David Little: this will take care of transient or Itinerant Merchants outside of structures the previous ordinance did not include outside a structure, this will require a transient merchant outside a structure or inside to pay $200.00 fee and fee for merchandise. 293 Supervisor Austin: Application would be made to Town Clerk and it should be noted that this ordinance is already in effect for merchants (transient or Itinerant) inside a building. . . Edward DeTemple_ resident of Glen Street- run flet- market at site of -ULd Gormett-Rest- in conjunction with my paitner we have reviewed the proposed amendment to the ordinance and our comments are as follows : We are opposed. . . it would prevent our continuation of business-We rent the premises from Mr. Russo and we sublet to individuals - as we under- stand each individual will have to secure a permit paying $200. 00- We question the need for the' ordinance - if it is designed to protect the general population then it would seem that there is a need for it --but if it trying to protect one or two business-mien from competition, I don't::febi. this is the place of the Town. With hype of business we will draw more people . . . I believe that there are other businesses that would be stopped. Kawanis Club,The Wood box that hope to have people demenstrate�2cvafts,the community days at local stores , We question the word, defination, of itinerant as applying to us . . .we are local people but we rent to outsiders. . . the 200.00 dollar fee* to some of these people would represent a whole season sales . . . Mrs . Guida: a spokes man for some people:The Lake George and Parrensburg shops ave a two months business season to make expenses and hopefully a little profit. Queensbury has 'no right to hurt the business of these two areas, by allowing peddlers and flea markets who have no expenses and so have undercut every one. By the nature of being a flea market they advertise they are cheaper 75% do not collect taxes . They take over the best area, they place signs advertising that they are there every week even selling on suriday'., °. Just to drive through the area is like driving through Coney island. . . Arlene DeTemple: We should consider why the whole ordinance was brought UP. -Mr. Olson: Where do you live? (Mrs . Guida) Mrs. Guida: On Route 9 Mr. Olson: You do not live in the Town of Queensbury? or Business? Mrs Guida: No Edward DeTemple_: We do have a sales tax, we are registered by the state of New York as a seller by self we carry public liability insurance in the amount of 300,000 from Glens Falls Insurance Company, we pay rent to the Russo' s and I am sure they pay taxes on the property. As far as the number of.:deklers who collect sales tax I do not know. . . Mr. Olson: Do you charge rent. . . from the individual dealers who join Mp with you. Edward DeTemple : Yes . Mr. Olson: The only sales tax that you are responsible for is the items you se . Edward DeTemple : Yes . Mr. Smith: I have talked with other dealers and I have asked them if they co�'rect sales tax more and more are collecting tax. . .we also advertise heavily to bring in thh public . . .many dealers in the area also deal with me. . .we buy and sell a lot cheaper Arlene DeTemple: Your ordinance does not cover all flea markets such as eenne its.. .—. !' Supervisor Austin: -As I read the ordinance-does not cover these flea markets. . . t s not a transient merchant, as it does not apply to a Garage Sale. . . Edward DeTemple : no matter who runs thh sale, whether it is a church etc. they are bring in transient merchants to sell I do not see why they are interpreted as being exempt. . . Supervisor Austin: We differ as to the interpretation. . . 294 Mr. Streeter: Coujsel - Do each individual in a flea market have to meet the restrictions of the ordinance? Mr. Little: any person must meet the ordinance. Mrs. DeTem le: We are working on a smaller expense, and consequently on a smaller profit margin . . . . Henry Bourgeois : I do a lot of buying in the flea markets. . . Mr. Barber: are you opposed or un-opposed to this ordinance amendment?
