I Whether an undesirable change will be produced in the character of the neighborhood or a detriment to
nearby property will be created by the granting of this area variance?
No -this will be a replacement of an existing residence in a small neighborhood.
2. Whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant
to pursue, other than an area variance?
No - side yard variance is dictated by the terrain and height variance is required due to height above
existing grade prior to filling of site for construction.
3. Whether the requested area variance is substantial?
Height request is moderate - 28.5% increase over required-however this is mainly due to height above
existing grade not final finished grade. Side yard relief is minimal and is greater than the existing
setback.
4. Whether the proposed variance will have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district?
No -this residence is situated at the base of a very steep embankment and the height variance requested
will be barely notice the ridge height and since finished grade will be brought up the actual height will
not be significantly above the 28' allowed height.
5. Whether the alleged difficulty was self-created?
It may be considered self-created although any renovation or reconstruction of the existing structure
would require an area variance.

I am writing you with regards to my review of the above-referenced project and to
document the recent conversations between your agent; Ethan Hall, and Laura Moore of
my office.
Upon my review I find that your proposal will require Area Variances and Site Plan
Review prior to the commencement of the project. Specifically, an Area Variance is
required as your plan offers the construction of a residence that does not rneet the
setback, height and road frontage requirements of the at wont Residential zone. Site

BEGINNING at a point on the northerly shore of the Hudson River at the southwest

minutes E for a distance of 662.79 feet more or less to an iron pipe for a corner which
is 3.0 feet southerly from the southerly side of the unimproved road known as the "Hill
