1971-08-05 SP 94 RESOLUTION Nos 161, introduced .by Mr. Austin, who moved its adoption, seconded by Mr. Demboski. WHEREAS, Town of Queensbury Ordinace No. 31 duly adopted December 10, 1970 and entitled "Unsafe Buildings and Collapsed Struc- tures Ordinance of the Town of Queensbury" provides for the precedures to be followed with respect to any structure in said Town deemed to be unsafe or dangerous to the public, and WHEREAS, the Building Inspector of the Town of Queensbury, the official appointed by the Town Board for the purpose of enforcing said ordinance has inspected and reported that the premises owned by Francis W. DeCamilla located on south side of Dixon Road in said Town of Queensbury, described on Queensbury Tax Map as Section 114, Block 2, Lot 14 is deemed unsafe and dangerous to the public, and has recom- mended that the said structure be demolished, now therefore be it RESOLVED that said structure be and the same hereby is deemed unsafe and dangerous to the public, and be it further RESOLVED that notice of this finding and resolution shall be given to the owner of the subject property as provided for in said Or- dinance No. 31 of the Town of Queensbury, and be it further RESOLVED that upon the failure, neglect or refusal of said owner to comply with said order of the Town Board, a survey of said premises be made and report rendered to the Town Board for further action. The following visitors were greeted by the Supervisor: Mrs. Douglas C. Johnson Edward Waters Ray Irish Harold Rist Leon Nassivera Iry Dean Supervisor Solomon annouced that the Queensbury Sewer District was approved by a vote of nearly two-to-one in the special referendum vote held today. About 16 per cent of the some 6,000 eligible voters turned out. With a total of 968 votes tallied on the three maclines, the results were 605 in favor, 343 opposed and 20 blank. Councilman Austin expressed gratitude to Leon Nassivera, the team of election inspectors and all other members of the town family who helped to make the election process efficient. He said it was some- thing new for all of us and we didn't have much precedent to go on. He said the months of planning on Leon Nassivera' s part paid off. The Board also commended Rist-Frost Associates for lending its expertise to the town to calculate costs and chart engineering plans for the pro- posed sewer district. RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION No. 165, introduced by Mr. Austin, who moved its adoption, seconded by Mr. Robillard. WHEREAS, Mr. & Mrs. Douglas C. Johnson of 1 Liberty Place, Hudson Falls, N.Y. , have made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE RE- GULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court as property situated Lots 1 and 2 on Pinello Road, Town of Queensbury, N.Y. , and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said appli- cation are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordin- ance, the town board shall conduct a public hearing on said application on August 19, 1971 at 8:00 P.M. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provi- sions of said ordinance. Noes: None RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION No. 166, introduced by Mr. Austin, who moved its adoption, seconded by Mr. Robertson. WHEREAS, Robert Kenneth Russell of R.D. Comestock Road, Whitehall, N.Y. has made application in accordance with paragraph 2 (c) Section T 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN OOUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Dawn Drive, Town of Queensbury, N.Y. , and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned or- dinance, the town board shall conduct a public hearing on said appli- cation on August 19, 1971, at 8:00 P.M. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. WHEREAS, Marshall Clemens of Star Route, Glens Falls has made applica- tion to this board for a permit to : substitute a larger and more modern trailer in place of his present trailer at property situated at Star Route, Glens Falls, N.Y. and owned by Marshall Clemens, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the ordinance regulations relating to mobile homes in the Town of Queensbury, therefore be it RESOLVED, that the application of Marshall Clemens as above described is hereby approved and that the Town Clerk is hereby authorized and directed to issue to Marshall Clemens the proper permit. Noes: None RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION No. 168, introduced by Mr. Robillard, seconded by Mr. Demboski. WHEREAS, Frederick C. Putsch of 656th Radar Sq. , Saratoga AFS, New York, has made application to this board for a permit to locate a Mobile Home at property situated at Sunset Avenue, Glens Falls, N.Y. and owned by Mrs. Albert Thompson and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Regulations relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown on the original applica- tion, therefore be it further RESOLVED, that the application of Frederick C. Putsch be and is hereby disapproved and that the Town Clerk is hereby directed to notify Frederick C. Putsch of the decision of this Board. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Robillard and Mr. Robertson Noes : Mr. Austin and Mr. Solomon RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION No. 169, introduced by Mr. Austin, seconded by Mr. Demboski. WHEREAS, Karl E. Lewis of Ralph Road, Lake Luzerne, N.Y. has made applicationta this Board for a permit to locate a Mobile Home at property situated off Dream Lake Road, Town of Queensbury, N.Y. and owned by Karl E. Lewis and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Regulations relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown on the original applica- tion, therefore be it further RESOLVED, that the application of Karl E. Lewis be and is hereby —+ disapproved and that the Town Clerk is hereby directed to notify Karl E. Lewis of the decision of this Board. Noes: None The application of Joan Combs of Van Duesen Road, West Glens Falls, N.Y. to locate a mobile home on Warren Lane, Town of Queensbury, N.Y. was tabled until the next meeting. 187 Supervisor Solomon moved a resolution appointing Leon Nassivera as Town Assessor for a six-year term beginning October 1, 1971, under the new assessing system. One provision of the so-called Assessment Improvement Law enacted by the 1970 State Legislature requires "first- class towns" such as Queensbury to name a professional assessor re- placing the former board of assessors. Supervisor Solomon described Nassivera as "the best assessor in Warren County". Councilman Harold Robillard, co-chairman of the assessment committee, asked the entire Town Board to second Mr. Solomon' s motion as a show of confidence in Nassivera' s appointment. RESOLUTION NO. 170, introduced by Mr. Solomon, who moved its adoption, and seconded by Mr. Demboski, Mr. Austin, Mr. Robillard and Mr. Robertson. WHEREAS, Article 15A of the Real Property Tax Law of the State of New York establishes new assessment organization and procedures in local governments, and WHEREAS, Section 1522 of said Article provides that each local government to which said Article applies shall have only one assessor who shall be appointed by the legislative body of the affected local government and that the term of office of assessor shall be six (6) years to commence on October 1, 1971, and WHEREAS, Leon Nassivera of the Town of Queensbury meets the stan- dards of qualification and training established for the office of assessor, now, therefore, BE IT RESOLVED that Leon Nassivera be appointed as assessor for the Town-of Queensbury for a term of six (6) years commencing October 1, 1971. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon Noes: None Town Attorney Harold W. Katz distributed new Queensbury coat of arms to members of the board to be worn on their coats. Resolution No. 171 urging Ray Fuller, district engineer of the State Transportation Department, to- act immediately on two- areas of traffic problems along Route 9 in the Town is not available- at this time but will be forth coming from Councilman John Austin and will be found on Page 192 Mr. Austin said that both the system of traffic lights at Storytown U.S.A, an amusement attraction, and the Gurney Lane in- tersection with Route 9 merit scrutiny by the State.
