3.7 3.7 LOCAL LAWS R ORDINANCES\SET PUBLIC HEARING RESOLUTIONS\Term Limits—Board Members and Supen�isor—10-3-16 RESOLUTION SETTING PUBLIC HEARING ON PROPOSED LOCAL LAW NO. _ OF 2016 LIMITING CONSECUTIVE TERMS OF MEMBERS OF TOWN BOARD AND TOWN SUPERVISOR RESOLUTION NO.: , 2016 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board wishes to consider adoption of Local Law No.: of 2016 to limit the number of consecutive years which may be served by a Town Councilperson and by a Town Supervisor, and WHEREAS, this legislation is authorized in accordance with New York Municipal Home Rule Law §10, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board shall meet and hold a Public Hearing at the Queensbury Activities Center, 742 Bay Road, Queensbury at 7:00 p.m. on Monday, November 7, 2016 to consider proposed Local Law No.: of 2016 and to hear all interested persons, and at that time may take any other actions authorized by law concerning proposed Local Law No.: of 2016, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Queensbury Town Clerk to publish and post a Notice of Public Hearing concerning proposed Local Law No. of 2016 in the manner provided by law. Duly adopted this 3rd day of October, 2016, by the following vote: AYES NOES ABSENT: 6 LOCAL LAWS\TERMS OF OFFICE-BOARD&SUPERVISOR- 11-7-16 TOWN OF QUEENSBURY LOCAL LAW NO. - 2016 A LOCAL LAW LIMITING YEARS OF CONSECUTIVE SERVICE OF TOWN COUNCILPERSONS AND TOWN SUPERVISOR Be it Enacted by the Queensbury Town Board as Follows: Section 1. Policy, Authority — It is hereby declared to be the public policy of the Town of Queensbury to limit to not more than twelve (12) consecutive years the time elected officials can serve as Town Councilperson or Town Supervisor so that elected representatives are "citizen representatives"who are responsive to the needs of the people and are not career politicians. It is adopted pursuant to New York Municipal Home Rule Law Section 10. Section 2. Limitations on Terms of Office — Notwithstanding any provision to the contrary contained in this Code, no person shall be eligible to be elected to or serve in the office of Town Councilperson or Town Supervisor if that person had previously held such office for twelve (12) consecutive years, unless one full term or more has elapsed since that person last held such office. The service of twelve (12) years in one of the two positions shall not prohibit immediate subsequent service in the other position. Section 3. Repealer; Supersession — All Local Laws or Ordinances or parts of Local Laws or Ordinances in conflict with any part of this Local law are hereby repealed. Section 4. Severability — The invalidity of any clause, sentence, paragraph or provision of this Local Law shall not invalidate any other clause, sentence,paragraph or part thereof. Section 5. Effective Date — This Local Law shall take effect upon filing by the office of the New York Secretary of State.
