4.18 4.18 LOCAL LAWS AND ORDINANCES\SET PUBLIC HEARING\Town Clerk—Salary Increase—11-7-16 RESOLUTION SCHEDULING PUBLIC HEARING ON LOCAL LAW NO. _ OF 2016 INCREASING SALARY OF TOWN CLERK FOR 2017 FISCAL YEAR RESOLUTION NO.: , 2016 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board believes it would be in the best interests of the Town to increase the salary of the Town Clerk to an amount in excess of the amount specified in the notice of public hearing on the Town's preliminary budget which was duly published pursuant to Town Law §108, and WHEREAS, Town Law §27 authorizes the Town Board to increase the salary of certain elected officials of the Town, including the Town Clerk, to an amount in excess of the amount specified in the notice of public hearing on the preliminary budget for not more than one fiscal year by adoption of a Local Law pursuant to the Municipal Home Rule Law, and WHEREAS, proposed Local Law No. of 2016 has been prepared which would accomplish this change, and WHEREAS, under Municipal Home Rule Law §20, no Local Law may be passed until a Public Hearing has been held, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board shall meet and hold a public hearing at the Queensbury Activities Center, 742 Bay Road, Queensbury at 7:00 p.m. on Monday, November 21St 2016 to consider proposed Local Law No.: of 2016 and to hear all interested persons, and at that time may take any other actions authorized by law concerning proposed Local Law No.: of 2016; and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Queensbury Town Clerk to publish and post a Notice of Public Hearing concerning proposed Local Law No. of 2016 in the manner provided by law. The proposed Local Law would increase the salary of the Town Clerk for the 2017 fiscal year from $67,791 to $69,147, which is in excess of the amount specified in the notice of hearing on the Town's preliminary budget which was duly published pursuant to Town Law §108. Town Law §27 authorizes the Town Board to increase the salary of certain elected officials of the Town, including the Town Clerk, to an amount in excess of the amount specified in the notice of hearing on the preliminary budget for not more than one fiscal year by adoption of a Local Law pursuant to the Municipal Home Rule Law, subject to permissive referendum. BARBER Queensbury Town Clerk LOCAL LAWS&ORDINANCES\Town Clerk Salary Increase—November 2016 TOWN OF QUEENSBURY LOCAL LAW NO. - 2016 A LOCAL LAW INCREASING SALARY OF TOWN CLERK FOR 2017 FISCAL YEAR Be it Enacted by the Queensbury Town Board as follows: Section 1. Intent, Authority — The purpose of this Local Law is to increase the salary of the Town Clerk for the 2017 fiscal year. It is adopted pursuant to New York Town Law §27 and Municipal Home Rule Law §10. In particular, Town Law §27 authorizes the Town Board to increase the salary of certain elected officials of the Town, including the Town Clerk, to an amount in excess of the amount specified in the notice of public hearing on the preliminary budget for not more than one fiscal year by adoption of a Local Law pursuant to the Municipal Home Rule Law. Section 2. Increase of salary—The salary of the Town Clerk is hereby increased from $67,791, the amount which was specified in the notice of hearing on the preliminary budget of the Town for the year 2017,to $69,147 for the fiscal year which begins January 1, 2017. Section 3. Repealer; Supersession — All Local Laws or Ordinances or parts of Local Laws or Ordinances in conflict with any part of this Local law are hereby repealed. Section 4. Severability — The invalidity of any clause, sentence, paragraph or provision of this Local Law shall not invalidate any other clause, sentence, paragraph or part thereof. Section 5. Effective Date—This Local Law shall be subject to permissive referendum and shall not become operative or effective unless and until 45 days have elapsed after its adoption and no petition protesting against this Local Law has been filed with the Town Clerk or, if such a petition is filed, a proposition for the approval of this Local Law has been submitted and received the affirmative vote of a majority of the voters voting thereon. If no petition is timely filed or if a petition is filed and this Local Law is approved, it shall take effect upon filing by the office of the New York Secretary of State.
