Noes : None Supervisor Solomon passed the minutes of the Planning Board meeting to the Councilmen. A petition signed by 66 :residents of the Old Forge Park Development was given to the Town Board protesting the dumping of debris caused by the Glens Falls Urban Renewal on property located on upper Sherman Avenue. The petition was given to the Town Clerk for filing. Solomon Supervisor 3.05 RESOLUTION TO SET PUBLIC HEARING ON ORDINANCE OF THE TOWN OF QUEENSBURY ENTITLED "ELECTRICAL INSPECTION ORDINANCE". RESOLUTION No. 68 , introduced by Mr. Robertson, who moved its adoption, seconded by Mr. Austin. RESOLVED, that a public- hearing be held on the following ordinance on the 15th day of April, 1971 at 8 :00 P.M. at the Queensbury Town Office Building, Bay and Haviland Roads, Glens Falls, New York, and that the Town Clerk give notice of such hearing by publication of a notice thereof in the official Town Newspapers at least once 10 days prior to the date specified for such hearing specifying the time when and the place where such hearing will be held and in general terms describing said proposed ordinance. RESOLVED, That the following Electrical Inspection Ordinance be adopted by the Town of Queensbury creating the position of Electrical Inspector. Section 1- ELECTRICAL INSPECTOR: The Chief Inspector, and each of the duly appointed Inspectors of the New York Board of Fire Under- writers are hereby authorized and deputized as agents of the Town of Queensbury to make inspections and reinspections of all electrical installations heretofore and hereafter- described, and to approve or disapprove the same. In no event, however, will the cost or expense of such inspections and reinspections be a charge against the Town of Queensbury. Section 2- DUTIES OF THE ELECTRICAL INSPECTOR: It shall be the duty of the Inspector to report in writing to the Chief Building Inspector, whose duty it shall be to enforce all provisions of this Code, all violations or deviations from or omissions of the electrical provisions of the Building Code applicable to the Town of Queensbury and of all local laws, Ordinances and the Building Code as referred to in this Ordinance insofar as any of the same apply to electrical wiring. The Inspector shall make inspections and reinspections of electrical installations in and on properties in the Town of Queens- bury upon the written request of an authorized official of the Town of Queensbury or as herein provided. The Inspector is authorized to make inspections and reinspections of electrical wiring, installations , devices, appliances and equipment, in or on properties within the Town of Queensbury where he deems it necessary for the protection of life and property. In the event of an emergency it is the duty of the In- spector to make electrical inspections upon the oral request of an official or officer of the Town of Queensbury. It shall be the duty of the Inspector to furnish written reports to the proper officials of the Town of Queensbury and owners and/or lessees of property where defective electrical installations and equipment are found upon inspection. He shall authorize the issuing of a certificate, of compliance when electrical installations and equipment are in conformity with this Ordinance. He shall direct that a copy of the certificate of compliance be sent to the Town of Queensbury to the attention of the Building Inspector. Section 3- VIOLATIONS OF THE ORDINANCE: It shall be a violation of this Ordinance for any person, firm or corporation to install or cause to be installed, or to alter electrical wiring for light, heat or power in or on properties of the Town of Queensbury until appli- cation for inspection has been filed with The New York Board of Fire Underwriters. It shall be a violation of this Ordinance for a person, firm or corporation to connect or cause to be connected electrical wiring in or on properties for light, heat or power, to any source of electrical energy supply, prior to the issuance of a temporary 106 certificate, or a certificate of compliance by the New York Board of Fire Underwriters. Section 4—This Ordinance will take effect ten .days after its publication and posting in accordance with the provisions of Section 133 of the Town Law, Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes: None The meeting was opened to tle public . Mr. Carleton Tucker and Mr. Robert Pollock voiced their protests against the use of an Upper Sherman Avenue site for disposal of urban renewal demolition debris. TIC City of Glens Falls owns the site located in the Town of Queensbury but its request to use the area for a landfill disposal operation was denied by the Town Board several years ago following a public hearing that brought forth strong and concerted opposition from residents of the area. Supervisor Solomon explained that the Board hoped to have a legal interpretation tomorrow from the Town Attorney. He in- dicated that there was a question as to whether the city was in violation of the town ordinance because the material being dumped was debris not garbage. Mr. Tucker said jiink cars were being hauled there. Mr. Solomon said he was not aware of this. Mr. Tucker said the city has a site on Sherman Island and there is plenty of room down there. Mr. Tucker asked why did the city pick this particular time to dump on Sherman Avenue. Mr. Pollock wanted to know who gave Glens Falls the right to dump in Queensbury and whether the city owned other areas with similar rights. After Mr. Solomon pointed out that the demolition haulers have agreed to cover up the debris, Mr. Tucker asked about the legality of removing sand and gravel in an R-3 District. The Supervisor pointed out that this is legal as a non-conformin; use that pre-existed zoning. Councilman Robillard brought up the subject of complaints he had heard concerning debris falling off trucks en route to the area. If the trucks are not securely covered they are in violation of the ordinance. Councilman Austin said he to was very concerned about the operations on Sherman Avenue of the last two days and said while we are waiting for the Town Counsel' s decision, I am of the firm opinion that the activity is con- trary to our ordinance. The meeting was closed to the public. RESOLUTION TO POST HIGHWAYS RESOLUTION No. 69, introduced by Mr. Robertson, who moved its adoption, seconded by Mr. Austin. WHEREAS, Superintendent of Highways, Carl A. Garb, has recommended Pursuant to Section 1660, Subdivision (a) 11 of the New York State Vehicle and Traffic Law, that certain Highways within the town should be closed to any vehicle with _a gross weight in excess of-k1'tons per wheel, effective from the time of the erection of the signs and WHEREAS, the restriction will be in effect until the removal of the signs as directed by the Town Board of the Town of Queensbury, therefore be it RESOLVED, that the following; roads be closed under this order and further RESOLVED, that proper notice shall be made in the local press. Olsen, as a member of the Queensbury Recreation Commission expired February 27 , 1971, therefore be it RESOLVED, that Daniel C. Olsen be and he is hereby reappointed a member of the Recreation Commission of the Town of Queensbury for a term of five (5) years to commence February 27, 1971 and to expire February 27, 1976. WHEREAS, this Board did by Resolution No. 61 appoint J. Patrick Dee, Provisional Patrolman and WHEREAS, this Board has been informed by the Police Chief that J. Patrick Dee has successfully completed a Municipal Police Training School, therefore be it RESOLVED, that the yearly salary of J. WHEREAS, this board did by Resolution No. 62 appoint James F. Ogden, Provisional Sergeant, thereby qualifying him for an increase in salary, �C7 therefore be it RESOLVED, that the yearly salary of James F. Ogden be $7,700.00 effective March 15 , 1971. Noes : None Supervisor Solomon announced that fee charges for commercial rubbish collectors, contractors and sewage haulers are being re- viewed with the expectation of adopting regulations and schedules that will be in line with those in effect in surrounding munici- palities. Supervisor Solomon said there would be a workshop meeting on water for Tuesday night, March 23rd, with Joseph L. Kestner, the consulting engineer on the proposed Hudson River filtration plant and water district in western Queensbury. Supervisor Solomon reminded the residents of Queensbury that they will need the official sticker in order to gain access to the land- full site after April lst. Starting April 4th the landfill site will be open on Sundays. The stickers may be obtained from the Town Clerk upon proper identification. On motion the meeting was adjourned.
