RESOLUTION NO, 90, Introduced by Mr. Daniel Olson who moved its adoption,

WHEREAS, the Town Board deems it necessary to adopt an Ordinance Number
41 entitled "No-Parking Zone on the Southerly .Side of Round Pond Road
Between County Club Road and Land of Salvatore Russo"
WHEREAS a prpposed Ordinance was presented to the Board, and after due
notice a public hearing was held thereon by the Town Board .on the
11 day of March 1975 at 7: 30 P.M. at the Town Office Building, Bay and
Haviland Roads, Glens Falls, N.Y. , and that the Town Clerk gave notice
of such hearing by publication thereof in the official Town Newspapers
at least once prior to the date specified for such hearing, specifying
the time when and the place where such hearing will be held and in —r+
general terms describing said proposed ordinance and therefore be it
RESOLVED, that Ordinance Number 41 by the Town Board be as follow$.
Section 1. For the purppeee of the Ordinance the word "vehicle"_,
"park" and "standing" shall have the meaning defined in the vehicle and
traffic law of the State of New York.
Section 2. No vehicle shall be parked or left standing on-the -
southerly side of Round Pond Road in the Town of Queensbury, Warren
County, New York between the Country Club Rdad and the Easterly line
of lands of Salvatore Russo and the Westerly line of lands of the

Glens Falls Country Club in the Town of Queensbury.
Section 3. All Ordinances or parts thereof of the Town of Queens-
bury inconsistent with the provisions of this ordinance are hereby
repealed; provided, however, that such repeal shall be only to .the ex-
tent that such inconsistency and in all other respects this Ordinance
shall be in addition to the other ordinances regulating and governing
the subject matter covered by this ordinance.
Section 4. Any person violating any provisions of Section 2 of .
this Ordinance shall upon conviction be punishable for a first offense
by a fine not to exceed TEN DOLLARS ($10.-00) - and for a second offense
by a fine not less than TEN DOLLARS ($10.00) nor more than TWENTY-FIVE
DOLLARS ($25.00) or by imprisonment for not less than TWO (2) nor more
-- than TEN, (L0) days. The third or any subsequent offense within one
year shal:l' be punishable by a fine not to exceed ONE HUNDRED DOLLARS
($100.00) or by imprisonment not to exceed THIRTY (30) days or by both
such fine and imprisonment. In addition to the aforesaid penalties ,
the Town -Board of the Town of QueensbUry may institute any proper action,

traffic on Everts Avenue-believed that there is enough traffic there now. . .

the proposed rezoning. . .

Councilman Robertson-I would also like to make the observation that while
this is a change in zoning I think the basic planning of the town bas always
reflected that that particular area would have some form of martufadturing
or some form of commercial enterprise primarily, I think it has always
reflected that and this particular change happens to conform with the
specific project but I do not really think it is too far out of line with
long range plans, that was made some years ago, It makes sense to me, on
that basis.
Councilman Olson-Agreeded with Councilman Robertson noting that he was
pleased that they were staying tip the Town and he was sure they would

RESOLUTION TO PUBLISH NOTIFICATION OF ESTABLISHMENT OF OFFICE OF
CENTRAL REGISTRY OF OPERATORS OF UNDERGROUND FACILITIES.
RESOLUTION NO. 76, Introduced by Mr. Hammond Robertson who moved its

WHEREAS Industrial Code Part (Rule No. ) 53 of the State of New York
relating to construction, excavation and demolition operations at or
near underground facilities was duly adopted by the New York State
Board ofSStandards and Appeals December 9, 1974 to take •effect on
the 1st day of April 1975, and
-- WHEREAS, the Town of Queensbury is required to establish a Central
Registry of Operators of Underground Facilities and publish notice
as required by said Rule 53,
NOW THEREFORE BE IT
RESOLVED,
1. That the Town of Queensbury hereby designates the Office of
Town Engineer as the Central Registry of Operators of Underground
Facilities, said Office to be located at the Town Office Building,
Bay at Haviland Reads , Glens Falls, New York 12801, telephone number
518-793-2555.
2. Thy purpose of such Central -Registry is ' to provide for notice
to operators of underground facilities by persons proposing to excavate
near such facilities, on to demolish structures near to or containing
such facilities, to provide for appropriate notices to operators
when underground facilities are damaged, to provide for the encourage
the establishmento6f "one-call" notification systems wherever feasible,
and amouggother things provide duties 'to safeguard life and property
and provide for penalties and remedies for violation of such duties.
3. All excavators and operators are hereby given notice of their
obligations to comply with Article 36 of the General Business Law
and the Provisions of Industrial Code Part (Rue+ No.) 53 before any
excavation and/or demolition operation is commenced. Such notice
shall include the requirement that every operator listed on the
Central Registry of its intent to perform excavation or- demolition
work in a specified area in the Town of Queensbury.
4. A copy of this notice shall be continuously displayed in
the office of the Builing Inspector of the Town of Queensbury.
5. A copy of this notice shall be given by the office of the
Building Inspector to any firm, person or organization obtaining a
permit for excavation or demolition work.
6. The Town Engineer shall compile a master list of operators of
existing underground facilities and who have registered with the
Central Registry pursuant to Rule 53, such master list shall contain
the corporate or other name of such operator and its address and shall
state the local address and telephone number of the department, agency,
office, or individual designated by such operators to be notified by
excavators, the issue number and date of issuance of the master list.
J ' "The master"list above• specified shall be revised promptly
whenever a new operator who has installed underground facilities is
listed on the Central Registry or an operator removes the existing
— underground facilities, or an operator revises information listed on
the Cenir'al Registry.
8. A' copy of the current master list shall be provided to any
excavator immediately upon requ .est during regular-budiness hours at a
fee of $5. 90 payable to the Town Clerk.
9. Before commencing any excavation or demolition work excavators
are required to contact the Central Registry and obtain a copy of the
master list or if one is in possession of the operator, ascertain whether its
copy 'ds •current. The excavators are required to serve notice to each
operator on the aaster list of propgoed excavation or demolition work at
least tao 'but not more than ten working day's prior to commencement of such
work.

10. Reference is hereby made to Industrial Code Part (Rule No.)
53 (12NYCRR53) relating to Construction, Excavation and Demolition
Operations at or near Underground Facilities for the specific applica-
tion of such rules and laws as pertain.
ll. .The Town Clerk is hereby directed to publish this notice in the
official town newspapers once each week for two .successive weeks
effective immediately.

Thank you for sending me a copy of the resolution adopted by the
Town Board of the Town of Queensbury objecting to the naming of
Lake George as a "Federal Waterway". The entire matter is an
extremely complicated one. The addition of the Army Corps of. , ,
Engineers to the already existing numbrous levelsvof .Jurisdiction.
over Lake George has understandably caused public concerns.
I am seeking further. information about the situation and do
appreciate being informed of your views.

The Mohican Council of the Boy Scouts of America')will be hosting
a bicentennial hike to be held Saturday, April 19th.
The hike would retrace a portion of the Knox Trail from the;.. .
railroad bed at the Glens Falls Country Club Rd. to Crandall Park.
Approximately 650 Scouts and adults from local units as well _
— as Asiting units would be taking part.
We would require community and police agency assistance in
accomplishing this short 2 mile hike and subsequent ceremony:
Lt. Governor Malty Ann Krupsak will be planning on attendance at
Crandall Park for a short ceremony (between 10:30 a.m. - 12:0O. p.m.)
Ceremonies should be over by noon. The council will provide its
own medical service by wa, y of Ekplorer Post 16 of Queensbury, which

specializes in First Aid and Rescue.

Councilman Barber:Noted that he voted NO on the Resolution to 'Publish
Notification of Establishment of Office of Central Registry of Operators
of Underground Facilities because. . .I do feel and the reason I voted no
because I do feel that we do have a choice and I personally an ashamed of
the Legislative action of our N.Y. State Legislature last year in the
manner in which they ramroded so many legislative actions through the
Legislature without any review and this is one case. . . There is another
one which is coming up very shortly that also pertains to excavation
whereby contractokz qAd,, ipa, ,i.tiea will have to get a permit from
ENCON to remove any more t an 60 yards of mat erial. The bureaucratic
collar that we are being tigh9wWdv-*ttgh more and more each day, I think
it is time that we do make a choice and not accept some of this legislation
that come# ,4own through. Basically, this is not a bad piece of legislation
but we did'not take this into advisement as to what it is going to effect
in the total overall aspect of this town in conjunction with a number of

as well as the municipality, that is my first point and that is the
re son". tha,t I voted NO. For a matter of record and not because I am an
obnoxious'person or not to be different than the rest of you, it is just
a personal feeling.
I mn k'l$ordistressed, by Mr., Pattison' s remarks in his letter to this board
pertaining` to the Fereral Waterway comment of Lake George. I do not feel
that it is an extremely complicated viewpoint and if he finds it complicated
than I.would hate to have him as our Congressman because there are certainly
many,, ny more things that are extremely more complicated than Lake George
being deemed as a Federal Waterway. It seems to me that not only this town
. ,�ut the',oX; er, townships around Lake George as well as the various commissions
such as the Lake George Park Commission and various...other bodies that are
involved with the Lake have definitely come out against the Federal
Wajerwgy .aspect of the Army Corps of Engineers and I would think that after
al this action upon all of these astute people and bodies that
surround
Lake George that Mr. Pattison politicaly if he was motivated
would take the bull by the horns and say Yes people you are right .and I
will endeavor to -try to do something for you: He does not say that, he
just says that this is a complicated matter and he appreciates us of
informing him. Apparently .he does not intend to get back to us but he
is going to get us some information. So therefore I would request that
another letter be forthcoming from this Board directing Mr. Pattison to
take a more positive position in respect to the Federal Waterway and our
viewpoints pertaining thereto. Thank You.

Mr. Barber: I' ll embelish it.
Mr. Streeter: I' d be very happy to have you do it.
Mr. Streeter: As far as the Industrial Code 53, on the advice of -our
Town Counsel, in order to protect the town in this matter the resolution
was drawn up.
Mr. Barber: I understand.
Mr. Streeter: You are entitled to your opinion.
Mr. Barber: But just because the State mandates does -not -necesaitrily
accept. I do not believe that we have to accept just because the State
mandates. Personal viewpoint.
Mr. Streeter: Is there any one else who has any testimony.
RESOLUTION TO APPROVE AUDIT OF BILLS
RESOLUTION NO. 77 introduced by Mr.Robertson, who moved its adoption

RESOLVED, that the Audit of Bills as listed in Abstract No. 75-3

RESOLUTION APPROVING THE REZONING OF PROPERTIES OF JOHN KUBRICKY. AND
SONS
RESOLUTION NO. 71 , Introduced by Mr. Olson who moved its adoption,
seconded by Mr. Robertson:
WHEREAS application has been made by John Kubricky' and Sons, and others
for the rezoning of a certain parcel of property situate on the East'
side of Bay Road and the West side of Everts Avenue in' the Town df ---
Queensbury, said parcel being more particularly described in Schedule, "A"
hereto annexed, from an R-4 and M-1 classification to an M-2 cla s' ificetion,
and
WHEREAS, the Zoning Ordinance of the Town of Queensbury, Section' 11 :O0 and
Sections 264 and 265, Article 16, Chapter 62 of the Consolidated taws df the
State of New York provide that any proposed amendment or chang4jn, the Zoning
Ordinance be referred to the Planning Board for a report thereon and a, public
hearing be held thereon, and
WHEREAS, the said application has been referred to the Town Planning Board
and the Warren County Planning Board and both have rendered their reports

to the Town Board recommending approval of the application, and
WHEREAS the Town Board has a master plan for the development of the
Town of Queensbury as a whole and is presently in the process of
updating the master plan and both the existing and proposed master
plans demonstrate the suitability and advisability of the requested
rezoning and it is consistent with the long range plans for development
of the Town of Queensbury, and
WHEREAS a public hearing was held pursuant to notice duly given and
published as required by law, in the Town Office Building on Tuesday
Larch 11, - 1975, at which hearing all persons desiring to be heard both
in favorRaad opposition to said porposed rezoning were given an opportunity
to be heard and thereafter said public hearing was closed,
NOW THEREFORE, be it
RESOLVFDs ►at the aforementioned property be and the same is hereby
rezoned frog an .R-4 and M-1 zoning classification to an M-2 zoning
classification, and be it further
RE!.4LV&D,, -that -the necessary changes be made on the Zoning and Depart-
ment maps of the Town of Queensbury so as to indicate said property
as bong located in a M-2 district and classification as defined and
regulated pursuant to the provisions of the Zoning Ordinance of the Town
