The adjustment would increase Davis'0.22 acre lot to 0.81 acres,providing for greater side setbacks to construct a single family residence on the lot as well as a shared curb cut in an effort to minimize the impact on traffic on State Route 9L.The proposed lot would also have a 60 foot non-disturbance covenant from the eastern property line as agreed to by Davis and his neighbor to the east, Charles C. Freihofer, III (see exhibit marked "S2" attached to the application). Davis'existing parcel provides for unique buildable lot which would only benefit from the proposed variance by reducing the impact on not only the neighborhood but also Mr.Freihofer's privacy given the narrow dimension and size of the lot (SBL 239.18-1-27.2) as it currently exists (see exhibit marked "S1" attached to the application). The proposed boundary line adjustment would have the same environmental impact as the existing lot but would allow the parcel to conform to the majority of the lots in the neighborhood, thus adding to the essential character and appearance of the neighborhood. As such,the area variance requested within this application would not only prevent Queensbury Planning Board and Zoning Board of Appeals 480248.1 March 15, 2017 Page 2 an undesirable change to the character of the neighborhood but it would actually add to said character by allowing a lot that substantially conforms to the size and dimensions of the majority of the surrounding parcels. Relief is requested for the two parcels having non-conforming lot areas, where 2-acres is required per Chapter 179-3-040 (5) of the zoning code, where 2-acres of minimum lot size is required. In addition,relief is requested from Chapter 147-111(3) (c) [4] where 100-ft of horizontal separation is required between a stormwater recharge area and a subsurface wastewater treatment system. As the stormwater management devices are downgradient from the wastewater absorption field and an enhanced treatment wastewater system is proposed,the SMPs will not have an adverse impact upon the wastewater system.
