WARRANTY DEED WITH LIEN COVENANT
THIS INDENTURE made the 1'6 day of November, Two Thousand Five.
BETWEEN CHRISTINE T. LECCE, residing at1131 Mohegan Road, Niskayuna, New York,
Party of the First Part, and GERARD J. BIELAK and PEGGY ANN BIELAK, his wife,
residing at 15 County Clare Lane, Niskayuna, New York, Parties of the Second Part.
WITNESSETH, that the Party of the First Part, in consideration of One and 001100
($1.00) Dollar, lawful money of the United States, and other good and valuable
consideration, paid by the Parties of the Second Part, does hereby grant and release unto
the Parties of the Second Part, their heirs and assigns forever, All his right, title and
interest in and to that certain lot, piece or parcel of land described in the Attached
Schedule "A".
BEING the same premises conveyed to the Party of the First Part by deed dated July
16, 1998, and recorded in the Warren County Clerk's Office on October 7, 1998, in
Liber 1084 at Page 303.
SUBJECT to any and all covenants, restrictions, easements and agreements of record, if
any.
TOGETHER with the appurtenances, and all the estate and rights of the Party of the
First Part in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the Parties of the
Second Part, their heirs and assigns forever.
AND said Party of the First Part covenant as follows:
FIRST, that the Parties of the Second Part shall quietly enjoy the said premises;
SECOND, that said Party of the First Part will forever Warrant the title to said
premises.
THIRD, That in Compliance with Sec. 13 of the Lien Law, the Grantor will receive
the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and

All that tract or parcel of land situate in the Town of Queensbury, County of Warren and State of New
York, briefly described as follows:
Beginning at the northerly comer of lot of land owned by Sherman and located on the westerly side of
Warner Bay and running northerly in a straight line along waters edge of said Bay forty feet for a comer,
thence in a westerly direction in a straight line parallel with the line between the Sherman and Hall
property to the private road; thence in a southerly direction along said private road to the northwesterly
corner of lot of land owned by Sherman for a comer, thence along the northerly line of said Sherman lot to
the water's edge mark, the point of beginning.
Also all the following described property:
Parcel "A"
All that certain piece, parcel or lot of land situated, lying and being in the Town of Queensbury, County of
Warren and State of New York on the East shore of Grassy point(sometimes called Ripley's Point) on
Lake George, and on the West side of Van Wormers Bay and being a part of Lot No. 42 in French
Mountain tract and bounded and described as follows:
Beginning at a cross mark on a rock on the lake shore at the southeasterly comer of premises purchased by
Dudley M. Hail of Danfort J. Brayton and others, it being the southeast corner of the southerly lot
purchased of said Brayton and others, thence South 86 deg. West 244 feet to an iron pipe driven in the
ground for a corner; thence North 24 deg. 30 min. West 50 feet; thence Easterly in a straight line to a
point on the lake shore at a cross mark on a rock 100 feet northerly of the place of beginning; thence .
Southerly along the lake shore as it winds and turns to the place of beginning,together with a right of way
extending along the back side of said lot to the public highway leading to Glens Falls in and over lands of
the said Danfort J. Brayton and others. Also a lot immediately to the West of the one just described and
bounded as follows: Beginning at the southwest comer of the aforesaid lot of land and running in a
westerly direction 124 feet to an iron stake which now forms J.E.L. Beals northwest comer; thence
running in a Northerly direction 50 feet to an iron stake; thence running in an Easterly direction 111 feet;
thence nmning in a Southerly direction 50 feet to the place of beginning.
Parcel "B"
A strip of land bounded and described as follows: Being in the Town of Queensbury, County of Warren
and State of New York on what was formerly called Grassy Point, now called Ripley's Point on the shore
of Lake George,beginning at a cross mark on a rock on'the lake shore which marks the boundary between
the southeast corner of the lands of Dudley M. Hall and the northeast comer of John Sherinan's lot and
running westerly along the said Sherman's Lot to the road which divides said Hall's land, said road marking
the western boundary of Sherman's land, thence northerly along the eastern edge of said road four feet,
thence easterly in a straight line to the place of beginning, describing a wedge shape strip of land four feet
wide at one end and running to a point at the other end, said strip of land being somewhat wider near the
middle as the present line between Hall and Sherman is not a straight line,the object being to convey this
strip from Fall to Sherman and to straighten the boundary line. .

A more modem description of said premises as follows:
All that certain parcel of land situate in the Town of Queensbury, Warren County,N.Y. located on the
westerly shore of Van Wormer Bay-Lake George and on the easterly side of Seeley Road approximately
1000 feet southerly of Rockhurst Road in said Town and which parcel is bounded and described as
follows:
Beginning at an iron pipe set in the east line of Seeley Road and at the southwest comer of a 10 foot wide
strip of land running easterly from Seeley Road to the shore of Van Wormer Bay; running thence North 81
deg. 12 min. 15 sec. East along the southerly line of said 10 foot strip, which is owned by James and
Nancy White and also running along the northerly line of those premises conveyed by Delia B. Hall to
William C. Sherman by Deed dated October 19, 1944 and recorded in the Warren County Clerk's Office in
Book 230 of Deeds at Page 212 for a distance of 347.36 feet to a capped iron rod set at the northerly end of
a stone seawall at the shore of said Bay; thence South 06 deg. 14 min. East along said wall and shoreline
for a distance of 40.00 feet to a cross chiseled in rock, marking the southeast comer of said lands conveyed
by Hall to Sherman and which comer also marks the northeast comer of those premises conveyed by
Minnie Sherman to William C. Sherman by Deed dated March 5, 1946 and recorded in Book 236 of deeds
at page 566,being parcel A-1 in said Deed and also being the easterly point of a triangular parcel defined
as Parcel B, in said Deed; thence in a southerly direction along said shore line for a distance of 100.00
feet to the southeast comer of said parcel A-1; thence South 88 deg. 04 min. 30 sec. West, along the
southerly line of said Parcel A-1 for a distance of 2 feet more or less,to a plastic capped iron rod, and
which iron rod is situate at a distance of 99.40 feet, southeasterly on a course of South 21 deg. 05 min. 45
sec. East from the aforementioned cross chiseled in rock; thence continuing South 88 deg. 04 min. 30 sec.
West and along the said southerly line of Parcel A-1 and the southerly line of Parcel A-2, in said Deed and
also along the northerly line of those premises conveyed by Florence H. Beals to Peter B. and Linda B.
Brown by deed dated September 13, 1968 and recorded in Book 499 of Deeds at Page 269 for a distance of
362.54 feet to an iron pipe set in the easterly line of Seeley Road; thence North 12 deg. 57 min. 20 sec.
West along said easterly line for a distance of 93.90 feet to the place of beginning.
The above described is based on a Map entitled "Map of lands of Gertrude C. McCoy and Henry Carpenter
McCoy" dated October 6, 1972 revised March 3 and August 26, 1993 and again on June 7, 1994 to show
source of title to William C. Sherman. Said map and the above description having been made and certified
to by Andrew T. McCormack PLS d/b/a Coulter and McCormack, Licensed Land Surveyors, Glens Falls,
N.Y. and which map is to be filed in the Warren County Clerk's Office.
