Parker Secretary- - - RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 65 , introduced by Mr. Demboski, who moved its adoption. Seconded by Mr. Barber. WHEREAS, Carolyn Lipps of West Glens Falls has made application in accordance with paragraph 2 (c) Section4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated on Ohio Avenue, West Glens Falls, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determindd that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, �-, the':Town Board shall conduct a public hearing on said application on May 11; 1972 at 8:00- P.M. in the Queensbury Town Office Building, Bay Raad, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. RESOLUTION NO. 66, introduced by Mr. Barber, Who moved its adoption, seconded by Mr. Robillard. _62 WHEREAS, Robert Waters of Tuckaway Trailer Park, South Glens Falls, has made application to this board for a permit to locate a=Mobile Home at property situated at Dawn Avenue, Town of Queensbury and owned by Ralph and Geneva Elmore, and WHEREAS, upon proper investigation it appears that the applicant has complied with all the requirements of the Ordinance Regulations relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown on the original application, therefore be it further, RESOLVED, that the application of Robert Waters be and hereby is disapproved and that the Town Clerk is hereby directed to notify Robert Waters of the decision of this Board. RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY. RESOLUTION NO.67 , introduced by Mr. Robillard, who moved its adoption, seconded by Mr. Demboski. WHEREAS, Gary and Sron Greene of Massachusetts Avenue, Glens Falls, N.Y. has made application to this Board for a permit to locate a Mobile Home at property situated at Massachusettes Avenue, Glens Kls , and owned by H. Russell Harris, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Regulations relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown on the original application, therefore be it further, RESOLVED, that the application of Sharon and Gary Greene be and hereby is disapproved and that the Town Clerk is hereby directed to notify Mr. and Mrs. Greene of the decision of this Board. WHEREAS , Ethel Matteson of RD#3, Burch Road, Glens Falls, N.Y. has made application in accordance with paragraph 2(c) Section 4 of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOME AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN , COUNTY, NEW YORK, to locate a mobile home outside a duly licenses Mobile Home Court at property situated off Burch Road, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance , and WHEREAS, it is hereby determined that the facts presented is said application are sufficient to justify further consideration by this board , therefore be it RESOLVED, that pursuat.t to the provisions of the above mentioned ordinance the Town Board shall conduct a public hearing on said application on May 11, 1972 at 8:00 P.M. in the Queensbury Town Office Building, Bay Rca d, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with theprovisions od said ordinance. Fisk has been tabled until the next regu ar meeting. The March Activity Report from the Water Department was read and placed on' file. A letter was received from Thomas K. Flaherty, Water Dept. ,, requesting standardization of water meters. RESOLUTION TO STANDARDIZE WATER METERS RESOLUTION NO.6$ ', -introduced by Mr. Robillard, who moved its -adoption, seconded by Mr. Streeter. This resolution is not available at this time, but will be forth coming from Attorney Harold Katz and will be found on page The March Report from the Building and Zoning Dept. was -read and placed on '¢] file. The March Activity Report from the Town Clerk' s Office was read and placed on file. The Supervisor's Report for the month of March shows total receipts of $87,620.04, and total disbursements of $145,464.16. The monthly report of the Highway Dept. was placed on file. Several members of the Queensbury Town Board toured the town landfill and the junk yards. Michael Goss of the Adirondack College Student Assoc. presented to the Board a petition to repair and improve Bay Road. Mr. Solomon told him that Bay Road is part of the County Highway system and that the petitions should probably be directed to the- County Board of Supervisors. As a County Supervisor Mr. Solomon offered to present them to the Board or Mr. Goss could be present as his guest and present them himself. Mr. Goss said he would attend the meeting. Pliney Tucker of Corinth Road made a strong protest about junk cars on the Corinth Road locations and the failure of town police to take action. Dr. Huested was present to inquire about Judge O'Brien' s decision reversing the Town Board' s decision to rezone property owned by the Ski and Shore Corp. Supervisor Solomon stated -that he just received the opinion handed down in the Supreme Court and the Board would study it with the intention of taking action at the April 27 meeting. Mr. Katz said that it was the court' s determination in substance that the Town Board at the time was not empowered because the resolution to rescind C-3 zoning failed. in reviewing what had happened Mr. Katz reminded questioners that on Ski and Shore original application for commercial zoning there were no appearances, a rehearing was held and a motion was made to rescind the C-3 zoning. That resolution failed but immediately thereafter, John Austin a councilman at the time offered a- resolution to rezone the property to R-3 classification and that motion passed. Mr. Katz stated that it was our contention that even though the recission failed, the rezoning passed. The court did not agree. Mr. Katz stated that even though the courts have ordered- the Building Inspector to issue the permit to Ski and Shore, notice of appeal has automatically stayed any further proceedings. The Building Inspector cannot issue a permit so long as the appeal' is pending and he has been so directed. Dr. Huested stated that his group would have appealed the Town Board' s failure to rescind commercial zoning if it had appeared at the time that subsequent rezoning was in doubt. Dr. Richard Hughes inquired if the State Health Dept. engineers could not be called in to make an in-depth study of the facts in relation to the drainage of the area. He reminded the Board that Rush Pond has been classified as a very important emergency supply of water. James Carlaw called attention to the fact he spoke in behalf of the Adirondack Mountain Club previously on the matter of keeping the Ski and Shore property residential and that the town take what action be needed to keep that position and he wanted to be on record as again repeating this notice. RESOLUTION TO ESTABLISH PUBLIC SAFETY ADMINISTRATION FUND A3010 RESOLUTION NO.,_78 , introduced by Mr. Robillard who moved its adoption seconded by Mr. Streeter. WHEREAS, during the late fall of 1971 there was conducted in the Town of Queensbury a search for a missing person, presumably lost in the woods, and WHEREAS, the Town was asked to help financially with certain expenses of the search, and after consulting with Audit and Control, agreed to do so, therefore be it RESOLVED, that the sum of $98.46 be transferred from the Contingent Fund to A3010 Public Safety Administration. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Robillard, Mr. Streeter, Mr. olomon Noes: Mr. Barber. RESOLUTION TO AUTHORIZE ADVERTISING FOR BIDS FOR GARDEN TRACTOR RESOLUTION NO. 71, introduced by Mr. Streeter who moved its adoption seconded by Mr. Barber. WHEREAS, the Town Office Building is in need of a new garden tractor and that Town Clerk Donald Chase has recommended to the Board that we purchase a new tractor, therefore be it RESOLVED, that the Town of Queensbury solicit sealed bids for the purchase of a new tractor and. that the following notice be published .once in the official town newspapers in the following form: NOTICE TO BIDDERS Notice is hereby given that the Town Board of the Town of Queensbury will receive sealed proposals for a new garden tractor for the Town Office Building. A complete copy of the specifications for both gas and electric models will be available in the office of the Town Clerk. Bids will be received up to 5 :00 P.M. on the 11th day of May, 1972 at the Town Clerk' s office in the Queensbury Town Office Building, Bay and Havland Roads, Glens Falls, New York. Bids must be submitted in sealed OPAQUE envelopes plainly marked TRACTOR BID and there shall be included in such bid the certificate of Non-Collusion required by Section 103D of the General Municipal Law and the bidder must state approximate date of delivery. The Town Board will meet at the Town of Queensbury Office Building at 8:00 P.M. on the 11th day of May, 1972,-at which time the bids will be opened and read aloud. The Town Board reserves the right to reject any or all bids. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Barber,, Mr. Robillard, Mr. Streeter, Mr. Solomon Noes: None. Plans for a Memorial Day parade, sponsored by the town on May 29 are being made. RESOLUTION TO APPROVE AUDIT OF BILLS RESOLUTION NO. 72 , introduced by Mr. Demboski, who moved its adoption seconded by Mr. Barber. _ RESOLVED, that the Audit of Bills as listed on Abstract No. 72-4 numbered 384 through 525 totaling $28,897.54 is hereby approved with the exception of Audit No' s 387, 412 and 443 changing the total to- $28,303.17. Chase, Town Clerk i t RESOLUTION TO STANDARDIZE WATER METERS RESOLUTION NO. 69, introduced by Mr. Robillard, who moved its adoption. Seconded by Mr. Streeter. WHEREAS, the Water Department of the Town of Queensbury, Warren County, New York, presently owns water meters manufactured by Badger Meter Manufacturing Company of Milwaukee, Wisconsin and has on hand a supply of said meters and spare parts therefor, and WHEREAS, to purchase different makes of water meters would be ineffecient and uneconomicalsince alternate and additional supplies of spare parts would have to be purchased which would not be interchangeable with those already on hand, ,and WHEREAS, for other reasons such as handling, economy of purchase and ffeciency ,of repairs and installation, it -is determined by this Board to standardize the purchase of said water meters and the spare parts therefor, '-NOW, THEREFORE, BE IT RESOLVED, that for reasons of effeciency and economy and pursuant to the authority conferred by Subdivision 5 of Section 103 of the General Municipal -Law, it is determined by this Board that there is a need for standardization in the purchase of water meters for the Town Water Department, and BE IT FURTHER RESOLVED, that the Superintendent of the Water Department be and he hereby is authorized to purchase water meters and spare parts therefor from the Badger Meter Manufacturing Co.of Milwaukee, Wisconsin as the standard water meter to be -used exclusively by said Water -Department of theTown of Queensbury.
