on Lake Sunnyside and Aqualogic because if they are effective there I think there will be more work for them. MR. HUNTZ-I would just mention one other thing. I did go up there myself to see them working on Lake Minerva. What they do is the milfoil ends up in a little power boat. When it is full they bring it into shore they put it in a truck and it is hauled away. At some point when we get this company down here, I may be coming and asking if the Town could help us out maybe as they did in Lake Minerva with the Town truck hauling this stuff away to the landfill. Some landscape companies like to get this waste material from the lake this plant life because they can convert into mulch and fertilizer,which is a nice recycling idea. COUNCILMAN IRISH-We have to make sure they don't use any of that around the lake. MR. HUNTZ-Just don't use it in the lake. That's for sure. SUPERVISOR STROUGH-Thank you very much Bob. SUPERVISOR STROUGH-That is an excellent question. I think the peak flow is like one thirty eight(138)? SUPERINTENDENT OF WATER, CHRIS HARRINGTON-Right now what we send to the City of Glens Falls through the main feed meter, we are approximately about eleven thousand (11,000) gallons per day. At full build-out I believe in the Map, Plan, and Report have it calculated out eighty five thousand(85,000). I think when we looked at also Luzerne Road when we look at Main Street; I think we were looking at about a hundred and thirty thousand (130,000) in the corridor there about. We have peak flows. We came up to a number about three hundred gallons (300) a minute. When we did everything together we changed...that's when we may have to upsize the sewer. The City was reasonable. We all know how these things may or may not work out. We agreed that we wouldn't rip up Broad Street right away. We would wait until it's necessary. If it is necessary, we will put a larger pipe. There is a Sunset Clause. Eventually we will go far after fifteen (15) years to upgrade that pipe regardless. Those are the numbers. You can see where they are at. It goes to a meter so we know exactly what is going through to that point at pretty much any point in time. COUNCILMAN VANNESS-We've taken the sewer and basically designated it commercial. It is a commercial sewer non-residential. The other thing as you have seen back when this discussion first started two and a half years ago about putting the sewer in. When we did the one upgrade and we were well aware that the upgrade where it clusters together there is going to have to happen. We are well aware of that. We are prepared for it. Eventually we are going to have to do that. SUPERVISOR STROUGH-We have put a hundred thousand dollars ($100,000) into the Hudson Avenue, Murray Street upgrade for sewer capacity. We could put another three hundred three hundred and fifty thousand($300,000 to $350,000) to the Broad Street upgrade. As Superintendent Harrington pointed out we have a meter. As we approach a certain capacity if it happens before the fifteen(15) year time period we will upgrade that Broad Street line. In any event within fifteen(15) REGULAR TOWN BOARD MEETING, 09-12-2016, MTG#28 653 years we will be upgrading that Broad Street line anyways. We're hoping that this brings good jobs to the Glens Falls Queensbury Region. Light industrial right next to the Exit 18 with an improved Airport you never know. COUNCILMEN IRISH-We have an approved Airport don't we. They fly there now. SUPERVISOR STROUGH-Anybody else, yes sir. LUCAS DOBIE-Just a couple questions. I did not read the Map, Plan and Report. Forgive me it is probably in there. Is the Town putting the pipe in the ground within that one point two million dollar budget? Does that include the directional booring and the laying of the infrastructure? Then the property owners when they develop and put in their own grinder pump to tie into that infrastructure is that the general theme? SUPERVISOR STROUGH-Yes. MR. DOBIE-Do we have any idea on the phasing or the timeline of this project if it moves forward? SUPERVISOR STROUGH-I think we would like to get this all said and done. It has to go to the State from here. They are going to give it their critical eyes as well. I think we could possibly break ground as early as late 2017. If we can break ground in late 2017 we would be done with it by 2018. COUNCILMAN VANNESS-I believe at this time the line is to Stewarts, correct? SUPERINTENDENT. HARRINGTON-Yes. COUNCILMAN VANNESS-As far west as to Stewarts at this point in time now. MR. DOBIE-Very good. Thank you. SUPERVISOR STROUGH-The public hearing is opened. Are there any other members of the public wish to speak? STEVE BORGOS, QUEENSBURY-First, I would like to compliment the Chazen Company. I did read all of the first section and most of the second section very complete very easy to read. I have a few comments though, no special order. I did notice that the financing that has been proposed is for only fifteen (15) years. In real estate most of the investors will look for twenty five (25) or thirty years (30) to keep the current costs down. You mentioned there that it would keep it down I think that we should take a look at that. If you had a fifteen(15) year mortgage on your house instead of a thirty (30) you would pay it off quicker get a lower interest rate. I think in doing major projects that have long anticipated life I think it is wise to look at perhaps a twenty five (25) to thirty (30) year payout. I think the tax free bonding is fairly easy to get for that. SUPERVISOR STROUGH-I think we did have that discussion. Why is it we landed here? SUPERINTENDENT HARRINGTON-We figured the City is going to require us to set up a reserve fund. Like I mentioned before we have to upgrade the Broad Street Sewer in fifteen (15) years so that was part of the calculation. The second part of the calculation is going to be commercial. Your point to do fifteen (15) years to get a better federal loan that was part of the calculation. The other part of the calculation is that we wanted to consolidate the West Queensbury Sewer District and the Carey Road Sewer District. We have a mechanism now to do that. I believe it is this Town Board and everybody else wants to eliminate having all these districts because it is very difficult to manage. The thought is if the notes mature at the same time in 2032 that would be an easier way of doing that consolidating without much of a problem. MR. BORGOS-But it does increase the cost for the first fifteen years for individual users. REGULAR TOWN BOARD MEETING, 09-12-2016, MTG#28 654 SUPERINTENDENT HARRINGTON-Yes for individual users. Again, it's not residential; it is ninety eight(98)percent commercial. MR. BORGOS-It looks to me like you have avoided most of the residential properties is that right? I would have a great concern for someone in a small one family house that had to put in the grinder pump and had to pay all those other fees. I am pleased to see that you didn't do that. It is a very interesting discussion that you had about meter verses none metered. I think a lot of people were still thinking about all the water coming in being charged and that is not the case. If you use it for your lawn you won't pay for it. You would have to buy a separate meter. SUPERINTENDENT HARRINGTON-You would have to get a dedicated meter... MR. BORGOS-It seems like a smart investment for anybody. How about companies that are not going to put it back into the sewer that just has processed water,just plain water to cool equipment or something and they have an existing septic system. Will they be allowed to keep that existing septic system for that purpose? ATTORNEY HAFNER-Our typical rule is you have to tie into within a year. MR. BORGOS-We are going back to the discussion of metered verses non metered. It seems like in that particular case that might be one of those non metered things because it is not going to go back into your system. COUNCILMAN IRISH-How do you verify or validate that Steve that they are not putting that... MR. BORGOS-Just an inspection. SUPERVISOR STROUGH-They can always apply for a variance and explain their case Steve. COUNCILMAN VANNESS-That is a good point. It is the first time I've heard that question. It is a good question especially in the industrial if we have like gray water not septic water, but like gray water. MR. BORGOS-Even if it just plain water. COUNCILMAN VANNESS-Correct. Something we can discuss as it goes on further. MR. BORGOS-The Native Drive property for instance has a very large septic system. If it had to be closed down put out of use if somebody came in and just wanted to run plain water through it, it would seem like a waste for everybody. COUNCILMAN VANNESS-We all know that it is great sand up there. MR. BORGOS-You mentioned Big Bay Road, Big Boom Road. Is there going to be a line down Native Drive? Native Drive had been part of the original Carey Industrial Park. The parcel where the Native Textile property is never was and is not part of the Carey Industrial Park it is just to the west of that. The connector road was put in through the Carey property quite a few years ago back in the late eighties early nineties. I am just wondering if the main line is going to come down Native Drive as well. MR. JOHNSON-It would pick up this property here. It doesn't have...Carey Road. MR. BORGOS-Thank you very much. IN RELATION TO AN INVESTMENT GRADE ENERGY AUDIT RELATING TO POSSIBLE ENERGY-SAVING FACILITY IMPROVEMENTS RESOLUTION NO.: 310, 2016 INTRODUCED BY: Mr. Doug Irish WHO MOVED ITS ADOPTION SECONDED BY: Mr. Anthony Metivier WHEREAS, the Queensbury Town Board is considering entering into an Energy Performance Contract (EPC) for the provision of energy saving services in exchange for a portion of the energy savings or revenues, and WHEREAS, EPCs are specifically authorized by New York Energy Law Article 9, and WHEREAS, an EPC is an agreement for the provision of energy services, including but not limited to electricity, heating, ventilation, cooling, steam or hot water, in which a person agrees to install, maintain or manage energy systems or equipment to improve the energy efficiency of, or produce energy in connection with, a building or facility in exchange for a portion of the energy savings or revenues, and WHEREAS, the first step of entering into an EPC is to obtain professional services to engage an energy services company (ESCO) to conduct an Investment-Grade Energy Audit (IGA) of the Town's assets and identify cost-saving improvements, and WHEREAS, if the IGA indicates significant cost savings could be realized under an EPC, the level of cost savings to result from implementation of the energy improvements would be guaranteed, and REGULAR TOWN BOARD MEETING, 09-12-2016, MTG#28 683 WHEREAS, if the IGA indicates that an EPC would not be likely to reduce energy expenses, the Town will not enter into an EPC and the cost of the IGA will not be recovered, and WHEREAS, SmartWatt Energy Inc., in consideration of an agreement with the Town and the payment of$21,000, has agreed to furnish all labor, materials, and equipment and perform all work required for completion of the IGA, and NOW THEREFORE, BE IT RESOLVED, that the Queensbury Town Board authorizes the Town Supervisor, following review and approval by Town Counsel, to sign an Investment-Grade Energy Audit (IGA) with Smart Watt Energy, Inc., and BE IT FURTHER RESOLVED, that the Town Board authorizes the Town Supervisor to execute all documents and perform all acts necessary and proper for entering into and completing the IGA, subject to all such documents and acts being reviewed and approved by Town Counsel and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Counsel and/or Town Budget Officer to take any and all actions necessary to effectuate all terms of this Resolution. We need to work with people like this on more things all winter, summer, spring, and fall. If we used our occupancy tax money for that I think it would be money well spent. Great event. Phenomenal job. SUPERVISOR STROUGH • Received a thank you note from Secretary of State Rossana Rosado of New York for attending the Department of States Local Government Services Roundtable discussion. Asked the Board to see if there is an easier process for the Grants. • Spoke regarding the site of Blind Rock noting that people have been dumping things back there. Will be sending someone there to clean it up. • Attended the Charles Evans Hughes a Native Sun Evening on September 8, 2016. Thanked Maury Thompson and Todd Degarmo for putting it together. • On Wednesday, October 12, 2016 there is a suffrage play by Alice Parker Butler that was originally performed May 23, 1916 at the Glens Falls First Baptist Church. • Charles Evans Hughes Day to be held on Saturday, October 15, 2016 at the Hyde Collection on Warren Street. • Walking tours to be held from eleven to three in Glens Falls of Charles Evans Hughes by Chapman Historical Museum. Nick Roll of the Warren County Soil and Water Conservation District would like to propose breaking the curbs up and allowing some storm water runoff to be conveyed to these little rain gardens to the residents in that area. • Letter received from Big Brothers Big Sisters thanking the Town for their continued support. • Lloyd Mott and Parks and Trail New York have been doing a study of the users of the Warren County Bikeway. • Letter received from David Harrington of 5 Seward Street who recently completed an addition to his house. Thanked the Building and Codes Department, noted that Dave Hatin's team is a professional group of people that serve the public well. The Inspectors John O'Brien and Charles Dyer were at all times prompt and extremely helpful. A special thanks to John O'Brien for his advice and knowledge that was used to improve upon my ideas and plans. • Cost Control is complete with the final report. They have found eight thousand six hundred and eighty dollars ($8,680.00) in savings. Eight hundred and seventy six dollars ($876.00) in refunds.
