RESOLUTION AUTHORIZING ENGAGEMENT OF
MILLER, MANNIX, SCHACHNER& HAFNER, LLC TO PROVIDE LEGAL
SERVICES REGARDING PLANNING BOARD'S REVIEW OF HILLIARD,
TYER, LYON & CERNY'S APPLICATION

WHEREAS, the Queensbury Planning Board has requested special legal counsel concerning its
review and consideration of Hilliard, Tyer, Lyon & Cerny's Site Plan and Special Use Permit
Application(s)Nos: SP 17-2017 and SUP 3-2017, and
WHEREAS, the Planning Board has accordingly recommended engagement of the legal
services of Miller, Mannix, Schachner&Hafiier, LLC, such services to be provided at the rate of up to
$200 per hour, as set forth in the March 31St, 2017 letter proposal presented at this meeting, and
WHEREAS, the Town Board wishes to authorize such engagement,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of
the legal services of Miller, Mannix, Schachner & Hafiier, LLC in connection with the Queensbury
Planning Board's review and consideration of Hilliard, Tyer, Lyon&Cerny's Site Plan and Special Use
Permit Application(s)Nos: SP 17-2017 and SUP 3-2017, such services to be provided at the rate of up
to $200 per hour, as set forth in the March 31St, 2017 letter proposal presented at this meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes that payment for these services shall be
paid for from accounts to be determined by the Town's Budget Officer and the Town Board authorizes
and directs the Town Budget Officer to amend the Town Budget or take any actions necessary to
effectuate payment, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute a Letter of Engagement and/or any other needed documentation and the Town Supervisor,
Director of Planning, Zoning and Code Compliance and/or Town Budget Officer to take any other
action necessary to effectuate the terms of this Resolution.

Re: Special Counsel for Queensbury Planning Board
Dear Mr. Brown:
Please consider this letter our proposal to serve as Special Counsel to the Town of
Queensbury Planning Board for a particular upcoming application matter which we
understand is on the Agenda for the Board's April 25th Meeting.
As you and the Planning Board are well aware, we have substantial experience in
representing Planning Boards, not only for Queensbury, but for literally dozens of other
municipalities as well. We can certainly assist the Queensbury Planning Board in this matter
if you wish.
We can provide our representation and guidance at our standard municipal hourly
rates not exceeding $200/hour. We understand that this engagement is for this one
particular application only and that, therefore, it obviously would not encumber our ability to
appear before the Planning Board or any other Town entities on behalf of private clients.
We look forward to hopefully assisting the Town Planning Board on this matter.
