1971-12-30 SP Special Meeting December 30, 1971 Members Present: Gerald B. Solomon Supervisor Lloyd Demboski Councilman John D. Austin, Jr. gouncilman ouncilman Harold Robillard Harold Katz Town Counsel The meeting was opened with a salute to the flag. The Supervisor greeted the following visitors: Florence McIlvaine Joseph Kestner Mr. Van Dusen Croswell Tuttle Kip Grant Jerry Thorne Mary Lou Quinn Ed Waters Thomas Flaherty Fred Austin First on the agenda was the opening of bids for a new police car. Proof of advertising was shown by the Clerk. Bids were received from Whiteman Chevrolet, Pride Motors and The Ford Garage Co. Due to the absence of the Police Chief a decision on the bids was not taken. The bids will be turned over to the Police Chief for his consideration. Next on the agenda was a public hearing on the Filtration Plant and Distribution Lines. The hearing was opened at 8:12 P.M. , proof of publication was shown by the Clerk. Mr. Solomon introduced Mr. Joseph Kestner, Consulting Engineer of the project who spoke to the people in attendance. The project will cost $4,175,000 and will produce 5 million gallons a day. The action is subject to approval of the Dept. of Audit and Control and the Water Resources Commission and also to a 30 day Permissive Referendum. Supervisor Solomon stated that the storm probably held down the crowd but the board is ready to discuss the project at any time during the 30 day referendum period. The reason the board is taking immediate action is --� to get state approval within six weeks and the project put to bid this .: winter. The total cost includes a $2.5 million for the filtration plant near the Sherman Island Dam on the south side- of the Corinth Road; $1.6 million for 6.25 miles of 16 and 24 inch transmission mains and $75,000 for a maintenance building. The first year and maximum tax rate for the district is estimated at $10 per thousand of assessed valuation. The storage and distribution district will encompass areas servedeby the present municipal well system and two new districts formed earlier this year-, subject to a new source of supply. Kestner said the plant will be well located from the standpoint of hydraulics. The Hudson River at this point is 30 feet higher than Lake George and about 80 feet higher than Pruyns Island. The hearing was declared closed at 8:42 P.M. The police report for November was read and placed on- file. Councilman Austin thanked Joseph Kestner the Consulting Engineer, Thomas Flaherty, Wgter Superintendent and to Hammond Robertson for all the work that they had dpne on this project. RESOLUTION TO FILL PLANNING BOARD VACANCIES RESOLUTION_ N_O. 255, introduced by Mr. Austin who moved its adoption seconded by Mr. Demboski. WHEREAS, the town board has received the resignation of William -Yale from the Town Planning Board and WHEREAS the 'Planning Committee has recommended the name of Richard Roberts of Haviland Road to succeed Mr. Yale and WHEREAS the term of John Sinnott of Chestnut Ridge has also expired therefore be it RESOLVED that Richard Roberts be appointed to fill the unexpired term `— of William Yale which will be September 30, 1976, and John Sinnott be reappointed, term to expire on September 30, 1977. RESOLUTION TO FILL ZONING BOARD VACANCIES RESOLUTION NO. 2569 introduced by Mr. Robillard who moved its adoption seconded by Mr. Demboski. WHEREAS, due to the resignation of Gordon Streeter from the Zoning Board due to his candidacy for the Town Board and WHEREAS, the term of George Ktirosaka has also expired therefore be it RESOLVED, that the Zoning Committee's recommendation of Richard Sanderspree of Cleverdale be accepted and that he serve out the term of Gordon Streeter which expires on September 14, 1975, and George Kdrosaka be reappointed his term to expire on September 14, 1976. WHEREAS, Robert Broughton has resigned from the Recreation Commission and WHEREAS the Recreation Committee has recommended the name of Jerry Howe of Rockwell Road therefore be it RESOLVED, that Jerry Howe be appointed to fill the unexpired term of Robert Broughton whose term expires on February 27, 1973. Mr. Solomon stated that in accordance with a new state law a Board of Assessment Review must be created. 14 RESOLUTION TO APPOINT BOARD OF ASSESSMENT REVIEW RESOLUTION NO. 258, introduced by Mr. Robillard who moved its adoption seconded by Mr. Demboski. WHEREAS, due to a new state law a board of assessment review must bq appointed therefore be it RESOLVED, thAt Roy Foley of Lupine Lane, Roy Behan of Sherwood Drive and Earl Ellsworth of Ridge Road be appointed to this board and that their terms will expire, December 30, 1974, December 30, 1975 and December 30, 1976 respectively. A letter was received from Ed Waters of Queensbury Ave.asking for reappointment to Dog Warden. Mr. Solomon announced that the Organization meeting will be held on New Years day at noon. At that time two new councilman will be appointed to replace Hammond Robertson and John D. Austin Jr. ° RESOLUTION TO APPROVE AUDIT OF BILLS RESOLUTION NO. 259, introduced by Mr. Austin who moved its adoption seconded by Mr. Demboski. AUSTIN THE TOWN LAW The Town Board of the Town of Queensbury, in the County of Warren and State of New York, meeting in regular session at the Town Office Building in the Town of Queensbury in the County of Warren, New York, on the 30th day of December, 1971 at 8:00 o'clock P.M. , Eastern Standard Time. Solomon Supervisor Lloyd Demboski Councilman John Austin Councilman Harold Robillard Councilman ABSENT: None The following resolution was moved by Mr. Solomon, seconded by Mr. Austin and passed: WHEREAS , a map , plan and report relating to the estab- lishment of the proposed Queensbury Water Storage and Distribution District prepared by Joseph Kestner, Jr. , Consulting Engineer, of Troy, New York, duly licensed by the State of New York, in the manner and containing such detail as has been determined by the l t Town Board of the Town of Queensbury, has been duly filed with the Town Clerk of the Town of Queensbury in accordance with the requirements of Article 12-A of the Town Law; and ` WHEREAS , an Order was duly adopted by the Town Board of the Town of Queensbury on the 14th day of December, 1971, recitin the filing of said map, plan and report, the improvements pro- posed, the boundaries of the proposed district, the estimated expense thereof, the proposed method of financing, the fact that the map , plan, and report describing the same, are on file in the Town Clerk's Office for public inspection, and stating all other matters required by law to be stated, and specifying the 30th day of December, 1971 at 8:00 P.M. on that day as the time and the Town Office Building in the Town of Queensbury as the place where the said Town Board would meet to consider the said map , plan and report, and to hear all persons interested in the subject thereof concerning the same , and to take such action thereon that is required or authorized by law; and WHEREAS , such order was duly published and posted as required by law; and WHEREAS , a hearing was duly held by said Town Board on the 30th day of December, 1971 beginning at 8:00 P.M. at the Town Office Building of the Town of Queensbury, New York, and full discussion of the matter having been had, and all persons desiring to be heard having been duly heard, now, upon the evidence given at such hearing, it is RESOLVED, AND DETERMINED: i d rb A. That all the property and property owners benefited are included within the limits of the proposed district . D. That it is in the public interest to establish said water storage and distribution district, and be it further RESOLVED AND DETERMINED, that the establishment of the water storage and distribution district as set forth in said map, plan and report be approved; .that the improvements therein men- tioned be constructed and the necessary easements and lands be acquired, upon the required funds being made available and pro- vided therefor; and such district shall be known and designated as "QUEENSBURY WATER STORAGE AND DISTRIBUTION DISTRICT" in the Town of Queensbury, and shall be bounded and described as set forth in Schedule A. attached hereto and made a part hereof; and be it further RESOLVED, that the proposed improvements , including the construction costs , cost of acquisition of lands and easements , legal and engineering fees , and all other expenses , be financed by the issuance of serial bonds of said Town to mature in such number of annual installments not exceeding forty (40) , as may hereafter be determined by the Town Board of the Town of Queens- bury, payable in the first instance from assessments levied upon benefited real property in said district'; and it is further -3- RESOLVED, that this resolution shall be subject to a referendum as provided in Section 209-E of the Town Law; and be i it further RESOLVED, that Harold W.
