Indicate location of existing structures and septic system c. Pool should be 10 feet from septic tank,leach field,or seepage pits. d. Show all setback distances from property lines to the pool. e. Indicate proposed fencing for your pool 3. Setback Requirements for Pool Placement: a. Minimum side setback requirement is 10 feet b. Minimum rear setback is 20 feet c. Pools may not be situated in the front or side yard. If this difficulty arises,you may apply for an Area Variance to the Zoning Board of Appeals. Requirements for Pool during construction: Section 1228.4 of the NYS Regulations requires swimming pools be enclosed by a temporary enclosure during construction of the pool, and requires the temporary enclosure to be replaced by a permanent enclosure, which complies with all applicable code provisions,within 90 days of issuance of the permit or commencement of construction(See the actual text of Section 1228.4 for more details). Fencing and/or Lift-Up Ladder Requirements: 1. If an above-ground pool is exactly 48 inches or more above-grade, the pool must be provided with a lift-up type ladder. No fencing is required. 2. If an above-ground pool is less than 48 inches above-grade, the pool must be fenced and meet the NYS Regulations, Appendix G. 3. If you are installing an in-ground pool, the pool must be provided with a fence or enclosure meeting the NYS Regulations, Appendix G:Temporary barrier must be replaced by a permanent pool barrier within either: 4. 90 days of the date of issuance of the building permit for the installation or construction of the swimming pool; or 5. 90 days of the date of commencement of the installation or construction of the swimming pool. The code enforcement official may extend the time period to complete the permanent barrier for good cause, including, but not limited to,adverse weather conditions delaying construction. Pool Pump Requirements—Time Clocks—(see attachment 1) Pool pumps must be equipped with time clocks so the pumps can be set to shut off during periods of peak utility electrical demand and set to control the length of time during which the filter runs. Energy Conservation Construction Code of New York State (ECNYS) part E504 entitled SERVICE WATER HEATING and section E504.3 applicable to swimming pools. Subsection E504.3.3, time clocks, states that time clocks shall be installed so that the pump can be set to run in the off-peak electric demand period and can be set for the minimum time necessary to maintain the water in a clear and sanitary condition in keeping with applicable health standards. Swimming Pool Alarms-Motion Activated Alarms-(effective 12/14/06): The New York State Uniform Fire Prevention and Building Code (Executive Law section 378(14)(b requires any residential or commercial swimming pool constructed or substantially modified after the effective date of 12/14/06, shall be equipped with an acceptable pool alarm capable of detecting a child entering the water and of giving an audible alarm. The Code Enforcement Officers will look for an approved Electrical Inspection (sticker on the Panel Box) and proper enclosure around the in- ground or above-ground pool or lift-up ladder for above ground pool *NOTE: The Electrical Inspection is required before the Certificate of Compliance is issued. The Inspectors are contracted through the Town of Queensbury but you are responsible for payment to them directly. Their fee is not part of this application. See Town Forms for list of Electrical Inspectors. WITHDRAWN PERMITS: 20% of the initial fee is retainable by the Town of Queensbury. No fee is refundable after 1 year from initial application date.
