3.04 3.4 GRANTS\Stormwater Improvement Grant Program—Cap Proj Fund 209—Project Changes— 11-20 RESOLUTION AUTHORIZING PROJECT CHANGES RELATED TO STORMWATER IMPROVEMENT GRANT PROGRAM - CAPITAL PROJECT FUND #209 RESOLUTION NO.: , 2016 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, in 2014 the Warren County Soil and Water Conservation District (WCSWCD) was awarded a stormwater improvement grant funded by the New York State Department of Environmental Conservation (NYSDEC) through its Round 11 Water Quality Improvement Program, and WHEREAS, the Town of Queensbury was included in WCSWCD's grant application as a prospective partner with the following Projects identified for funding: • Assembly Point Knox intersection- bioretention or porous pavers need test pits; • Assembly Point Sunset intersection- two drywells; • Pickle Hill Tributary- three drywells; • Lockhart south project- Large drainage in combo with Bay Road- one drywell; • Lockhart north project drywells, turnouts- one drywell, check dams, stable turnouts; • Chestnut Road Glen Lake- one drywell and paved swale; and WHEREAS, by Resolution No.: 272,2015, the Queensbury Town Board accepted $39,000 in such grant funds with the effective date of the grant being January 1, 2015 through December 31, 2017, and WHEREAS, by Resolution No.: 124,2016, the Town Board authorized the establishment of Stormwater Improvement Grant Program Capital Project Fund 4209 which Fund established funding for expenses associated with the Project, and WHEREAS, by letter dated October 31, 2017, the WCSWCD has requested a two (2) year time extension for this grant from the NYSDEC and has also proposed changes to the original projects selected by the WCSWCD due to certain site or landowner issues, and WHEREAS, the NYSDEC has approved the new projects as they meet the Program's goals and are located within the same watershed, and WHEREAS, a summary of such proposed Project changes is as follows: • Assembly Point Knox Intersection- Bioretention/porous pavers has been cancelled and replaced by Sunnyside East Project—Filter sox will be installed along roadside; • Pickle Hill Tributary- three drywells has been cancelled and replaced by Fort Amherst Project—Bioretention system; • Lockhart South Project- Large drainage in combo with Bay Road- one drywell; • Chestnut Road Glen Lake- one drywell cancelled and replaced with Birch Road drywell install; • Lockhart North Project drywells, turnouts, one drywell cancelled and replaced by Woodchuck Hill Project; • Birdsall Road—Bioretention system; and WHEREAS, the Town Highway Superintendent concurs with such proposed Project changes, and WHEREAS, the Town Board wishes to authorize the two (2) year time extension for this grant as well as such proposed Project changes, 2 NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes a two (2) year time extension (through December 31, 2019) and the Project changes related to the Stormwater Improvement Grant Program Capital Project Fund 4209 as set forth in the preambles of this Resolution, as well as any other necessary changes to the scope of the Projects as may be deemed acceptable to the Town Supervisor, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor, Town Highway Superintendent and/or Town Budget Officer to take any and all actions necessary to effectuate all terms of this Resolution. This is not unusual as contracting dates and construction times do not always fit together well for project completion, especially when addressing multiple projects in several towns. For the town of Queensbury there have been changes to the original projects that the District had selected due to site or landowner issues. Projects have been chosen in their place and have been approved by the NYSDEC as they meet the goal of the program and they are within the same watershed(Champlain—Lake George and Halfway Brook). Here is a summary of the changes: • Assembly Point Knox Intersection-Bioretention/porous pavers has been cancelled it was replaced by Sunny Side East project-filter sox will be installed along roadside. Hoping to get this one completed this fall. • Pickle Hill Tributary-three drywells has been cancelled replaced by Fort Amherst—boiretention going in the Spring of 2018. • Lockhart south project-large drainage in combo with Bay Road-one drywell-hoping to add this to the list of projects possibly this fall. • Chestnut Road Glen Lake—one drywell cancelled and replaced with Birch road drywell install—completed and reimbursed. • Lockhart north project drywells,turnouts,one drywell cancelled,replaced by woodchuck Hill project-completed waiting for invoices and match hours,equip,etc...for grant for reimbursements. • Birdsall Road—boiretention system going in the spring of 2018. Sincerely, Jim Lieberum,CPESC District Manager Cc: J.Watkins J.Strough RESOLUTION AUTHORIZING ESTABLISHMENT OF STORMWATER IMPROVEMENT GRANT PROGRAM - CAPITAL PROJECT FUND #209 RESOLUTION NO.: 124,2016 INTRODUCED BY: Mr. Doug Irish WHO MOVED ITS ADOPTION SECONDED BY: Mr. William VanNess WHEREAS, in 2014 the Warren County Soil and Water Conservation District (WCSWCD) was awarded a stormwater improvement grant funded by the New York State Department of Environmental Conservation (NYSDEC) through its Round 11 Water Quality Improvement Program, and WHEREAS, the Town of Queensbury was included in WCSWCD's grant application as a prospective partner with the following Projects identified for funding: • Assembly Point Knox intersection-bioretention or porous pavers need test pits ($3,000); • Assembly Point Sunset intersection-two drywells ($8,000); • Pickle Hill Tributary-three drywells ($12,000); • Lockhart south project- Large drainage in combo with Bay Road- one drywell ($4,000); • Lockhart north project drywells, turnouts- one drywell, check dams, stable turnouts ($4,000); • Chestnut Road Glen Lake- one drywell and paved swale ($4,000); and WHEREAS, the dollars attached to each Project were estimates, as the Town has the ability to spend and be reimbursed up to and including $39,000 for these improvements and the eligible reimbursable expenses would include supplies and materials, and WHEREAS, NYSDEC will withhold 10% of the grant expenditures until the grant is closed out, and if the Town has vouchered for $39,000 in supplies and materials, the Town would receive $35,100 until the grant closeout and the remaining $3,900 would then be paid, and WHEREAS, WCSWCD submits reports and reimbursement request quarterly, and NYSDEC has generally been providing reimbursement within 8 weeks so that once WCSWCD receives payment, it disburses the Town's eligible expenses (less the 10%) within 30 days and then the remaining funds at grant closeout, and WHEREAS, by Resolution No.: 272,2015, the Queensbury Town Board accepted $39,000 in such grant funds, and WHEREAS, the Town Highway Department has not yet completed these projects; however, the effective date of the grant is actually January 1, 2015 through December 31, 2017 and therefore the Town Board wishes to establish a Capital Project for such Projects in the total amount of$39,000 rather than use its General Fund as the budgets for expenses and revenues are only for budget year 2015, WHEREAS,the Town Board needs to authorize a temporary loan from the General Fund in the amount of$39,000 to Capital Project Fund#209 that will be paid back when the Town receives its funds from the WCSWCD, and WHEREAS, in accordance with New York State General Municipal Law §9-A, the Town Board is authorized to temporarily advance moneys held in any fund to any other fund, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and directs the establishment of Stormwater Improvement Grant Program Capital Project Fund #209 which Fund will establish funding for expenses associated with the Project as set forth in the preambles of this Resolution, and BE IT FURTHER, 2 RESOLVED, that the Town Board hereby authorizes and directs the Town Budget Officer to temporarily $39,000 from the General Fund #001 to Capital Project Fund #209 as the Town will have to spend the money before it may be reimbursed from WCSWCD as previously set forth in Resolution No.: 272,2015, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend the 2016 General Fund #001 and Capital Project Fund #209 as needed, keep suitable records and arrange for the repayment of the temporary loan as soon as available,and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend the 2016 Town Budget, make any adjustments, budget amendments, transfers or prepare any documentation necessary to establish appropriations and estimated revenues as is deemed necessary, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs Town Supervisor and/or Town Budget Officer take any and all action necessary to effectuate all terms of this Resolution. Duly adopted this 21'day of March, 2016, by the following vote: AYES : Mr. Clements, Mr. Irish, Mr. VanNess, Mr. Strough, Mr. Metivier NOES : None ABSENT : None 3 RESOLUTION AUTHORIZING ACCEPTANCE OF GRANT FUNDS IN CONNECTION WITH WARREN COUNTY SOIL AND WATER CONSERVATION DISTRICT STORMWATER IMPROVEMENT PROGRAM, ESTABLISHING APPROPRIATIONS AND ESTIMATED REVENUES FOR SUCH GRANT FUNDS AND MEMORANDUM OF UNDERSTANDING RESOLUTION NO.: 272,2015 INTRODUCED BY: Mr.Doug Irish WHO MOVED ITS ADOPTION SECONDED BY: Mr.Anthony Metivier WHEREAS, in 2014 the Warren County Soil and Water Conservation District (WCSWCD) was awarded a stormwater improvement grant funded by the New York State Department of Environmental Conservation(NYSDEC)through its Round 11 Water Quality Improvement Program, and WHEREAS, the Town of Queensbury was included in WCSWCD's grant application as a prospective partner with the following Projects identified for funding: • Assembly Point Knox intersection- bioretention or porous pavers need test pits ($3,000) • Assembly Point Sunset intersection- two drywells ($8,000) • Pickle Hill Tributary-three drywells ($12,000) • Lockhart south project- Large drainage in combo with Bay Road- one drywell ($4,000) • Lockhart north project drywells, turnouts- one drywell, check dams, stable turnouts ($4,000) • Chestnut Road Glen Lake- one drywell and paved swale ($4,000) and WHEREAS, these Projects were developed from discussions with the Queensbury Highway Department and reviewing the "Town of Queensbury Stormwater Identification Project" (March 2013), and , WHEREAS, the dollars attached to each Project are estimates, as the Town has the ability to spend and be reimbursed up to and including $39,000 for these improvements and the eligible reimbursable expenses would include supplies and materials, and WHEREAS, as with many grants, some Projects may have been completed prior to the award or the date that reimbursement may be eligible, so if a Project on this list has been completed prior to January 1 2015, it is not eligible for reimbursement; however, WCSWCD would work with the Town to identify additional water quality improvement project locations that could be substituted, and WHEREAS, the Town's contribution to the grant is an in-kind service match commitment which would be through force labor, equipment usage and any supplies and materials that are not eligible for reimbursement, but assist with the implementation of the Projects, and WHEREAS, NYSDEC will withhold 10% of the grant expenditures until the grant is closed out, and if the Town has vouchered for $39,000 in supplies and materials, the Town would receive $35,100 until the grant closeout and the remaining $3,900 would then be paid, and WHEREAS, WCSWCD submits reports and reimbursement request quarterly, and NYSDEC has generally been providing reimbursement within 8 weeks so that once WCSWCD receives payment, it would disburse the Town's eligible expenses (less the 10%) within 30 days and then the remaining funds at grant closeout, and WHERESA, as a result of changes in the NYS grant programs,the Town will need to enter into a Memorandum of Understanding with the WCSWCD regarding this grant Project, and the WCSWCD has prepared and presented such proposed MOU at this meeting, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby accepts the up to $39,000 in grant funding as delineated in the preambles of this Resolution, and 2 BE IT FURTHER, RESOLVED, that the Town Board further establishes appropriations and estimated revenues as follows: • Increase Revenue in Home and Community Aid Account No.: 001-0000-53989 by $39,000; • Increase Appropriations in Drainage Account No.: 001-8540-2899 by$39,000; and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Budget Officer to amend the 2015 Town Budget, make any adjustments, budget amendments, transfers or prepare any documentation necessary to establish such appropriations and estimated revenues and effectuate all terms of this Resolution, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to execute the memorandum of Understanding between the Town and the Warren County Soil and Water Conservation District substantially in the form presented at this meeting, and the Town Supervisor, Town Counsel and/or Town Budget Officer to take such other and further action necessary to effectuate the terms of this Resolution.
