Badera 55 Mason Rd Queensbury, NY 12804 Zoning and Planning Office Town of Queensbury 742 Bay Rd, Queensbury, NY 12804 October 14, 2017 To whom it may concern Zoning and Planning Office, I have a residence at 55 Mason Rd in the Town of Queensbury. There is an existing deck on the lakeside of the home that is a very nice spot to sit and view the lake. Presently it is very narrow, with a walkway about 5 feet wide in many places, and not very useful as a deck for dining outside or entertaining. I want to extend the existing deck in one section about 5 feet closer to the lake to make an area that would allow for a picnic table with seating so we can have a space on the deck to dine and entertain. At present the existing deck on one corner is only 49 feet from the shoreline. This extension would encroach on the 50 foot requirement to the nearest shoreline such that after construction the nearest point would be 45 feet. This is a residence and not commercial property. This request is for a very minor extension to an existing deck which will have no significant impact on the surrounding area,the environment, or water runoff and is well within the normal and consistent usage for a deck. Please see the following pages of photos that show the view of my deck looking north and south to see the relationship between the small extension I want to make and the location of the homes on either side of me which are both much closer to the lake. J 11 1 In this picture, you can see on the north side, the "Lakeside-front" of my deck at 52 feet from the shoreline, if it were extended, would hit the side of the house to the north. I understand that this home was built earlier than my home and to different codes. Nonetheless the setback to the front of their deck is approximately 25 feet. `a I R i _1• r., 4 In this picture, it is difficult to clearly see the house, but you can see the roof through the trees, and you can see on the south side, the "Lakeside-front" of my deck at 52 feet from the shoreline, if it were extended, it would hit the side of the house. I understand that this home was built earlier than my home and to different codes. Nonetheless the setback to the front of their deck is approximately 20 feet. My small deck extension in this area on the south side of my deck, although encroaching on the 50-foot zone would still be much further back from the waterline than the setback for either neighbor to the north or south of my property. As you can see from this picture the deck in question is very narrow and cannot be used for anything much other than a couple chairs.
