Duly adopted by the following vote: Ayes : Mr. Olson, Mr. Barber, Mr. Robillard, Mr. Streeter, Mr. Austin Noes: None Absent: None PUBLIC HEARING-STOP SIGNS - OWEN AVENUE AND SUNSET OWEN AVENUE AND LYNNFIELD DRIVE Notice shown 210 Hearing Opened-7 : 35 P.M. -The following letter was read into the record: 4 Owen Ave. Glens Falls, New York 12801 N-ovember 6, 1974 Queensbury Town Board Bay Road Glens Falls, New York 12801 Gentlemen: I, am writing this letter to you, the Queensbury Town Board, in reference to the stop signs at the corner of Owen Ave. and Sunset Drive. It is with utter dismay that I find some residents publicly declaring "stop signs" a nuisance in this highly traveled area of Owen Avenue, when all throughout the Westland area, stop signs have been adhered to, in order to make the area residential. There is a 30 mile an hour speed sign at the beginning of Owen and Aviation, but this is now, and always has been apparently overlooked. Now, I understand that you are considering the removal of the stop signs and reducing the speed limit. This ridiculous situation has been blown out of porportion, Since the ordinance was passed and became law, twice, the signs were deliberately removed, which should be an indication of how people respect the law. The signs were erected after many signatures on a petition requested them for safety for our children. No one was forced to sign. Only after a few tickets and warnings were given out did this whole matter gain newspaper attention. After a lengthy door to door interview, members of your Town Police found some residents stating they were unaware of what they were signing. Surely you ; cannnt accept this as logical reasoning. Now, we are faced with another public meeting, and a vote as to the removal of said signs. This follows a lengthy survey by your Police Department, and a recommendation by your Police Chief that the signs should remain. But again, at a Town Board meeting, you were told that some residents were sick and tired of getting tickets, the signs are a nuisance, and come winter, they would not mean a thing. In addition, the location of these signs happens to be a bus stop, which should deserve a little consideration. After all , I feel we and our children are worth a stop, or are we going to wait until we have a tragedy before we realize what we are doing. Pure luck has been with some youngsters, but it cannot hold out indefinitely. Isn' t a little stop sign really with it? Since the enforecment of the Town Ordinance, the stop signs have been very effective. It has slowed the traffic down to a reasonable rate of speed, and in the majority of cases, the traffic has stopped for the signs. I believe that the residents of this area of the Westland section should have the same consideration as other sections of the area, as there are stop signs to regulate the flow of traffic in these other areas. I feel that if these signs are removed, the residents of this area are being discriminated against. In these times of questionable law and order, our Police Department should be given the full support of our Town Board in their recommendations. _.. I cannot believe that open public defiance of a Town Ordinance would bring the Town Board to removing a definite safety measure. Thank 'you, /s/ Victor E. (resolution no. 255) TOWN BUDGET 1975 PUBLIC HEARING Supervisor Austin-announced that the Fire Company budget will be read and discussed first. . . The following letter was read. . . 11. 7. 74 Town Board Town of Queensbury; Gentlemen: - Re: -Proposed unequal payments for the five Fire Companies. I believe that the proposed new system of unequal payments for the five fire companies is wrong and should not be put into effect. As a charter member of the W.G.F.Co. I was closely involved in its organization and in fact followed closely and assisted in a number of ways in the formation of the entire five companies. This period of original organization of the WGF Co. was closely followed by some ten yrs on the Town Board during which period I held the position of chairman of the Fire Co. committee. I am therefor quite familiar with the organization of this town protection service. 1. The original concept under which all were organized was that ALL were mutually responsible for protection throughout the ENTIRE town; 2. District boundaries were merely convenient lines to locate the various companieA general area of operation & the prime consideration in this selection was to facilitate the fastest response time. If these now result in some hardships or overloading of a company the boundaries should be changed by the original concept should remain the same as indicated above. 3. Unequal payments will promote dissention & ill feelings between the companies instead of the close cooperation needed and which we have had in the past. Lively competion is fine during firemanic field days but has no place where lives & property are involved. The proposed allotments on the basis of assessed valuation in an area is arbitrary & unrealistic, a continually changing figure. 4. In unusual emergencies or equipment requirements, County Mutual Aid is there to provide special needs such as ladder trucks, tankers, rescue squads etc. In conclusion gentlemen I believe the present policy of equal payments should be retained. Blanche `D dour-read the following-(on file) OUR SQUAWK The Town board says $15,000 equal and then . 00015 of assessed valuation within its chartered area. O.K. - BUT - When the fire company was formed 25 years ago there was River Street, Boulevard and Dix Avenue. No Quaker Road. To get anywhere you used these roads or up County Line Road and out Hicks Rd or Jenkinsville Rd. to get to Ridge Road. There was no shopping ctrs, Cottage Hill was just starting and other Home Developments hadn' t started. Our section helped to support the town then because of the mills. The fire companies were still paid equally although our fire company could have hollered. The Shopping Centers didn' t pay taxes for 5 years. . . . .Who covered for them then?? Do the shopping centers coming in now still have 5 years leniency?? We, the Tax Payers do believe that our fire company should not be penalized because our section is the lowest assessed. -- First-Low taxes keep the mills here instead of moving out. They have to make a profit and that lets them construct new buildings-that makes jobs for construction workers-material used is bought from business places- then the new buildings employ more people. So with General Election laying off-Finch Pruyn cutting back, Patrician cutting back, Nibco cutting back if our mills moved out (by assessing them like our homes or business' s) , the people having jobs would cut back on their spending. It could happen-people moving out to other sectiomsrof the state to get jobs-leaving empty houses behind-if no employment-people can' t pay for their homes so the banks get stuck holding theip. So-NO MILLS=NO JOBS=NO PAYCHECKS=NO BUYING POWER=NO SHOPPING CTRS , NO BUYING BUILDING material for new homes, no new refrigerators, washers , TV' s, jobs at the shopping centers. It' s a merry=go-round maybe but it should be realized by the Town and Community. By taking a lower assessment valuation we, South Queensbury, have and still are supporting the economy of the town because-NO MILLS=NO JOBS= NO PAY CHECKS=NO BUYING POWER=SLUMP. A petition containing 287 names from South Queensbury calling for equal payments for all fire companies was presented to the Town Board. Glenn Gregory-Invited the Board to a special meeting at the W.G.F. Fire Company to discuss their needs:. . Gary Evans-President of Bay Ridge. . .money not adequate. . .request at least $5, 000 more Edward Waters-equal money between companies. . . Bill Bogs-30 Boulevard equal monies-danger of Hercules-.need strong fire company John Miller-praised So. Queensbury and requested more for the Company. . . Iris ;Flynn-noted the individual needs of each fire company—equal payment would not be right. . . 213 Glenn Gregory-Each fire company is contracted for the whole town. . . Dave Butler-is there any reason that the districts cannot be changed to equalize the districts? (member of So. Qsby. ) Victor Miner-noted that there have been changes in two districts . . . Dave Butler- not talking value of property but of territory. . . Roger Hewlett-No. _ Queensbury the problem of spliting districts was response time. . .The State mandates certain mileage from a fire house. . . Catherine Daire- Why was the assessed valuation used. . . -- Supervisor Austin- this was the most readily available figure from year to year, reflecting changes, is the assessed valuation. . . Ralph Chambers-Bay Ridge-the $15, 000 base figure was not enough to operate and maintain their standards. . . $Undhe DuFour-questioned taxation of the shopping centers. . . Supervisor Austin- the tax is to the owner of the centers. . .each structure s involved whether vacant or used. . . UNKNOWN-Does the Assessment figures include those that do not pay taxes? Supervisor Austin-yea Councilman Robillard-do not like to see division in the ranks. . .I would like to propose that the Fire protection Committee meet again and come up with a concrete proposal to solve this problem formulate the proposal and present it to the Town Board on November 14, 1974 if this can not be done I would re- quest that the Town Board enact the formula that we have before us . . . Councilman Streeter-The Town Board is interested in providing fire protection at the best cost. . .noted that the Fire Committee requested unequal payments. . .Central noted that they needed more money. . .many meetings were formed but an agreement was not met. . .I agree with Councilman Robillard. . . Supervisor Austin-The Committee must come up with a reasonable amount so the board can present it and work a reasonable budget that the taxapayers can tolerate. . . Ken Parker-Central- we do not totally agree with the proposed budget. . . we need additional funds. . . Allen DuFour-So. Queensbury- company requested that we agree to equal shares. . .equal shares until some one comes in and re-districts the Town. . . can not come to an agreement in seven days. . . Councilman Robillard-dismayed over Chief DuFour' s Attitude noting that an agreement could not be reached. . . feels that with an attitude such as that agreements could not be metil Phil Davies-No. Qsby. will be at the meetings. . .an agreement can be reached. . . will Ken Parker-Central-weAattend the meeting. . . Supervisor Austin gave a detailed description of each item of the Budget and questions were asked by several residents of the Town. . .questions to follow: _214 Mr. Murray-I noticed a separate department for the landfill has that already been decided upon? Supervisor Austin-It has been included in the budget. . .it would take a separate resolution prior to the first of the year by the Town Board declaring new positions and rescinding a former resolution taking the Highway Supt. out of that position of the Landfill care. . . Letter read into the record: November 5, 1974 John Austin, Esq. 21 Bay Street Glens Falls, New York 12801 Dear John: I was really very surprised and almost shocked to learn that our election inspectors in the Town of Queens- bury only receive $25.00 for a day that starts around 5: 00 in the morning and finishes around 11:00 at night. I under- stand in some towns the inspectors get close to twice this amount. On a half day primary, or something like that, I can see where $25.00 might be an adequate fee but on a full blown eighteen hour day, I would think the town, in its wisdom, could pay $50. 00 to each inspector. We were short one in District 7 and Ted Turner had to contact five people before he could get someone to serve. Mr. Murray-What account did the consulting firm in regard to the landfill come out of? Supervisor Austin-That came out of the research account and an additional amount out of surplus. . . Mr. Murry- you could have used the contingency account. . . Supervisor Austin-yes Mr. Murry-This is justcaf general account that you can use,'for just about anything. . . . Supervisor Austin-yes. . . Norman Ferguson-What does the Health Officer do? Supervisor Austin-He conducts clinics at the school and administers shots . .investigates Board of Health Complaints. . * he makes an annual report at the end of each year. . . Norman Ferguson-What is personal-services? 215 Supervisor Austin- That is sAlaries. . .The landfill kaxgsf2agx$H be divorced from the Highway Dept. and that the landfill be under a Superintendent someone who will be responsible to the Town Board. . .rather than- the highway Dept— this will be a new department. . . Norman Ferguson-I think it is a very very poor time to suggest new positions : . . . Councilman Robillard-Will this not refled-a decrease in the Highway Costs. Supervisor Austin-yes. . . there would be only one new position-the Supt. Norman Ferguson- Isn' t it satisfactory now? Supervisor Austin- no. Mr. Murray- I think if you compare the salaries with other landfill opera- tions you will find not that high salary. . . Norman Ferguson-What Special talents do you need for the job. . . Supervisor Austin- Administration, knowledge of heavy equipment,knowledge of aanndfill operation. . . Councilman Streeter-noted the concern over the landfill wishing that the running of the Town landfill would be under one persons control - responsible to the Town Board. . . Norman Ferguson-Does the State inspect the landfill. . . Councilman Barber- yes Councilman Robillard: we were cited last year. . . Supt. Carl Garb-cited for sewage disposal and base too large. . . Mr, Murray-Under Mr. Garb is there not a foreman there that takes care of it? Couldn' t the foreman be responsible for it under Mr. Garb? Save 10, 000 or 13, 000, Norman Ferguson- I do not like the brush pile and junk cars in the dumping area. . . Supt. Carl Garb- That is no longer there. . . Norman_Ferauson_ - I have never found our dump too bad compared to some of—hers, if Mr. Garb is short of men and no doubt he is I say that we could hire a man for five or six thousand dollars and put him up there and make him responsible. . . Supervisor Austin- If there was a Supt. _ up there - no working foreman would be hired, just labor would be used. . . Councilman Streeter-What did the working foreman get last year? Supt. Carl Garb- around 9, 000. 00 Councilman Barber-If we had a man responsible to the Town Board and not the Hi'g-Fiway Supt. we would have a better managed landfill, less over time because you would not have your landfill personnel be used to fill trucks for the highway dept. or water dept for gravel or other things. . . Mr. Murray- A landfill is susposed to be utilized in such a way that eventually the land mill be usable. . . Councilman Barber- we do not have a landfill plan. . . Mr. Murray-question the buying of property from Torrington. . . Supervisor Austin-This was to be used for expansion of the landfill. . . Councilman Streeter-This was purchased when Gerald B. Solomon was supervisor- at that time there was consideration of a County Landfill operation. . . 216 The County withdrew from the project. . . Mrs.Monahan-Suggested that the weed removal include the removal of rag weed in the Town. . . . along the road sides . . . What does the Fire Insurance cover? Sweet of West Drive was appointed to the Queensbury Conservation Advisory Council in July 25, 1974 and WHEREAS, Mr. Sweet has resigned from this position which term is to expire on December 31, 1975, therefore be it RESOLVED, that Elizabeth Renner of Ridge Road, Town of Queensbury be and she hereby is appointed to replace Mr. Sweet on the Queensbury Conservation Advisory Council, with her term to expire on December 31, 1975. 21 Duly adopted by the following vote: Ayes : Mr. Olson, Mr. Barber, Mr. Robillard, Mr. Streeter, Mr. Austin Noes : None Absent: None A BOND RESOLUTION AUTHORIZING THE CONSTRUCTION OF A WATER DISTRIBUTION SYSTEM TO SERVE THE WEST QUEENSBURY WATER DISTRICT IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $1, 060, 000 AND AUTHORIZING THE ISSUANCE OF $1, 060, 000 SERIAL BONDS OF SAID TOWN TO PAY THE COST THEREOF RESOLUTION NO , Introduced by Mr. Robert Barber who moved its adoption, seconded by Mr. Harold Robillard: WHEREAS, the Town Board of the Town of Queensbury, WarLan County, New York, after all necessary proceedings required by law were duly had and taken, has established the West Queensbury Water District in said Town and has authorized the construction of a water distribution system to serve said District at a maximum estimated cost of $1, 060, 000, pursuant to Article 12-A of the Town Law; and WHEREAS, it is now desired to provide for the financing thereof; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Queensbury, Warren County, New York, as follows: Section 1. she construction of a water distribution system to serve the West-Queensbury Water District in the Town of Queensbury, Warren County, New York, consisting of water mains, valves, hydrants and appurtenant facilities, together with the acquisition of lands and rights in land where necessary, including original furnishings, equipment, machinery and apparatus incidental thereto, or as more fully set forth and shown on the map and plans perpared in connection with the establishment of said Water District, is hereby authorized at a maximum estimated cost of $1,060, 000. Section 2. The plan for the financing of such maximum estimated cost is by tie issuance of $1, 060, 000 serial bonds of said Town hereby authorized to be issued therefor pursuant to the Local Finance Law. Section 3. It is hereby determined that the period of probable usefu ness o . the aforesaid object or purpose is 40 years, pursuant to subdivision 1 of paragraph a of Section 11. 00 of the Local Finance Law. It is hereby furhter determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Queensbury, New York, are-hereby irrevocably pledged to the payment of the principal of and interest on such bonds as the same become due and payable. There shall annually be assessed upon all the taxable real. property in said Water District at the same time and in the same manner as other Town charges an amount sufficient to pay said principal and interest as the same become due and payable, but if not paid from such source, all the taxable real property within said Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms , form and contents, and shall be sold in such manner, as may be prescribed by said Town consistent with the provisions of the Local Finance Law. Section 6. The validity of such bonds and bond anticipation notes may be contested only if: 21' 1)` Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is com- menced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 7 . This resolution, which takes effect immediately, shall be pu fished in full in Tri County News and Post Star-Times, the official newspaper, together with a notice of the Town Clerk in substantially the form provided in Section 81. OD of the Local Finance Law. Chase, Town Clerk RESOLUTION TO SET PUBLIC HEARING ON AMENDMENT TO ORDINANCE NUMBER 28 RESOLUTION NO. 242 Introduced by Mr. Robert Barber who moved for its a option, secon e by Mr. Harold Robillard: WHEREAS, the Town Board of the Town of Queensbury has received a petition from several residents of the Owen Avenue Area in the Town of Queensbury requesting that the stop signs ber.removed from Owen Avenue-­as they intersect with Sunset Avenue and Lynnfield Drive and WHEREAS, it is provided by Section 1660 (a) of the Vehicle and Traffic Law of the State of New York that a Town may place or remove stop intersections and establish the same within such town, and -- WHEREAS, Section 130 of the Town Law provides that a public hearing be held upon all proposed ordinances and amendments thereof to be held upon due notice as provided for therein, now therefore be it RESOLVED, that a public hearing on the following proposed amendment to Ordinance Number 28 of the Town of Queensbury be held on the 7th day of November, 1974 at 7: 30 P.M. and that the Town Clerk give notice of such hearing by publication of notice thereof in the official town newspapers once at least 10 days prior to the date specified for such hearing, specifying the time when and the place where such hearing will be held and in general describing the amendment to said ordinance; Amendment to Ordinance Number 28 of the Town of Queensbury ESTABLISHING THROUGH HIGHWAYS AND STOP INTERSECTIONS IN THE TOWN OF QUEENSBURY, COUNTY 219 OF WARREN, STATE OF NEW YORK Section 2 Through highways, as amended to include; Owen Avenue, from Aviation Road to Crestwood Drive. All ordinances or parts thereof of the Town of Queensbury inconsistant with the provisions of this ordinance are hereby repealed;Y P provided, however that such repeal shall be only to the extent of such inconsistanc y and in all other respects this ordinance shall be in addition to the other ordinances regulating and governing the subject matter covered by this ordinance. This ordinance shall take effect immediately. Duly adopted by the following vote: Ayes: Mr. Olson, Mr. Barber, Mr. Robillard, Mr. Streeter, Mr. Austin Noes: None Absent: None RESOLUTION TO AMEND ORDINANCE NUMBER 28 OF THE TOWN OF QUEENSBURY RESOLUTION NO. 255, Introduced by Mr. Harold Robillard who moved its adoption, seconded by Mr. Gordon Streeter: WHEREAS, a proposed amendment to Ordinance Number 28 of the Town of Queensbury was presented to the Town Board, pursuant to Section 1660 (a) (1) of the New York Vehicle and Traffic Law and after due notice a public hearing was held thereon by the Town Board on the 7th day of November, 1974 at the Town Office Building, Bay and Haviland Roads Glens Falls, New York 12801 and that the Town Clerk gave notice of such hearing by publication thereof in the official town newspapers at least once prior to the date specified for such hearing, specifying the time when and the place where such hearing will be held and in general terms describing said proposed amendment and WHEREAS all persons were heard both in favor of and opposed to, now, therefore be it RESOLVED, that Ordinance Number 28 of the Town of Queensbury establishing through highways and stop intersections in :the Town1�6f_ Queensbury, County of Warren and State of New York be amended as follows : Section 2 Through, highways, is amended to include; Owen Avenue, from Aviation Road to Crestwood Drive All Ordinances or parts thereof of the Town of Queensbury, inconsistant with the provisions of thi6 ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be in addition to the other ordinances regulating and governing the subject matter covered by this ordinance.
