MACELROY-I am representing the property owners Steve and Caryn LaFleche for this application for the use of holding tanks. It requires a variance as per the Queensbury regulations. This is a small lot eighty two hundred square feet, the lot itself, so there really isn't room for replacement. Certainly not anything that would be compliant in with the groundwater conditions.... The owner would like to propose to use holding tanks. As you know the Queensbury Zoning Ordinance I am talking residential zone requires a statement of compliance or certification of the wastewater system....to get a building permit. In the future the LaFleche's hope to make some improvements to the structure of the residence and therefore this is the first step in that process. PUBLIC HEARING OPENED REGULAR TOWN BOARD MEETING MTG#35, 12-05-2016 835 NO COMMENT PUBLIC HEARING CLOSED RESOLUTION APPROVING SANITARY SEWAGE DISPOSAL VARIANCE OF STEVE AND CARYN LAFLECHE RESOLUTION NO.: BOH 40,2016 INTRODUCED BY: Mr.William VanNess WHO MOVED ITS ADOPTION SECONDED BY: Mr.Anthony Metivier WHEREAS, Steve and Caryn LaFleche (Applicants) filed an application for a variance from Town of Queensbury On-Site Sewage Disposal Ordinance, Chapter 136, §136-11, which requires applicants to obtain a variance for holding tanks, as the Applicants wish to install two (2)2,000 gallon septic holding tanks for a total of 4,000 gallons of capacity to replace their existing waterfront wastewater system on property located at 12 Waters Edge Drive in the Town of Queensbury, and WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's official newspaper and the Local Board of Health conducted a public hearing concerning the variance request on Monday,December 5b,2016, and WHEREAS,the Town Clerk's Office has advised that it duly notified all property owners within 500 feet of the subject property, NOW, THEREFORE, BE IT RESOLVED,that 1. due to the nature of the variance, it is felt that the variance would not be materially detrimental to the purposes and objectives of this Ordinance or other adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan or policy, and 2. the Local Board of Health finds that the granting of the variance is necessary for the reasonable use of the land and is the minimum variance which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect the Applicants, and BE IT FURTHER, REGULAR TOWN BOARD MEETING MTG#35, 12-05-2016 836 RESOLVED, that the Local Board of Health hereby approves the application of Steve and Caryn LaFleche for a variance from the Sewage Disposal Ordinance to allow installation of two (2) 2,000 gallon septic holding tanks for a total of 4,000 gallons of capacity to replace their existing waterfront wastewater system on property located at 12 Waters Edge Drive in the Town of Queensbury, bearing Tax Map No.: 227.17-1-29, and BE IT FURTHER, RESOLVED, that the Town Board authorizes and directs the Town Clerk to forward by certified mail a certified copy of this Resolution to the Adirondack Park Agency for its review, and BE IT FURTHER, RESOLVED,that this approval Resolution shall not be effective until 30 days after such notice to the Adirondack Park Agency and shall be subject to any lawful action by the Adirondack Park Agency during such period. COUNCILMAN CLEMENTS (WARD III) • Congratulated his Alma Mater Glens Falls City School District for their recent State Championship in Football. COUNCILMAN METIVIER (WARD I) • Congratulated Glens Falls City School District and their parents on their State Championship in Football. • Spoke regarding the World Cup in Killington, Vermont. It was a great success it was nice to see so many people from this area support the best skiers in the world. SUPERVISOR STROUGH • Spoke regarding the Reindeer Run. Thanked the Rotary for organizing this. Noted he walked in it. These are great experiences and for good causes. • Thanked West Mountain for hosting the fundraiser for Debbie Collins who was diagnosed with ALS. It was a great turnout. The Town of Queensbury will be holding their Christmas Tree Lighting on December 9, 2016 at 6:00 p.m. • Thanked the Beautification Committee for Hovey Pond Park for their help in making Hovey Pond Park look so nice. • Yard Signs.
