GUESTS : Residents of the Bay Areas of Lake George, Greg Johnson, Lee Coleman, George Liapes , Carl Garb, Harold Boynton, Residents of Owen Avenue Area, Local Fire Company Representatives Mobile Home Application of Eli Thorpe to locate a mobile home on Glen Lake Road , owner of property Eli Thorpe- Building Inspector approved of the application-Mr. Thorpe was present-1 year permit requested- - Councilman Robillard moved for a public hearing, Councilman Olson seconded. Eli Thorpe-requested to speak. . .after due consideration noted that he did know of a better location that could not be=seen from Glen Lake Road. . . Supervisor Austin: because of the question of a new location, I would suggest a one week tabling of this application so as to look at the location Councilman Robillard withdrew his motion. . . Public Hearing on the Proposed amendment to Ordinance Number 33 Notice Shown. . . Opened 7 : 33 P .M. Helen Gallagher-of Sandy Bay in favor of the 200 ' . . . gave several sugges- tions 1,.) place the existing five mile an hour buoys out to the 200' distance thus using them for two purposes . . . 2 . ) place four more further in the bay for guide lines . . . 3 .) suggest curfew for the bays. . . Supervisor Austin: Property owners may place their own buoy (one only) 100' from shore if more are needed they must get a permit from the State. . . The use of the five mile per hour buoys for a du'1 purpose would be a matter for the Park Commission . . Over night mooring, the Town has no authority in this matter it would be up to the State. . . Helen Gallagher-could the Town contact the State in regard to the over night mooring. . . Supervisor Austin-The Town will try. . . Bill Hall-President of the Kattskill Bay Association. . .urged the passage of the 200' anchorage. . . reiterated the statements of MrS, Gallac;her noting the support of the Association in her suggestions . . . Mr. Hall noted personally that he did not see how a curfew would be legal . . . Elliot Lawton-could see no harm in using; the present five mile per hour buoys for a duAl purpose but noted that the use of more in the bays would be confusing. . . is in favor of the 200' anchorage. . . Supervisor Austin: noted that the 200' anchorage does not effect the owners of lake property using their own lake shore and mooring less than the 200' . . . the ordinance is to effect boaters and restricting them from mooring in front of private property. . . x.70 Mrs. McMillan-What is the limitation. . . . could the 200 ' be extended. . . at a future date? Supervisor Austin-"The limitation in the law is 1600 ' . . . UNKNOWN: concerned with speeding in the bays . . . Supervisor Austin_ any violation should be noted and call the Park Commission. . . Alger Mason-noted the suggestionsuthat have been made but noted his concern with the suggestion of more buoys . . .could cause confusion. . . Helen Monte% of Sandy Bay-noted her concern with the anchoring of boats in the bay all day without sanitary facilities . . . Marge Calasito- of Sandy Bay noted her concern with boats mooring in the bays all day noting several instances . . . .no sanitary facilities . . . has the bays water been tested? Supervisor Austin- I understand that the water has been tested in several areas I do not know the results — suggested that the Park Commission be notified of the situation of mooring boats without sanitary fa-ailities . . . Hearing Closed. . . 8: 07 P.M. RESOLUTION TO AMEND SECTION 4 OF ORDINANCE NO. 33 ORDINANCE REGULATING THE OPERATION OF MOTOR BOATS IN THE 'TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK RE. SOLUTION N0, 206. Introduced by Mr. Robert Barber who moved its adoption, secoAded by Mr. Harold Robillard: INTHEREAS, Ordinance No. 33 of the Town of Queensbury provides by Section 4 thereof for regulation of anchorage in the waters within the boundary OF said Town pursuant to Section 130, Paragraph 17, of the Town Law of the State of New York; and WHEREAS said ordinance limits the anohoring or mooring of any boat within 100 feet of any private dock or other improved property, and --' 1-THEREAStthe Town Board has determined that public health and safety will benefit from an increase of said distance from 100 feet to 200 feet; and WHEREAS a proposed amendment of said ordinance was presented to the Town Board and after due notice a public hearing was held thereon by the Town Board on the 29th of August, 1974 at 7: 30 P.M. D.S .T. at the Town Office Building, Bay and Haviland Roads, Glens Falls, New York 12301 , and that the Town Clerk gave notice of such hearing by publication thereof in the official town newspapers at least once prior to the date specified for such hearing,, specifying the time when and the place where such hearing will be held and in general terms describing said proposed amendment and WHEREAS, all persons were heard 'both in favor of and opposed to, now, therefore be it RESOLVED, that Ordinance #33 of the Town of Queensbury regulating the operation of motor boats in the 'Town of Queensbury, Warren County, New York be amended as follows : Section 4. Regulation of anchorage. No person shall anchor or moor any boat within 200 feet of any private dock or other improved property, except in a case of emergency or at the direction of any police officer, or at the invitation of the owner or lessee of said J dock or improved property, and be it further RESOLVED, that said amendment shall take effect ten (10) days after its publication and posting as required by Section 133 of the Town Law and upon written approval of the Conservation Commissioner as required by Section 130 of the Town Law. Dear John: Re: Fire Protection Committee The Town of Queensbury In our meeting, Austin 26, 1974, the above mentioned committee has decided that we can no longer arrive at a unanimous decision regarding the fire protection problems of districting and finances of the five individual fire companies . Hewlett, Chairman Queensbury Fire Protection Committee All Chiefs , Presidents Volunteer Fire Companies Town of Queensbury The attached letter was received from the Fire Protection Committee. The Town Board is extremely disappointed that your representatives are at this time unable to make a decision as to the fire protection financing within the Town on behalf of all five volunteer companies . Unless the Town Board receives a unified financing proposal from all five fire companies by 7 : 30 P.M. on Thursday, September 5, 1974, the Board is prepared to take unilateral action, which can assume one or more of the following forms : 1. Abolition of the Queensbury Fire Protection District 2. Creation of one or more new Fire Protection Districts 3. Establishment of a new financing basis 4. Determination of no change Legal deadlines exist as to budgeting action and as to creation or dissolution of special districts . For this reasons, the Town Board must have a response, if one is to be made, by September 5 . I am including some basic information that may be of assistnace to you, if youV care to deliberate this matter further. The Town Board appreciates the work that has been done by the Fire Protection Committee leading to boundary changes , adoption of a Fire Code and the impending; appointment of a Fire Marshal. RE: Butternut Hill Subdivision Dear John: Mr. and Mrs. Charles Maine, the developers of the above named subdivision, would like to change the name of the main entrance road to the subdivision from "Ferguson Drive" to "Butternut Hill Drive" They don' t believe that the new proposed name conflicts with any existing Town road, so that it would be appropriate fpr the Tocan Board to adopt a resolution to that effect. No lots have as yet been sold in the subdivision so there is no problem from that standpoint, however, we do have an interested party and would appreciate the Town making the change as soon as possible.
