Richard McCarthy spokes-man for the Ridgedale residents asked if federal aid would be-possible? Supervisor Austin predicted very �-- little chance at all to get federal or state aid. Supervisor Austin noted that if five per cent of the landowners in the proposed dis- trict petition the board, the issue would have to be put up before a referendum of district residents. Since only about 40 residents would be affected, as few as two could force the referendum. , but it was felt a simple majority in the referendum would be sufficient to pass the project. A public information meeting on the matter will be scheduled for April 12 at 7;.30 P.M. WHEREAS, diverse and numerous complaints have been received frgsP residents, fire officials and police agencies calling attention to a hazdous con- dition created by the parking of motor vehicles on both sides -of Sweet Road, Town Road No. 97 , Town of Queensbury, and WHEREAS , it is provided by subdivision 7 of Section 130 of the Town Law that the Town Board may enact ordinances, rules and regulations reg- ulating the use of streets and highways , including the restricting of parking of all vehicles therein, and WHEREAS, said Section 130 of the Town Law requires a public hearing upon all .proposed ordinances upon due notice as provided for therein, be it RESOLVED, that a public hearing on the following proposed Parking Ord- inance be held on the 26th day of April, 1973 and that the Town Clerk give notice of such hearing by publication of a notice thereof in the official town newspapers, once at least ten days prior to the date specified for such hearing, specifying the time when an4 the place where such hearing will be held and in general terms describing said pro- posed ordinance. ORDINANCE TO ESTABLISH A NO- PARKING ZONE ON BOTH SIDES OF SWEET ROAD (TOWN ROAD NO. 97) BETWEEN ROUTE 9 AND MONTRAY ROAD BE IT ENACTED AND ORDAINED BY THE TOWN BOARD OF THE T014N OF QUEENSBURY, WARREN COUNTY, NEW YORK, AS FOLLOWS : Section 1. For the purpose of this ordinance, the words "vehicle", "Parked" and "Standing" shall have the meaning defined in the vehicle and traffic law of the State of New York. Section 2. No. vehicle shall be parked or left standing on both sides of Sweet Road (Town Road No. 97) between Route 9 and Montray, Road in the Town of Queensbury. Section 3. All ordinances or parts thereof of the Town of Queens- bury inconsistent with the provisions of this ordinance are hereby re- pealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be in addition to the other ordinances regulating and governing the subject matter covered by this ordinance. Section 4. Any person violating any provision of section 2 of this ordinance shall upon conviction ,be punishable for a first offense by a fine not to exceed Ten ($10. 00) Dollars , and for a second offense by a fine not less than ten ($10. 00) Dollars nor more than Twenty- five ($25 .00) Dollars, or by imprisonment for not less than two nor more than ten days. The third or any subsequent offense within one year shall be punisable by a fine not to exceed One Hundred ($100. 00) Dollars, or by imprisonment not to exceed thirty days, or by both such fine and imprisonment. In addition to the aforesaid penalties , the Town Board of the Town of Queensbury may institute any proper action, suit or proceeding "to prevent, restrain, correct or abate any violation of this ordinance. Section 5. This ordinance shall take effect immediately. RESOLUTION RECOMMENDING ADOPTION OF BILL IN THE STATE LEGISLATURE DEALING WITH HIGHWAY IMPROVEMENT PROGRAM RESOLUTION NO. 101 , introduced by Mr. Harold Robillard who moved its adoption seconded by Mr. Daniel Olson: WHEREAS, Towns need assistance in meeting ever increasing trans- portation responsibilities ; and WHEREAS, aid allocations under the existing New York State Town Highway Improvement Program are disproportionate; and WHEREAS , legislation has been presented to the 1973 State Legislature increasing minimal financial assistance by the State and making avail- able other:-areas of support for town highway improvement; now, therefore, be it RESOLVED, that the Town Board of the Town of Queensbury hereby recommends adoption by the 1973 State Legislature of such legislation, Senate Bill No. 4642 and Assembly Bill No. 6986; and be it further RESOLVED, that copies of this resolution be transmitted to Senator Ronald B. Stafford, Assemblyman Gerald B. Solomon, Assembly Speaker Perry Duryea, Senate Majority Leader Warren Anderson and Senator John J. LaFalce. Since there may be a problem concerning the legality of such an ordinance, Barber asked Town Attorney J. David Little to study the legal aspects of question. In their own investigation of the matter Barber reported that he and Councilman Olson could find no instances of "hustling, so to speak" in the vicinity of the nightspot.
