WHEREAS, the Queensbury Town Board is authorized by Town Code Chapter 136 to issue
variances from §136-44 "Connection to sewers required" which requires Town property owners
situated within a sewer district and located within 250' of a public sanitary sewer of the sewer district
to connect to the public sewer facilities within one(1)year from the date of notice, and
WHEREAS, Marianne McDonough has applied to the Town Board for a variance/waiver
from §136-44, as Ms. McDonough has requested a continuing waiver and/or permanent relief from the
Town's connection requirements to connect the Graycourt Motel property to the Town of
Queensbury's Route 9 Sewer District for the reasons set forth in the October 13th, 2017 letter and
application presented at this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board will hold a hearing on Monday, December 4th,
2017 at 7:00 p.m. at the Queensbury Activities Center, 742 Bay Road, Queensbury, to consider
Marianne McDonough's sewer connection variance/waiver application concerning the Graycourt
Motel property delineated in the preambles of this Resolution and located at 1082 State Route 9,
Queensbury(Tax Map No.: 296.9-1-9), and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Queensbury Town Clerk to send
the Notice of Hearing presented at this meeting to Ms. McDonough as required by law.

Dear Members of the Board:
Enclosed please find our Application for Waivers from the sewer line for Graycourt Motel.
As previously stated, our seasonal motel business has changed little over these past fifty-four(54)
seasons of our operation of approximately eight(8)to ten(10)weeks per year. We have continued
annually to make upgrades and improvements to enhance the appearance of our premises and
maintain its attractiveness to the community,the town and the traveling public on Route 9.
From a review of the facts to"hook up"or connect,it is cost prohibitive at$67,000.00(old figures)
to over$112,000.00 on estimate. The motel and office are spread on approximately 31/2 to 4 acres.
The income generated from the seasonal business is not only not cost effective, but prohibitive to
borrow such money. A review of the sales tax revenues will certainly demonstrate that point.
The content of this application is similar to prior year's application with the addition of an updated
estimate and a current sewer report.
Considering the foregoing, which we request be made part of the application, and considering our
previous applications, your previous findings and the fact that we are paying sewer taxes as if we
were, in fact,"hooked up",we do request a continuing WAIVER and do request as we have in the
past, make this relief permanent or for so long as there is no NEED for a change in our septic
systems.

determines that the temporary granting of the variance/waiver would not be materially
detrimental to the purposes and objectives of Queensbury Town Code Chapter 136
and/or adjoining properties or otherwise conflict with the purpose and objectives of any
plan or policy of the Town of Queensbury; and
b) the Town Board finds that the granting of the variance/waiver is reasonable and would
alleviate unnecessary hardship on the applicants;and
BE IT FURTHER,
RESOLVED, that the Queensbury Town Board hereby approves Marianne McDonough
dba GrayCourt Motel and Thomas J. McDonough Law Office (the McDonoughs)'s application for
a variance/waiver from Queensbury Town Code Chapter 136, §136-44 "Connection to sewers
required" and hereby grants the McDonoughs a five (5) year extension of time or until sold, if
sooner, in which to connect their properties located at 1082 and 1088 State Route 9, Queensbury
(Tax Map No.'s: 296.9-1-8 and 296.9-1-9) to the Town of Queensbury's Route 9 Sewer District,
provided that if there is any change in property use, increase in septic use or additional bathroom
facilities added,then such variance shall immediately terminate unless the Queensbury Town Board

has been determined to fail or is modified by the Applicant, or if ownership of the property is

The law office has one (1) toilet facility and it is shared with our daughter, Cathy Ratto, who
operates a gift basket shop seasonally. The office is no longer open on a full time basis. There are
no full or part time employees.
From a review of the facts to "hook up" or connect, it is cost prohibitive at $67,000.00 to over
$100,000.00 on estimate. The motel and office are spread upon approximately 31/4 to 4 acres. The
income generated from the seasonal business is not only not cost effective, but prohibitive to
borrow such money. A review of the sales tax revenues will certainly demonstrate that point.
The content of this application is identical to last year's application with the addition of updated

Connection with lower motel units must be constructed in
such a fashion to avoid destruction of a sprawling oak estimated
to be well over two hundred (200) years old.
All connections in addition to excavating earth will entail
excavating in excess of over 500 linear feet of Black top (width
unknown) . To return to original condition would require complete
resurfacting. O'Connor Consttruction resurfaced in 1998 at a cost
of $25, 000 .00.

cost of connection should be provided. The estimates must come
from registered contracts with the Department of Wastewater.
These estimates must be in writing copy attached to this form.

Current sewage disposal systems are in excellent condition
and functioning very well.
In support of the Application for Waiver/Variance to support
a basis for not connection, I would submit the following:
This motel is operated seasonally and a very short one at
that. We open Memorial Day solely to make certain it is fully
operational for Americade which is the major sole service of
income for June. (Memorial Day over the recent years has proved
to be a poor revenue period. ) If Americade were not to occur we
would not open in June and open for July 4th weekend. This
business is basically a six (6) week season with Americade in
June and the Antique Car Show after Labor Day as events to be
open for. The balloon festival is not the big draw it once was
to even justify keeping the motel open.
The septic systems are in excellent shape and in good
functioning order and at best are used two (2) months per
season/year.
It is an extreme financial hardship to close the current
septic systems down and require an expense from $52, 500 .00 to
$88, 000.00 to replace it. Connecting for such a brief period of
use (6-8 weeks) at such great expense and would be a great
financial burden. To look at another way is to say to continue
to do the same business for this brief six (6) week period it
will require us to invest as much as $88, 000.00 with no added
income to support such expense.
In addition to the Motel Units there is also an Motel Office
with a seasonal residence which is occupied basically the same
time period as the Motel . The facilities in the house are for
private use only - not public.

Also there is a Law Office and Gift shop separate from the
Motel. These are open by appointment and have no regular
employees only the owner Thomas J. McDonough and his daughter
Cathy Ratto, all of which have very limited use.
We will be taxed in the District and pay usage fees based
upon water consumption which we certainly do understand.
If "hooking up" or "connection" to the sewer is a desired
result, might the Board consider connecting the Motel residence
which is used seasonally to the sewer which will be the least
invasive and more reasonable and manageable financial expense and
the same for the Law Office/Gift Shop which is used in a limited
fashion.

WHEREAS, the Queensbury Town Board is authorized by Town Code Chapter 136 to
issue variances from §136-44 "Connection to sewers required" which requires Town property
owners situated within a sewer district and located within 250' of a public sanitary sewer of the
sewer district to connect to the public sewer facilities within one (1) year from the date of notice,
and
WHEREAS, Marianne McDonough dba GrayCourt Motel and Thomas J. McDonough Law
Office (the McDonoughs) applied to the Local Board of Health for a variance/waiver from §136-
44, as the McDonoughs requested an exemption from the Town's connection requirements to
connect their Graycourt Motel and Law Office properties to the Town of Queensbury's Route 9
Sewer District, as: connection with the lower Motel units must be constructed in a way to avoid
destruction of a 200 year old sprawling oak tree; in addition to excavating earth, all connections
will entail excavation of over 500 linear feet of black top and returning it to original condition after
connection would require complete resurfacing costing anywhere between $52,500 to $88,000 - a
financial hardship; current sewage disposal systems are in excellent working condition and are used
two months per year at best so it would not be cost effective to connect; the Motel Office with
seasonal residence is occupied during the same time period as the Motel and the house facilities are
for private use only — not public; and the Law Office and Gift Shop separate from the Motel are
open by appointment and have no regular employees other than the owner and his daughter; all as

meeting, and
WHEREAS, the Town Clerk's Office mailed a Notice of Hearing to the McDonoughs and
the Town Board conducted a hearing concerning the variance/waiver request on August 1561,2005,
NOW,THEREFORE,BE IT
RESOLVED, that
a) due to the nature of the variance/waiver request, the Queensbury Town Board
determines that the temporary granting of the variance/waiver would not be materially
detrimental to the purposes and objectives of Queensbury Town Code Chapter 136
and/or adjoining properties or otherwise conflict with the purpose and objectives of any
plan or policy of the Town of Queensbury; and
b) the Town Board finds that the granting of the variance/waiver is reasonable and would
alleviate unnecessary hardship on the applicants; and
BE IT FURTHER,
RESOLVED, that the Queensbury Town Board hereby approves Marianne McDonough
dba GrayCourt Motel and Thomas J. McDonough Law Office (the McDonoughs)'s application for
a variance/waiver from Queensbury Town Code Chapter 136, §136-44 "Connection to sewers
required" and hereby grants the McDonoughs a two-year extension of time or until August 15th,
2007 in which to connect their properties located at 1082 and 1088 State Route 9, Queensbury(Tax
Map No.'s: 296.9-1-8 and 296.9-1-9) to the Town of Queensbury's Route 9 Sewer District,
provided that if there is any change in property use, increase in septic use or additional bathroom
facilities added,then such variance shall immediately terminate unless the Queensbury Town Board

WHEREAS, the Queensbury Town Board is authorized by Town Code Chapter 136 to
issue variances from §136-44 "Connection to sewers required" which requires Town property
owners situated within a sewer district and located within 250' of a public sanitary sewer of the
sewer district to connect to the public sewer facilities within one (1) year from the date of notice,
and
WHEREAS, Marianne McDonough dba GrayCourt Motel and Thomas J. McDonough Law
Office (the McDonoughs) applied to the Town Board for a variance/waiver from §136-44, as the
McDonoughs have requested a continuing waiver and/or permanent relief from the Town's
connection requirements to connect the Graycourt Motel and Law Office properties to the Town of
Queensbury's Route 9 Sewer District for the reasons set forth in the McDonough's August 22°d,
letter and application,and
WHEREAS, the Town Clerk's Office mailed a Notice of Hearing to the McDonoughs and
the Town Board conducted a hearing concerning the variance/waiver request on Monday,
September 26th,2011,
NOW, THEREFORE,BE IT

RESOLVED,that
a) due to the nature of the variance/waiver request, the Queensbury Town Board
determines that the temporary granting of the variance/waiver would not be materially
detrimental to the purposes and objectives of Queensbury Town Code Chapter 136
and/or adjoining properties or otherwise conflict with the purpose and objectives of any
plan or policy of the Town of Queensbury; and
b) the Town Board fords that the granting of the variance/waiver is reasonable and would
alleviate unnecessary hardship on the applicants; and
BE IT FURTHER,
RESOLVED, that the Queensbury Town Board hereby approves Marianne McDonough
dba GrayCourt Motel and Thomas J. McDonough Law Office (the McDonoughs)'s application for
a variance/waiver from Queensbury Town Code Chapter 136, §136-44 "Connection to sewers
required" and hereby grants the McDonoughs a one (1) year extension of time or until September
26th,2012 in which to connect their properties located at 1082 and 1088 State Route 9, Queensbury
(Tax Map No.'s: 296.9-1-8 and 296.9-1-9) to the Town of Queensbury's Route 9 Sewer District,
provided that if there is any change in property use, increase in septic use or additional bathroom
facilities added,then such variance shall immediately terminate unless the Queensbury Town Board
reviews and approves a new application for a variance/waiver, and furthermore, if the septic system
has been determined to fail or is modified by the Applicant, or if ownership of the property is
transferred, then the variance is terminated as well and the property must connect to the Route 9
Sewer District,
BE IT FURTHER,
RESOLVED, that RESOLVED, that the McDonoughs shall pay all charges due as if their

properties were connected to the Route 9 Sewer District,and
BE IT FURTHER,
RESOLVED, that this Resolution is contingent upon the applicant obtaining cost estimates
and providing information concerning-connection to Town Sewer of the offices within one (1)year
before next year's request for a waiver,and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes the Town Supervisor, Wastewater Director
and/or Town Budget Officer to take any actions necessary to effectuate the terms of this Resolution.
