A RESOLUTION AUTHORIZING THE CONSTRUCTION OF IMPROVEMENTS TO SERVE THE { SOUTH QUEENSBURY WATER DISTRICT NO. 2 IN THE TOWN OF QUEENSBURY, WARREN , COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $380,000 AND AUTHORIZING THE ISSUANCE OF SERIAL BONDS NOT EXCEEDING $3803,000 TO PAY THE COST THEREOF. RESOLUTION 10._222, introduced by Mr Robillard, who moved its adoption. Seconded by Mr. Streeter. At a Special Meeting of the Town Board of the Town of Queensbury, Warren County, New York, held at the Town Office Building in the Town of Queensbury, Warren County, New York, on the 21st day of December, 1972, at 8:00 o'clock P.M. , the following were present: Gerald B. Solomon Supervisor Harold Robillard Member Lloyd Demboski Member Robert Barber Member Gordon Streeter Member The following resolution was offered by Mr. Robillard, who moved its adoption, seconded by Mr. Streeter. BOND RESOLUTION DATED DECEMBER 21, 1972. A RESOMON AUTHORIZING THE CONSTRUCTION OF IMPROVEMENTS TO SERVE THE SOUTH QUEENSBURY WATER DISTRICT NO. 2 IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $380,000 AND AUTHORIZING THE ISSUANCE OF SERIAL BONDS NOT EXCEEDING $380,000 TO PAY- THE-COST THEREOF. WHEREAS, the Town Board of the Town of Queensbury, Warren County, New York, . by prodeedings duly had and taken pursuant to Article 12-A of the Town Law, has duly established the South Queensbury Water District No. 2 in the Town e, Queensbury , and WHEREAS, it is now desired to provide for the financing of the cost of construction of improvements insaid South Queensbury Water District No.2, be it RESOLVED, by the Town Board of the Town of Queensbury, Warren County, New York, as follows : Section 1. The construction of improvements to serve the South Queensbury Water District No. 2 in the Town of Queen!kury , Warren County, New York, is hereby authorized at a maximum estimated cost of $380,000. Such improvements shall consist of the construction and installation of mains, the installation of pipes, hydrants, valves and other appurtenances and equipment, sub- , stantially in accordance with the map , plan and report prepared by Joseph A. Kestner, Jr. , a licensed engineer. Section 2. The plan for the financing of such maximum estimated cost is by the issuance of not exceeding $380,000. serial bonds of the Town of Queensbury hereby authorized to be issued therefor pursuant to the Local FinanceLaw. Section 3. Subject to the provisions of the Local Fianance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor of said Town, the chief fiscal officer. Such notes shall be of such terms, form and con- tents , and shil be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 4. It is hereby determined that the period of probable usefulness of the aforesaid object or purpose is forty years, pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law, provided, however, that such bonds shall mature over a period not in excess of thirty years. It is hereby determined that such bonds will mature over a period in excess of five years. Section 5. It is hereby further determined that no downpayment is required in connection with the aforesaid object or purpose, pursuant to the provisions of Section 107.00 of the Local Finance Law. Section 6. The faith and credit of the said Town of Queensbury, Warren County, New York ,are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same become due and payable. There 161 shall annually be assessed upon the taxable real property in said Water district at the same time amd in the same manner as other Town charges, an amount sufficient to pay said principal and interest as the same become due and payable, but if not paid from such source, all the taxable real property within said Town shall be subject to the levy of ad valorem taxes without limitation as to the rate or amount sufficient to pay the principal of and interest on said bonds. Section 7. the validity of such bonds may be contested only if: 1. Such bonds are authorized for an object or purpose for which said Town is not authorized to expend money , or 2. The provisions of law which should be complied with at the date of _publication of this resolutionare not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3. Such bonds are authorized in violation of the provisions of the Constitution. Section 8. This resolution, which takes effect immediately, shall be published in full in the Glens Falls Post Star and Times, together with a Clerk' s certification insubstantial conformity with Section 81.00 of the Local Finance Law. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows: Member Lloyd Demboski voting Yes Member Robert Barber voting Yes Member Harold Robillard voting Yes Member Gordon Streeter , voting Yes Supervisor Gerald B. Solomon _ _ voting Yes The resolution was thereupon declAred duly adopted. RESOLUTION TO TRANSFER FUNDS. RESOLUTION NO. 221, introduced by Mr. Solomon, who moved its adoption, seconded by Mr. Robillard. _ RESOLVED, that $52.54 be transferred from the Contingency Fund, A1990.4 to Capital Fund, H2810.3, for payment of tax adjustment to Torrington Construction Company. (H2810.3, land purchase for Refuse Area) Duly adopted by the following vote: AYES:Mr. Robillard, Mr. Barber, Mr. Streeter, Mr. Demboski, Mr. Solomon. NOES:None. RESOLUTION TO SET PUBLIC HEARING RESOLUTION NO. 224, introduced by Mr. Robillard, who moved its adoption. Seconded by Mr. Solomon, WHEREAS, there has been duly established in the Town of Queensbury a fire protection district embracing all of the territory of said town of Queensbury and the Town Board has provided for fire protection therein by contracts with five (5) volunteer fire companies and for emergency rescue squad and ambulance service with two (2) of said volunteer fire companies and one (l) independent rescue squad and ambulance service, and WHEREAS, the said contracts for fire protection and emergency rescue and ambulance service,expire December 31, 1972 and the Town Board deems it in the public interest of the residents of said Town to provide for such fire protection service and emergency rescue and ambulance service, and WHEREAS, Section 184 of the Town Law requires a public hearing upon the contract provisions for such fire protection service and emergency rescue and ambulance service, NOW, THEREFORE BE IT RESOLVED, that a public hearing on said proposed contract terms will be held by the Town Board of said Town —�Lt the Town Office Building, Bay and Haviland Roads in said Towm, on the 11th day of January, 1973 at 8:00 o'clock in the evening,EST, of that day, and that then and there the said Town Board will hear all persons interested in the matter and will then and there take action in the matter and the Town Clerk of this Town be and hereby is directed to prepare and have published and posted in compliance with the law, the necessary notices of such hearing.
