1971-07-22 Regular Meeting July 22, 1971 Present: Gerald B. Solomon Supervisor John Austin, Jr. Councilman Harold Robillard Councilman Lloyd Demboski Councilman Hammond Robertson, Jr. Councilman was absent. Attorney Harold Katz was present. The meeting was called to order at 8:15 P.M. with a salute to the flag. The following visitors were greeted by the Supervisor: John Bowman Pliney Tucker Mary Lou Quinn Ed Waters Florence Mcllvaine James Ogden Dan Sweet Mr and Mrs John Richardson Winona Wood Mrs Kelly The public hearing on the application of George and Marjorie Dresser of South Glens Falls, N.Y. to locate a Mobile Home on Ohio Ave. in West Glens Falls, N.Y. was opened at 8:15 P.M. Proof of publication was shown by the Clerk. No one spoke in favor of or against the application. The hearing was closed at 8:20 P.M. The public hearing on the application of Winona Wood of Homestead Village Trailer park, Glens Falls, N.Y. to locate . a Mobile Home on West Drive, Glens Falls, N.Y. was opened at 8 :20 P.M. . Proof of publication was shown by the Clerk. Mr. Dan Sweet asked for the floor. He claimed he was opposed to granting permission to Mrs. Wood. He stated that in his opinion the trailer would reduce the value of his property. There are no trailers on this property at present. The public hearing was closed at 8 :25 P.M. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION NO. 157 , introduced by Mr. Austin, who moved its adoption, ^'seconded by Mr. obillard. WHEREAS, George and Marie Dresser of South Glens Falls, N.Y. have,:knade application in accordance with paragraph 2 (c),.'Section 4, of an ordinance of the Town of Queensbury entitled; ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE-;-HOME COURTS IN THE TOWN OF QUEBNSBURY, WARREN COUNTY, NEW YORK to locate a mobile home outside of a duly licensed mobile home court at property situated at Ohio Ave. in the Town of Queensbury and WHEREAS, this Town Board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuancd of the permit requested by said application,for the following reasons: there were no perso'Wail?sffFearance in opposition to granting the permit, there was sufficientAs own and the Building Inspector approved the application, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to George and Marie Dresser of South Glens Falls, N.Y. to locate a mobile home outside of a licensed mobile home court at property situated at Ohio Ave. in the Town of Queensbury and that the Building Inspector is hereby authorized and directed to issue such permit in %accordance with the terms and conditions of said ordinance. RESOLUTION TO DISAPPROVE APPLICATION FOR MOBILE HOME RESOLUTION NO. 158, introduced by Mr. Robillard, who moved its adoption, seconded by Mr. Solomon. WHEREAS, Winona Wood of Homestead Village Trailer Park in the Town of Queensbury has made application to this board for a permit to locate a mobile home at property situated at West Drive in the Town of Queensbury and WHEREAS, upon proper investigation it appears that the applicant has 180 complied with all of the requirements of the Ordinance Regulations relating to mobile homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown on the original- application and that the application met with the disapproval of the neighbors therefore be it further RESOLVED, that the application of Winona Wood be and is hereby disapproved and that the Building Inspector is hereby directed to notify Mrs. Wood of the decision of this board. Duly adopted by the following vote: Ayes:.. Mr. Demboski, Mr. Austin, Mr, Rob-illard and Mr. Solomon. Noes: None. - The applications of Mr. and Mrs. Douglas Johnson, Mr. Frederick Putsch, Mr. Robert Russell, Karl Lewis, Marshall Clemens, and Joan Combs were tabled for a future meeting. The meeting was declared open to the public at this time. Mr. Michael O'Connor was given the floor to speak in regard to the Gerald Brown rezoning application. Mr. O'Connor said he would like to withdraw the application for rezoning at this time. A petition objecting to the rezoning was entered into the record. The meeting- was then closed to the public. Louis Fisher Hon. Byron-Tillotson Hon. Leon Layden Gentlemen: This is to bring you up to date concerning the status of our system. You have undoubtedly seen our trucks stringing strand and cable. We have completed sixty miles of strand in the five municipalities and have installed twelve miles of cable and cable is being currently installed at a rapid pace. We have experienced some difficulties and have had to go underground in certain areas where pole space was not available. The preparatory make-ready work, because of storm damage received by the utilities, has been slow. We cannot utilize the poles until the work is done. We are receiving signals in our head-end. We have opened a studio at 139 Dix Ave. which is fairly centrally located geographically to service the five municipalities. Our tower is nearby and we feel it is most strategically located to give service to all subscribers. We have established a policy of taking no deposits until we are in a position to give service. Solomon, Supervisor July 20, 1971 Town of Queensbury Town Office Building Rd#1 Glens Falls, New York, 12801 Dear Mr. Solomon: I am pleased to inform you that the application you submitted to us earlier this year for federal and state grants for a Comprehensive Planning Assistance (701) Program has been approved by the U.S. Department of Housing and Urban Development. OPS approved and submitted your application to HUD on April 19. A news story covering all such applications throughout the State will be released during the week of July 19. Contract documents and additional information will be forwarded to you shortly. Sincerely, Richard Wiebe Three letters from the Building and Zoning Department were read by the Clerk. These letters had to deal with unsafe structures of the following persons: The Chauncey Didio Estate, Isabell Hall, and Francis DeEamilla. Resolution No' s 159-160-161 declaring the structures as hazardous in the definition of the ordinance are not available at this time but, will be forthcdming from Attorney Harold Matz and will be found on Pages 183-184. Legal notices to be served on these persons will also be made up by the Town Attorney. These buildings were ordered demolished or repaired if they can be repaired with safety. RESOLUTION TO ENTER INTO CONTRACT WITH THE LAKE GEORGE OPERA FESTIVAL RESOLUTION NO. 162, introduced by Mr. Solomon who moved its adoption, seconded by Mr. Robillard. WHEREAS, the Town Board made as appropriation to the publicity fund of the town for the fiscal year of 1971, and WHEREAS, the Opera Festival Association, Inc. is located in the Town of Queensbury and the publicity program of the Opera Festival will be of great benefit to the town, be it RESOLVED, that the Town Board of the Town of Queensbury enter into contract with the Opera Festival Association, Inc. , which will provide that Opera Festival Association, Inc. , promote the Town of Queensbury as a summer vacation area and cultural center for the lower Adirondack and Lake George section in consideration of the sum of $5 ,000.00 to be paid from said appropriation, and be it further RESOLVED, that the Supervisor be and he hereby is authorized to execute such contract on behalf of the Town Board of the Town of Queensbury in form approved by the Town Counsel. RESOLUTION TO APPROPRIATE YEAR END BALANCE AND SURPLUS MONEY IN ITEM IV HIGHWAY ACCOUNT RESOLUTION NO. 163, introduced by Mr. Demboski who moved its adoption seconded by Mr. Robillard. WHEREAS, there now exists certain unappropriated surplus funds in Item IV of the Highway Account, therefore be it RESOLVED, that the sum of $2049.51 in excess revenues and the sum of $996.93 unappropriated year end balance be appropriated as follows: $209.82 to DS 9030.8 - Social Security and $2,836.62 to DS 5142.4 Contractual thereby increasing DS 9030.8 from ,;QoY.co$ 8.00 to $ and aS/-•k.', DS 5142.4 from $14,414.00 to $17,250.62. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard and Mr. Solomon. Noes: None. Mr. Solomon announced that the appointment of Election Inspectors for the August 5th referendum on SewersNwould be done this evening. Mr. Solomon also read the voting procedures and eligibility rules for voting. Mr. Katz also spoke in regard to rules for voting. He emphasized that persons who reside in the Pershing-Ashley-Coolidge Sewer District or any of its five extensions and residents of the Reservoir Park Sewer District and its extensions may not vote because these districts are not included in the proposed district. Mr. Solomon said these persons will have their say as to participations of costs at budget time. The Town Attorney is drafting a letter to each of these property owners explaining their status in more detail. The list of eligible voters has been prepared by the Assessors and is now available if anyone has a question. Mr. Solomon reviewed the boundaries. In regard to hookups for individual homes if the distance is not more than 100 feet from the Town right-of-way_ the cost would be roughly $5.00 per foot. For a distance farther than 100 feet the cost would drop to $4.00 per foot. The average cost would be about $150.00. --- RESOLUTION APPOINTING ELECTION INSPECTORS FOR SEWER REFERENDUM RESOLUTION NO. 164, introduced by Mr. Austin who moved its adoption, seconded by Mr. Demboski. RESOLVED, that the following Election Inspectors be appointed to work during the Special Election on August 5 , 1971 between the hours of 12 noon and 8:00 P.M. at the Town Office Building, Town of Queensbury, Bay and Haviland Roads, Glens Falls, New York, in regard to the establishment of the Queensbury Sewer District: REPUBLICAN DEMOCRAT Minnie Bidwell Elva M Dermott Lois Smith Dorothy Barker Pauline Joslyn Jean Sullivan Joyce Garb (alternate) Ann Dougher (alternate) Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard and Mr. Solomon In regard to complaints about noise at a Route 9 restaurant adjacent to a residential area the Supervisor appointed Councilmen Austin and Dembosk; to study the possibility of an anti-noise ordinance. Mr. Austin accepted the assignm6nt but urged that the board proceed against the restaurant in the meantime under the disturbance of peace clause. Answering Solomon' s query Mr. Katz said members of the board could proceed as individual complaints. Upon adjournment the board will conduct a workshop session on the proposed Western Queensbury Water District. Meeting was adjourned at 9:00 P.M. Respectfully submitted, Donald A. Chase Town Clerk RESOLUTION No. 159, introduced by Mr. Austin, who moved its adoption, seconded by Mr. Demboski. - WHEREAS Town of Queensbury Ordinance No. 31 duly adopted December 10, 1970 and entitled "Unsafe Buildings and Collapsed Struc- tures Ordinance of the Town of Queensbury provides for the procedures to be followed with respect to any structure in said Town deemed to be unsafe or dangerous to the public , and WHEREAS, the Building Inspector of the Town of Queensbury, the official appointed by the Town Board for the purpose of enforcing said ordinance, has inspected and reported that the premises owned by the Chauncey DiDio Estate and located at 17 Luzerne Road in said Town of Queensbury is deemed unsafe and dangerous to the public, and has recommended that the said structure be demolished, now therefore, be it RESOLVED that said structure be and the same hereby is deemed unsafe and dangerous to the public, and be it further RESOLVED that notice of this finding and resolution shall be given to the owner of the subject property as provided for in said Or- dinance No. 31 of the Town of Queensbury, and be it further RESOLVED that upon the failure, neglect or refusal of said owner to comply with said order of the Town Board, a survey of said premises be made and report rendered to the Town Board for further ac- tion. WHEREAS, Town of Queensbury Ordinace No. 31 duly adopted December 10, 1970 and entitled "Unsafe Buildings and Collapsed Struc- tures Ordinance of the Town of Queensbury" provides for the precedures to be followed with respect to any structure in said Town deemed to be unsafe or dangerous to the public, and WHEREAS, the Building Inspector of the Town of Queensbury, the official appointed by the Town Board for the purpose of enforcing said ordinance has inspected and reported that the premises owned by Francis W. DeCamilla located on south side of Dixon Road in said Town of Queensbury, described on Queensbury Tax Map as Section 114, Block 2, Lot 14 is deemed unsafe and dangerous to the public, and has recom- mended that the said structure be demolished, now therefore be it RESOLVED that said structure be and the same hereby is deemed unsafe and dangerous to the public, and be it further RESOLVED that notice of this finding and resolution shall be given to the owner of the subject property as provided for in said Or- dinance No. 31 of the Town of Queensbury, and be it further RESOLVED that upon the failure, neglect or refusal of said owner to comply with said order of the Town Board, a survey of said premises be made and report rendered to the Town Board for further action. Solomon Supervisor Lloyd Demboski Councilman John D. Austin, Jr. Councilman J Harold Robillard Councilman Hammond Robertson, Jr. Councilman The meeting was called to order at 8 :50 P.M. The following visitors were greeted by the Supervisor: Mrs. Douglas C. Johnson Edward Waters Ray Irish Herold Rist Leon Nassivera Iry Dean Supervisor Solomon annouced that the Queensbury Sewer District was approved by a vote of nearly two-to-one in the special referendum vote held today. About 16 per cent of the some 6,000 eligible voters turned out. With a total of 968 votes tallied on the three maclines, the results were 605 in favor, 343 opposed and 20 blank. Councilman Austin expressed gratitude to Leon Nassivera, the team of election inspectors and all other members of the town family who helped to make the election process efficient. He said it was some- —� thing new for all of us and we didn' t have much precedent to go on. He said the months of planning on Leon Nassivera' s part paid off. The Board also commended Rist-Frost Associates for lending its expertise to the town to calculate costs and chart engineering plans for the pro- posed sewer district.
