213.2016 Bay Ridge Rescue - Authorize Coverage of NQ EMS District - 6-13-16 RESOLUTION AUTHORIZING BAY RIDGE RESCUE SQUAD, INC. TO COVER ALL EMERGENCY CALLS WITHIN NORTH QUEENSBURY EMERGENCY SQUAD, INC.'S CONTRACTED DISTRICT ON A TEMPORARY BASIS RESOLUTION NO.: 213,2016 INTRODUCED BY: Mr.William VanNess WHO MOVED FOR ITS ADOPTION SECONDED BY: Mr. Brian Clements WHEREAS, in accordance with Town Law §184, the Queensbury Town Board (Town) may contract with ambulance services certified or registered in accordance with Public Health Law Article 30 for general emergency ambulance service within the Town, and WHEREAS, by Resolution No.: 5, 2015, the Town authorized an Agreement for emergency protection services with the North Queensbury Emergency Squad, Inc., (North Queensbury)for 2015 - 2017, and WHEREAS, by Resolution No.: 39, 2016, the Town authorized an Agreement for emergency protection services with the Bay Ridge Rescue Squad, Inc., (Bay Ridge)for 2016-2017, and WHEREAS, both such Agreements for emergency protection services set forth a number of terms and conditions, including a condition that if the Emergency/Rescue Squad shall fail to respond to any alarm and fulfill and perform its duties and obligations at any time during the duration of this Agreement for a period of 30 days and without a reasonable explanation, or at any time notifies the Town that it does not intend to perform its duties for any period of time, then the Town may allot and pay to one or more of the other emergency squads located in the Town for furnishing ambulance service to the Town, all or any part of the monies due or to become due under this Agreement for the period for which such service is to be rendered, and WHEREAS, the Town Board has been notified that North Queensbury's future viability to provide emergency services to its designated service area and respond to mutual aid calls is in jeopardy due to North Queensbury's loss of its ability to provide Advanced Life Support (ALS) services at all times in accordance with the requirements of the Mountain Lakes Regional EMS Council (Mountain Lakes), and WHEREAS, it is the Town's responsibility to assure that it contracts with a viable entity capable of providing those emergency services to all of its residents, including those within North Queensbury's normal area of coverage, and WHEREAS, Bay Ridge has the ability to provide emergency services to North Queensbury's contracted service area and has expressed its desire to provide such services as long as the Town enables it to do so by providing the needed financial support, and WHEREAS, the Town Board agrees that there is a need to authorize Bay Ridge to cover the emergency calls in the service area which is North Queensbury's normal area of coverage on all shifts and such arrangement will benefit Town residents and visitors to both Squad's service areas, and therefore it is necessary and in the public interest to act on such proposal to assure the continued and uninterrupted provision of emergency services to the Town, and WHEREAS, providing coverage to such area is important to the Town Board and to Town residents and North Queensbury's inability to provide such coverage constitutes an emergency that the Town Board wants to respond to promptly, and WHEREAS, the Town Board will hold a public hearing on a later date to formally amend the Agreement after it determines whether this will only be for short-term emergency coverage or whether longer-term coverage will be required, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby authorizes and approves of the Bay Ridge Rescue Squad, Inc., covering the emergency calls in the North Queensbury Rescue Squad, Inc.'s normal area of emergency coverage on all shifts due to North Queensbury's temporary loss of certification to provide ALS services, until such time that North Queensbury is able to reobtain its ALS certification, and BE IT FURTHER, RESOLVED, that the Queensbury Town Board hereby authorizes and directs the Town Budget Officer to transfer funds, amend the Town Budget and take all actions necessary to provide for payment to Bay Ridge relating to such arrangement for two months of emergency coverage for this area,not to exceed$56,000, and BE IT FURTHER, RESOLVED, that the Town shall pay Bay Ridge for the costs which shall be paid on the same procedures as detailed in the Agreement dated as of January 1, 2016 between the Town and Bay Ridge, and BE IT FURTHER, RESOLVED, that the Town Board shall decrease the amounts paid to North Queensbury as detailed in its Agreement due to its inability to provide emergency coverage, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to sign any needed agreement or documentation in form acceptable to the Town Supervisor and Town Counsel and the Town Supervisor, Town Counsel and/or Budget Officer to take all actions necessary to effectuate all terms of this Resolution.
