1971-11-11 225 Regular Meeting November 11, 1971 Present : Gerald B. Solomon Supervisor Lloyd Demboski Councilman John Austin, Jr. Councilman Harold Robillard Councilman Harold Katz Town Counsel The meeting was opened with a salute to the flag. Cornwall Francis Dowd The public hearing on the formation of a West Queensbury Water District was declared open at 8:05 P.M. The estimated cost to be $1,060,000. The action is subject to approval of the Department of Audit and Control and to the construction of a Hudson River filtration plant as a source of supply. Joseph Kestner Jr. was introduced by Mr. Solomon and through maps and charts he described the facilities. here will be 9.2 miles of water mains, 520 individual water services 60 fire hydrants. Construction would be financed by a 30 year bond issue, the first year cost is estimated at $20.00 per thousand of assessed valuation for construction in the district, $10;00 per thousand for the master water supply district including the filtration plant, and metered water charges of from $20.00 to $40.00 per year for the average home. A home owner with an assessment of $2500 would thus pay about $100 per year. Every home in the district would be within 600 feet of a hydrant and would qualify for "protected rates". Mr. Solomon stated that Mr. Kestner' s estimates were very conservative. He pointed to the experience in South Queensbury where the tax rate was also projected to be $20 and that the actual tax levy was $17.98. Answering questions he said j--�nstruction in the district and the building of the filtration plant would oceed simultaneously. The system would be operational by June 1973. __, s,Costs within the district would decrease as the assessment grows. An annual gain of $100,000 termed very modest would lower the $20 figure to $15 at the end of ten years and to less than$6 at the end of 30 years. Warren County Fire Coordinator Les Hillis asked why all of West Mountain Road was not included. Mr. Kestner and Mr. Solomon replied that development was too sparse to make it feasible. The district can be extended when development warrants. Pliney Tucker asked for an estimate on the cost of bringing service from the property line to the house. Mr. Kestner replied not more than $3 to $4 a foot. Robillard, seconded by Mr. Austin and passed: WHEREAS , a map, plan and report relating to the estab- lishment of the proposed West Oueensbury Water District prepared by Joseph Kestner, Jr. , Consulting Engineer, of Troy, New York, . duly" licensed by the State of New York, in the manner and con- -' taining such detail as has been determined by the Town Board of the Town ;©f Queensbury, has •been duly filed with %the Town Clerk ix .k k + j t .a#. v of the Town of queensbury in accordance with the requirements of Article 12-A of the Town Law; and WHEREAS , an Order was duly adopted by the Town Board of the Town of queensbury on the 21st day of October, 1971, reciting the filing of said map, plan and report, the improvements proposed, the boundaries of the proposed district, the estimated expense thereof, the proposed method of financing, the fact that the map, plan, and report describing the same , are on file in the Town Clerk's Office for public inspection, and stating all other matters required by law to be stated, and specifying the 11th day of November, 1971 at 8:00 P.M. on that day, as the time and the Town Office Building in the Town of que ensbury as the place where the said Town Board would meet to consider the said map, plan and report, and to hear all persons interested in the subjedt thereof, '--r concerning the same , and to take such action thereon that is required or authorized by law; and WHEREAS , such order was duly published and posted as required' by law; and WHEREAS , a hearing was duly held by said Town Board on the 11th day of November, 1971 beginning at 8:00 P.M. at the Town Office Building of the Town of queensbury, New York, and full discussion of the matter having been had, and all persons desiring to be heard having been duly heard, now, upon the evidence given at such hearing, it is RESOLVED, AND DETERMINED: A. Than all -property and property owners within the --- proposed district are benefited thereby. C. . That all the property and property owners -benefited are included within the limits of the proposed district. D. That it is in the public interest to establish said water district, and be it further RESOLVED AND DETERMINED, that the establishment of the • water district as set forth in said map, plan and report be approved; that the improvements therein mentioned be constructed and the necessary easements and lands 'be acquired, upon the required funds being made available and provided therefor; and such district shall be known and designated as "WEST QUEENSBURY WATER DISTRICT in the Town of Queensbury, and shall be bounded and described as set forth in Schedule A attached hereto and made a part hereof, and be it further RESOLVED, that the proposed improvements , including the construction costs , cost of acquisition of lands and easements , legal and engineering fees , and all other expenses , be financed by the issuance of serial bonds of said Town to mature in such number of annual installments not exceeding forty (40) , as may hereafter be determined by the Town Board of the Town of Queens- bury, payable in the first instance from assessments levied upon benefited real property in said district; and be it further a RESOLVED, that this resolution shall ;be subject to a -3- J + s ' , 7 t, referendum as provided .in Section 209-E of the Town Law; and be it further RESOLVED, that Harold W. RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 225, introduced by Mr. Austin who moved its adoption seconded by Mr. Demboski. WHEREAS, Carl Covell of Haviland Road has made application in accordance with paragraph 2(c) Section 4 of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licenseab mobile home court at property situated at Haviland Road and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on December 2, 1971 at 8 :00 P.M. in the Queensbury Town Office Building, Bay Road and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. WHEREAS, Francis Dowd of Ohio Ave has made application in accordance with paragraph 2(c) Section 4 of an ordinance of the Town of Queensbury entitled: ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK to locate a mobile home outsidd of a duly licensed mobile home court at property situated on Indiana Ave. and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance the town board shall conduct a public hearing on said application on December 2, 1971 at 8:00 P .M. in the Queensbury Town Office Building, Bay Road and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing' in accordance with the provisions of said ordinance. RESOLUTION TO DISAPPROVE APPLICATION FOR MOBILE HOME RESOLUTION NO. 228, introduced by Mr. Robillard who moved its adoption seconded by Mr. Solomon. WHEREAS, Gilbert Fairchild of Gansevoort has made application to this board for a permit to locate a mobile home at property situated on Big Bay Road and owned by Carl Hamell and WHEREAS, upon proper investigation it appears that the applicant has complied with all the requirements of the ordinance regulations relating .. to Mobile homes in the Town of Queensbury, therefore be it RESOLVED, that there was no hardship shown on the original application therefore be it further RESOLVED, that the application of Gilbert Fairchild be and is hereby disapproved and that the Town Clerk is 'hereby directed to notify him of the decision of thie Board. RESOLUTION TO APPROPRIATE SURPLUS FUNDS IN HIGHWAY ACCOUNT RESOLUTION NO. 229, introduced by Mr. Demboski who moved its adoption seconded by Mr. Austin. WHEREAS, there remains surplus funds and unexpended balances in Item I of the Highway Account in the amount of $20,812.30, therefore be it RESOLVED, that the sum of $5,000.00 be appropriated to DR5110.1, the sum of $571.11 be appropriated to DR9030.8, the balance of $15,241.19to be appropriated to DR 5110.4 thereby changing the appropriations as follows: . DR 5110.1 from $74,000.00 to $79,000.00 DR 5110.4 from 50,500.00 to $65,741.19 DR 9030.8 from 3,552.00 to 4,123.11, and also be it further RESOLVED, that the sum of $600.00 be transferred from Item IV DS5140.1 to DS5140.4, thereby decreasing DS5140.1 from $600.00 to $.00 and increasing DS5140.4 from $400.00 to $1000.00. ,,.. RESOLUTION TO NAME MEMBER TO THE BOARD OF CEMETERY COMMISSION RESOLUTION NO. 230, introduced by Mr. Austin who moved its adoption seconded by Mr. Demboski. WHEREAS, Chapter 814 of the laws of 1948 provides that there shall be a Board of Cemetery Commissions of the Town of Queensbury to consist of three members appointed by the Town Board for three year terms to expire on June 30 of each year and 229 WHEREAS, it appears from the records of the Town Clerk that Joseph Regan was last appointed by the Town Board for a term which expires on June 30, 1972 and WHEREAS, the Town Board has received the resignation of Joseph Regan with regrets which is effective immediately, therefore be it RESOLVED, that the Rev. Roger U. Day be and he hereby is appointed a member of the Board od Cemetery Commissions of the Town of Queensbury to fill the unexpired term which ends on June 30, 1972. RESOLVED that the Audit of Bills as listed on Abstract 71-11 numbered 2144 through 2316 totaling $45,478.01 is hereby Duly adopted by the following vote: approved.
