2.06 2.6 AGREEMENTS\Water Department and Charles Winslow—6-5-17 RESOLUTION AUTHORIZING AGREEMENT BETWEEN TOWN OF QUEENSBURY AND CHARLES WINSLOW RESOLUTION NO.: ,2017 INTRODUCED BY: WHO MOVED FOR ITS ADOPTION SECONDED BY: WHEREAS, the Town of Queensbury's Water Superintendent has requested Town Board authorization for an Agreement between the Town Water Department and Charles Winslow, a Town retiree with over 25 years' service as a Lab Operator, regarding his employment with the Town on an "as needed"basis, and WHEREAS, a proposed Agreement has been presented at this meeting in form acceptable to Town Counsel, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes the Agreement by and between the Town of Queensbury Water Department and Charles Winslow substantially in the form presented at this meeting and authorizes and directs the Town Supervisor and/or Town Water Superintendent to execute such Agreement, and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor, Town Water Superintendent and/or Town Budget Officer to complete any documentation and take such other and further action necessary to effectuate the terms of this Resolution. Duly adopted this 5ffi day of June, 2017,by the following vote: AYES NOES ABSENT: AGREEMENTS\Water\Chase Michael—May 2014 AGREEMENT BY AND BETWEEN THE TOWN OF QUEENSBURY WATER DEPARTMENT AND CHARLES WINSLOW WHEREAS, Charles Winslow was employed by the Town of Queensbury for over 25 years before retiring on April 29th, 2016 while employed as a Water Treatment Plant Operator in the Town Water Department, and WHEREAS, Charles Winslow has agreed to remain available to the Town so that the Town can benefit from his 25 years of employment experience, for a period of three (3) years on a part-time, "as needed basis,"and WHEREAS, Charles Winslow was a member of the Town of Queensbury Unit of the Civil Service Employees Association, Inc. (Union) at the time of his retirement and the Union has been informed, NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. For a period of three (3) years from the date of this Agreement, Charles Winslow will be employed on an "as needed" basis for the Town of Queensbury Water Department. 2. Charles Winslow (Winslow) will be paid on an hourly basis subject to the following limitations: A. Winslow will be paid at the Water Plant Operator II rate in effect at the time that the services are provided. Winslow will be paid at the Lab Operator rate in the event he works as Laboratory Operator. B. Winslow will be paid for actual hours worked. C. In no case will Winslow work more than 40 hours in any week and he shall not earn more than $30,000 in any calendar year. D. Winslow will have no entitlement to additional retirement credit or other employment benefits. E. As an employee, Mr. Winslow will be covered by the Town's Workers' Compensation Insurance Policy. F. Mr. Winslow shall have the opportunity to work no more than 8 hours every 90 days. This shall serve as a refresher and need not be contiguous. 3. Winslow will be available to the Town when needed in the event of an employee absence. 4. In no event will Winslow's services be used to eliminate a Union position. Winslow will not be called for coverage or shift work unless and until all qualified available Water Department employees have been offered overtime. 5. In any dispute involving an employee other than Charles Winslow, this Agreement will have no precedential value and may not be relied upon by the Town in any disagreement with the Union regarding bargaining unit work. IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by the duly authorized officials as of the 5th day of June, 2017.
