Austin, Jr. Councilman Harold Robillard Councilman Attorney Harold Katz was also present. Councilman Hammond Robertson, Jr. was absent. - The meeting was called to order at 8 :15 P.M. and opened with a salute to the flag. `- The following visitors were greeted by the Supervisor: Ed Waters Kip Grant Mary Lou Quinn Douglas Johnson Ralph Russo III Robert Russell The public hearing on the Mobile Home application of Robert- Russell was declared open at 8 :16 P.M. This application has the approval of the Building Inspector. Proof of advertising was presented to the Board by the Clerk. No one spoke for or against the application. The public hearing was declared closed at 8 :18 P.M. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION NO. 171, introduced by Mr. Austin, who moved its adoption seconded by Mr. Robillard. Whereas, Robert Russell of Whitehall, N.Y, has made application in accordance with paragraph 2 (c) Section 4,- of an ordinance of the Town of Queensbury entitled: ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a Mobile Home outside of a duly licensed Mobile Home Court at property situated on Dawn Drive , Town of Queensbury, and WHEREAS, This Town Board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: Sufficient hardship is shown, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to Robert Russell of Whitehall, N.Y. to locate a mobile home outside of a licensed mobile home court, at property situated- at Dawn Drive, Town of Queensbury and that the Building Inspector is herebe authorized and directed to issue- such permit in accordance with the tek-ms and conditions of said ordinance. Duly adopted by the fallowing vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard and Mr. Solomon. Noes : None. The Mobile Home application of Douglas Johnson was presented to the Board for a Public Hearing. The hearing was declared open at 8 :20 P.M. The application has the Building Inspector' s approval. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION NO. 174, introduced by Mr. Demboski, who moved its adoption seconded by Mr. Robillard. WHEREAS, Douglas Johnson of Hudson Falls, N.Y. has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled: ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate. a mobile home outside of a duly i90 licensed mobile home court at property situated at Lots No. 1 & 2 Pinello Road, Town of Queensbury and WHEREAS, this Town Board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to Douglas Johnson of Hudson Falls, N.Y. to locate a mobile home outside of a licensed mobile home court, at property situated at Lots 1 & 2, Pinello Road, Town of Queensbury and that the Building Inspector is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard and Mr. Solomon. Noes: None. The application of John Matthews was then brought before the Board. This application is for a 1 year permit and even though a public hearing is not usually required for a one year permit but because of its location it was decided that we should hold a public hearing if that is the wish of the board. RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 1759 introduced by Mr. Robillard, who moved its adoption, seconded by Mr. Austin. WHEREAS, John Matthews of RD #1, Lake George, N.Y. has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled : ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Plumb Point, Dark Bay, Route 9L in the Town of Queensbury and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideratian by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on September 9, 1971 at 8 :00 P.M. in the Queensbury Town Office Building, Bay Road and that the Town Clerk` is hereby authorized and directed to give proper notice of said public hearing in acc- ordance with the provisions of said ordinance. Duly adopted by the following vote: Ayes: Mr. Austin, Mr. Robillard and Mr. Solomon Noes: Mr. Demboski. The Mobile Home applications of Ralph Russo Ill, and Stephen Hall were tabled until the next Board meeting. Supervisor Solomon asked the Safety Committee to prepare recommendations with respect to parking or standing on Old- Aviation Road. Now that the relocated Aviation Road is open to traffic, the old section previously a town road will be turned back to the town. The parking there has created a problem. RESOLUTION TO AUTHORIZE ADDITIONAL STREET LIGHTING RESOLUTION NO2_176, introduced by Mr. Austin who moved its adoption seconded by, Mr. Demboski. RESOLVED, the following list of streetlights be installed as soon as possible. They are to be the 400 Watt .white mercury type and the X91 Town Clerk shall notify Niagara Mohawk by sending them a certified copy of this resolution. Pole No. 28 Corner of Wincrest Drive and Country Club Road. Pole No. 14 Corner of Sweet Road and Country Club Road. Pole Nos. 5 and 3 on the 90 degree turn just as you go on Chestnut Ridge Road from Ridge Road. Duly adopted by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard and Mr. Solomon. Mr. Solomon termed "erroneous" and "without basis" an article pub- lished in the newspaper Tuesday concerning burning regulations in the Town as set forth by Forest Ranger George Stec of the Con- servation Dept. He referred to the article that a new amendment to the Public Health Law makes burning in barrels illegal. With a population of under 20,000 but more than 10,000 the town does not come under the jurisdiction of the En-Con Air Pollution Control Division but is still under the jurisdiction of the State Health Department. Open burning in containers in the town will be allowed until further notice. It will not be necessary to obtain a permit. Mr. Solomon said he discussed this with the Chief Forest Ranger at Warrensburg and with the State Health Department and they all agreed. Councilman Demboski said that while burning might be allowed it should not be encouraged. Councilman Austin said that many persons have voluntarily stopped burning. Councilman Austin announced that as a public service the highway and water department will be sending notices to property owners whose improvements extend onto the town right of way. These are not to be construed as neither criticism nor permission, but to alert owners to the possibility that lawns, fences and shrubbery may be disrupted in the course of municipal improvements such as water and sewer installations. The meeting was declared open to the public. Mary Lou Quinn asked when the street signs are going to be replaced on June Drive and Carlton Court. Mr. Solomon stated that the roads have not been turned back to the Town as yet and as soon as they were the signs would be located and replaced. Councilman Austin asked the board to consider a study of self- service gasoline stations. Some municipal safety regulations may be advisable. On motion the meeting was adjourned at 8:42 P.M. Respectfully submitted, Donald A. Chase Town Clerk 182 RESOLUTION TO ATTEMPT TO REMEDY THE TRAFFIC SITUATION AT STORYTOWN, USA, AND GURNEY LANE. RESOLUTION NO. 171 , introduced by Mr. Austin, who moved its adoption, seconded by Mr. Demboski. WHEREAS, the traffic signal at the intersection of Route 9 and the Story- Town,USA, entrances and exits operates in such a manner as to inhibit the normal flow of traffic on Route 9, a through highway, resulting in long back-ups of vehicles at many times during the summer season; and WHEREAS, the lack of a traffic signal at the intersection of Route 9, Gurney Lane and the Warren County Municipal Center entrances and exits inhibits the normal and -regular flow of traffic to and from the Adirondack Northway, Interstate 87, to and from the Warren County Municipal Center and Route 9 , resulting in long back-ups of vehicles at many times throughout the year; and WHEREAS, the aforementioned situations result in public safety dangers to the Town of Queensbury and to the public generally; now, therefore, be it RESOLVED, that the State Department of Transportation be and hereby is requested to study the traffic problems at the aforesaid intersections and take the necessary steps to remedy same. The following visitors were greeted by the Supervisor: Kip Grant Ed Waters Florence Mcllvaine At the opening of the meeting the Supervisor acknowledged receipt of a request from several residents of Barber Ave. asking to be included in the Sewer District. He said it was one of several requests that cannot be acted upon until the District receives State approval. Supervisor Solomon presented to the Board a Mobile Home Application from Regal Realty for a one year permit to locate a Mobile Home on the site during the construction of the Regal Apartments. This trailer would be used by a watchman to provide on-site surveillance. RESOLUTION TO AUTHORIZE ONE YEAR PERMIT FOR MOBILE HOME RESOLUTION NO. 177, introduced by Mr. Robertson who moved its adoption seconded by Mr. Robillard. WHEREAS, Regal Realty of Merrimack, New Hampshire has made application in accordance with paragraph 2 (b) Section 4 of an ordinance of the Town of Queensbury entitled : ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY NEW YORK to locate a mobile home outside of a duly licensed mobile home court at property situated at Meadowbrook and Cronin Road and
