PUBLIC HEARING- CONSOLIDATION WEST QUEENSBURY AND CAREY ROAD

MR. SALVADOR-Has the Town received any written submissions for this public hearing to this
date?
SUPERVISOR STROUGH-Not that I am aware of.
MR. SALVADOR-My comments this evening are further to my letter of January 26th, directed to
this Board as well as Mr. Chris Harrington. Wherein, I expressed my concerns for effectuating a
consolidation of the West Queensbury Sewer District with that of the Carey Road Sanitary Sewer
District as early as April 1, 2018. The reasons being there was a great dissimilarity between the
processing scheme for each of these two districts. The West Glens Falls District is a gravity flow
system not involving any pump stations. The Carey Road Sewer District is a low flow force main
type of system involving forty five onsite individual pump stations. The estimated costs of these
pumps stations the Carey Road Sewer District could be as high as twenty thousand dollars
capital investment costs for each of the property owners when you consider the necessity to have
the emergency power generator. In addition to that there are maintenance costs, operating costs
for this onsite pump station. The participants of the West Glens Falls system do not have this
burden. The design and permitting process of the Carey Road Sewer District as of this date is
incomplete. We don't know what the final cost of the project is going to be. Everything in this
consolidation agreement is based on estimates for the Carey Road Sewer District. We don't
know the relationship between the completion of the Carey Road Sewer District and the levying
of the benefit tax for that district. The Agreement, paragraph g, page 3 of the Agreement shows
the reasoning for the ability to combine those two sewer systems. They list the unit cost for the
Carey Road Sewer District as compared to the unit cost for the West Glens Falls District as being
somewhat the same. They have done this by taking the actual cost, the cost we know in the West
Glens Falls District since the district was up and operating fully installed. I have applied
estimated costs for the Carey Road Sewer District. In doing so they have predicated the whole
comparison on the basis of the existing uses of the land. Whereby there are a total of eleven
hundred thirty nine benefit units in that district. When you run the math they get a possible
hundred and forty five dollars as compared to a hundred and fifty one for West Glens Falls and
the average the two to come up with the one hundred and forty seven for the combined. It looks
like a very simple exercise. However, they state in the agreement that the West Glens Falls
Benefit Unit could be reduced marketability in the future if the project is built out as estimated.
When built out there will be twenty three hundred ninety nine benefit units, running the math
there the benefit unit tax would only be seventy five dollars. When you average the seventy five
dollars with a hundred and forty five of the West Glens Falls you come up with a hundred and
ten dollar average. This means that all the participants in the combined consolidated district
would then be levied a hundred and ten dollars per unit. This would work to benefit a great deal
the West Glens Falls people to the determent of those in the Carey Road Sewer District. Without
consolidation the Carey Road people would only pay seventy five dollars a unit, whereas after
consolidation they would pay a hundred and ten. This is in addition to the fact that the people in
the Carey Road Sewer District have to bear the cost the capital cost of their pump station, which
could run to twenty thousand dollars including emergency power generator. I just don't know if
the participants in that district are fully aware of what this consolidation would amount to. They
could benefit very highly from the buildout whereas if it is consolidated they will not receive the
corresponding benefit.

TRAVIS WHITEHEAD, QUEENSBURY-A couple minutes ago Mr. Strough mentioned that we
have an established district in the Carey Road District. It might be established on paper. I am
making sure of that because last time I looked DEC had not signed off on it. That waste is going

to a sewer plant that is under a consent order for the DEC for not being able to handle discharges
so I am making sure that is established. I know over the last year you have been working
steadily to get in one piece after another to get this to the point for on paper it's approved. This
is the very first time that I can recall over the past year when they set this hearing that the idea of
consolidating this district with another district was ever mentioned. I wonder why over the past
year this hadn't been mentioned. It seems to me like it is a significant event. My problem here
is more with the process. In that if you had some ideas that this was going to happen it should
have been stated a year ago as we were talking and as we were trying to go forward. But, it was
not so today it is thrown out there. I don't really know how it could benefit anybody in West
Glens Falls. They've already retired about two thirds of their debt. Why should they see brand
new debt from an area across the way thrown at them? I don't know. I can suspect some of the
problems are that this new district is not very well established in the fact that the people the
businesses, etc. it is largely vacant land. Trying to assess vacant land for an improvement is a
real problem. You can't go ahead and assess somebody if it's vacant land. This is a very short
time for payback on the debt, fifteen years. West Glens Falls was considerably longer...they end
about the same time, I'm not sure if it helps anybody. If I were an owner there I would sit on
that property that vacant property for fifteen years so I wouldn't have to pay these benefits taxes.
I would have to pay a small amount, but they are vacant lands a very small amount compared
to... I would gain the benefit by letting it sit there. Wait it out. Make my profit. I think a lot of
these people are speculating on waiting it out there. The benefit tax I would question it just
doesn't apply it doesn't make sense. If you look at some of the assessments there are two
different tables in the Map, Plan, and Report that would give an estimate. They are both
estimates of what individuals would be paying. You've got one guy there with twenty two acres
of land you have some billboards out front. One residential property on it and he is going to be
paying four thousand dollars a year. You have another adjoining property, which is commercial,
but it is maybe a five acre footprint on a thirty three acre lot. He will be paying more than ten
times that amount for fifteen years. The difference is perhaps five hundred thousand dollars over
that fifteen years. I am not sure you are doing anything to help development by doing this. I
have a question. I did send a question out earlier and I did not hear back. Actually, I heard back
from Teri Ross and she said while it might sounds like it's a question for her it was not. It had to
deal with the benefit assessments and she said that would be Chris Harrington. He is in the back
of the room so I am assuming that he is going to come up and answer some of these questions
afterwards. The question, I put out to Teri and to him the other day was why the big difference
between residential and commercial on properties that is basically largely underdeveloped.
There are even things in here that don't make sense. You get charged more per acre as the lot
gets larger. You would think you would get a discount maybe after so many acres. In fact the
rate goes up by fifty percent after ten acres on commercial property. That is one reason why the
thirty three acre unit the one that had been owned by Native Textiles and has been recently sold
to Angio Dynamics and some others. I'm not sure...it went to some holding company who is
leasing it out to various people. The way it is set up now they are going to be paying a
tremendous amount of money compared to a lot of their neighbors and I am not sure exactly
why. To wind this back up I just want to get back to the beginning and basically ask the
question. Is why do we have here was not this mentioned this idea of consolidation mentioned? I
think this would have been relevant. I think it would have been relevant maybe to the series of
steps that you took to get this place here. This is not the time to be throwing it people. Thank

WHEREAS, New York General Municipal Law Article 17-A authorizes water and sewer
districts to consolidate into combined districts if such combination "shall be conducive to the public
health, welfare, and convenience and be of special benefit to the lands of the district," and
WHEREAS, the West Queensbury Sanitary Sewer District ("West Queensbury District")
was duly established by the Queensbury Town Board ("Town Board") in 2011 to serve the West
Queensbury area from the City of Glens Falls line at Western and Thomas Streets to the area just
past Exit 18 of the Adirondack Northway(I-87) on Corinth Road, and
WHEREAS, the Carey Road Sanitary Sewer District ("Carey Road District") was duly
established by the Town Board in 2016 to serve the Carey Industrial Park and adjacent properties
along Corinth Road, Carey Road, Silver Circle, Big Bay Road and Big Boom Road, and connect to
the West Queensbury District at two locations, but the improvements have not yet been constructed,
and
WHEREAS, potential environmental impacts of the West Queensbury District and the
Carey Road District were subject to review pursuant to the State Environmental Quality Review
Act (SEQRA) at the time each of the Districts was established, and
WHEREAS, the Queensbury Town Board is the body responsible for the administration of
all its sewer districts, including the West Queensbury District and the Carey Road District, and
WHEREAS, the Town Wastewater Director studied whether it would be to the mutual
benefit, and in the best interests of the customers each serves, to combine the West Queensbury
District and the Carey Road District into one District, and determined that such a combination
would create greater operating efficiencies, provide better service to the public each serves, and
generate cost savings by avoiding duplication in administrative services, and
WHEREAS, Town Counsel and the Town Wastewater Director prepared a proposed
Consolidation Agreement and provided it to the Town Board for its review, and
WHEREAS, New York General Municipal Law Article 17-A requires the local government
entities to be consolidated to endorse a Consolidation Agreement by adoption of a joint Resolution
to commence consolidation proceedings, and
WHEREAS, the Queensbury Town Board is the governing entity for both of the Districts,
so the statutory requirement for a joint Resolution is satisfied by adoption of a single Resolution by
the Queensbury Town Board on behalf of both Districts, and

WHEREAS, the Town Board adopted Resolution 52,2018 on January 22, 2018 endorsing
the proposed Consolidation Agreement and scheduling a Public Hearing to hear public comments
on the proposed Consolidation Agreement, and
WHEREAS, after providing notice as required by General Municipal Law Article 17-A, the
Town Board conducted a Public Hearing on the proposed Consolidation Agreement on March 5,
2018, and the Town Board has considered the evidence given together with other information, and
WHEREAS, the Town Board wishes to consolidate the West Queensbury District and the
Carey Road District in accordance with General Municipal Law Article 17-A,
NOW, THEREFORE, IT IS HEREBY
RESOLVED:
1. The Town Board hereby determines that consolidation of the West Queensbury District
and the Carey Road District as described in the Consolidation Plan is not an "action" for purposes of
SEQRA review as it does not involve any project or physical activity, planning and policy making
activity or adoption of agency rules, regulations and procedures, that may affect the environment.
2. The Town Board hereby determines that consolidation of the West Queensbury District
and the Carey Road District as described in the Consolidation Plan would be conducive to the public health,
welfare, and convenience and be of special benefit to the lands of the Districts, approves the final
Consolidation Agreement and authorizes the Town Supervisor to execute the Consolidation Agreement in
substantially the form presented at this meeting.
The Town Board authorizes and directs the Town Supervisor, the Town Water Superintendent and the Town
Clerk to take all actions necessary to effectuate this Resolution and the Consolidation Agreement.

Companies (Fire Companies) expired on December 31,2017, and
WHEREAS, in such Agreements the Town and Fire Companies agreed that the terms and provisions
of the existing Agreements may continue during the interim period pending execution of new Agreements
which is anticipated to occur sometime within the next few months of 2018, and
WHEREAS, by Resolution No.: 381,2017, the Town Board authorized payment vouchers
constituting 1/12"' of the respective 2017 Contract Amount(s) for January and February to the Fire
Companies under their current respective Agreements, which payments constituted advance payments on the
new fire protection services 2018 Agreement(s), and
WHEREAS, the Fire Companies may face cash flow shortages before the new Agreements can be
executed and therefore the Town Board wishes to authorize advance payments under the current, respective
Agreement(s), which if new Agreements are entered into will constitute advance payments on the 2018

agreements to the Fire Companies, such advances to be deducted from contract payments to be paid if and
after the 2018 Agreements are ratified,

RESOLVED, that the Queensbury Town Board hereby authorizes the Town Supervisor to approve
payment vouchers constituting 1/12`h of the respective 2017 Contract Amount(s) (not including Vehicle
Fund) during March, April, May and June, if needed, to the North Queensbury and Queensbury Central
Volunteer Fire Companies under the current, respective Agreements,which payments will constitute advance
payments on the new fire protection services 2018 Agreement(s)if such Agreements are entered into, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor and Town
Budget Officer to make the necessary arrangements to make such payments which are authorized under the

Bay Ridge Rescue Squad, Inc., North Queensbury Rescue Squad, Inc., and West Glens Falls Emergency
Squad, Inc., (Squads)in accordance with Agreements between each Squad and the Town, and
WHEREAS,the Town's Agreements with the Squads expired on December 31,2017, and

WHEREAS, in such Agreements the Town and Squads agreed that the terms and provisions of the

Agreement(s) to the Squads, such advances to be deducted from contract payments to be paid after the 2018
Agreements are ratified,

RESOLVED, that the Queensbury Town Board hereby authorizes the Town Supervisor to

the amount of$43,030 in accordance with Solitude's January 1, 2018 through December 31, 2018 Contract,
and
WHEREAS, Solitude has presented the Town Board with a Contract Addendum dated February 21,
2018 for additional services providing for Solitude collecting the riparian and downstream address list for
notification for an additional sum of$900, and
WHEREAS, the Town will continue to adhere to all New York State Law bidding requirements as
well as the terms and conditions of its Contract with Solitude dated January 1, 2018 through December 31,
2018, and
WHEREAS,the Town Board wishes to authorize such Addendum as presented at this meeting,

RESOLVED, that the Queensbury Town Board hereby authorizes the Contract Addendum with
Solitude Lake Management dated February 21, 2018 regarding Solitude's additional services related to the
Aquatic Vegetation Lake Management Program for Glen Lake for the additional amount of$900, and

RESOLVED, that the Town Board authorizes and directs the Town Budget Officer to pay expenses
incurred from appropriations in the Glen Lake Misc. Contractual Account No.: 051-8790-4400 in the
additional amount of$900 and/or take any actions necessary to provide for such payment, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to sign the
Contract Addendum substantially in the form presented at this meeting and/or any other needed

for dog control in the Town.
