I am writing you with regards to my review of the Area Variance application that you
have submitted relative the above-referenced property.
As I understand your project, you are seeping to demolish the existing home on the
property and construct a new single-family dwelling. I have reviewed your submittal and
confirm that both ars Area Variance and Site Plan Review are needed prior to the issuance
of a building permit for the work, Specifically, an Area Variance is required as the
proposed structure does not meet the minimum setback requirements of the Waterfront
Residential; (WR) distrhn. Additional variances may be required once all outstanding
infornnation has been submitted to and reviewed by this office. Site Plan Review is
needed for the construction of the home in an area that is within 50 feet of 15% or greater
slopes.
Based upon my review, I note the followu' ig concerns with your submittal:
• Page 3, Question 6 notes the total project land disturbance to be greaten than the
area of the parcel. This is not possible, please revise.
• Page 3, Floor Area Ratio, (FAR) calculations; the proposed floor area listed does
not appear accurately to reflect all flooxs, porehes, and entry areas as shown on
the submitted floor plans. Also, I note the absence of a foundationlbasernent plan.
If there are any basement areas with greater than 5 ft. of head height, the same
will need to be added to this FAR calculation.
* Site drawings; I note the absence of any existing or proposed grading, stormwater

Submitted for your distribution and review are 15 sets of the applicable Area Variance and Site Plan
Review application documents for the referenced project located on Rt. 9L. The subject property
consists of a lawful nonconforming single family residence (side yard setback). The proposed project
involves the removal of the existing residence and replacement with a new single family residence .
We will be seeking an area variance for the side yard setbacks for the new residence as well as a
slight decrease in site permeability. All required application documents including site plans,
architectural plans, AV application, deed, survey and application fee have been compiled in the AV
package.
A wavier from Area Variance submittal requirements for non-residential item (square footage building
use breakdown, signage, lighting, etc). info is herein requested.
Site Plan Review will be required as development will involve development within 50' of 15%slope

Our family fell.in love with this cabin so in July of 2017 we purchased It. Aft.er have spent time we
have come to the realfaation ft is not the "dream cabin". We kneW we had to do some upgrades but
after our fiat time lighting the fire place acrd smelling more than just the wood that was put In the
fire place we actually had set the house an fire. The fire place has no fire walls and once we rernoved
the facing it had looks Ake the house had been set on fire before (see enclosed pictures). We had a local
fire place company to come in and get recommendations to repair and his words were tear it down, it
will not meet any codes and ha would not touch it. The fire place also has'nd foundation. We also had
to remove the ceffing which was a mice haven and discovered the ceiling and 2Rdfl00r is not properly
supported. Ali the Insulation in ceiling and waI[t is infested with mice debris. We also discovered that
the house is built on anclent piers and tree stu raps and the kitchen foundation is built on dirt which
Is now rotted and we have discovered mold. Our existing-septic is on the south side neighbor's
property which a have addressed In the approved septic plan.
So, after many conversations with farnily, neighbors and Building Department we have decided that the
cabin is not safe for our famllyand we.need to demo the existing'dream"cabin and build a new house
that A1.1 meet the new building codes and be ascetically pleasi ng to the neighborhood.
So in cgncfusion we are asking to buiId a new l family home arid obtain variance for setbacks and
permeability which would. include removing existing cabin which.fs presently 5'from south side at
property lines and build new structure that would be centered on property and would be 17'from
north and 17'south side of property limes. a would also be compfeting the new approved septic
system and move the tanks to meet the building code requirements.
