The public was asked if anyone cared to speak in favor of or against the granting of the permit. No one spoke. The public hearing was closed at 8:03 P.M. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION No, 93, Introduced by Mr. Robillard, who moved its adoption, seconded by Mr. Austin. WHEREAS, Alfred E. and Lillian Wells of R.D. #1, Waterford, New York, have made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled; ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN. COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property located at 1.5 miles from Corinth Road on east side of Big Boom Road, Town of Queensbury, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: There were no persons in appearance in opposition to the granting of the permit. Noes: None Regarding the mobile home application of Eileen Thorpe, Councilman Austin stated that they had visited the site and because the appli- cation as stated does not correspond with the actual physical situation at the site he would recommend disapproval of the application. Council- man Robillard noted that the trailer was to be moved by May 1st. 4©6 RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION No. 95, Introduced by Mr. Robillard, seconded by Mr. Robertson. WHEREAS, Eileen Thorpe of Sunset Avenue, Town of Queensbury, New York, has made application to this Board for a permit to locate a Mobile Home at property situated at Sunset Avenue, Town of Queens- bury, New York, and owned by Carleton Fox, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Regulations relating to Mobile Homes in the Town of Queensbury, therefore be it RESOLVED, that the application as stated did not correspond with the actual physical situation at the site, therefore be it further RESOLVED, that the application of Eileen Thorpe be and is hereby disapproved and that the Town Clerk is hereby directed to notify Eileen- Thorpe of the decision of this Board. RESOLUTION No, 97, Introduced by Mr. Austin, who moved its adoption, seconded by Mr. Demboski. WHEREAS, the use of land for gasoline filling stations or garages for five or more motor vehicles has nuisance characteristics and is potentially harmful, and WHEREAS, the Town of Queensbury has duly adopted a Zoning Ordinance that includes- provision for issuance by the Board of Appeals of special use permits for such garages and filling stations under certain specified conditions, and WHEREAS, consent of a certain percentage of the landowners within a specified distance of the site of such proposed uses is not now a condition for issuance of such permits, and WHEREAS, the establishment of such consent as a condition precedent to the issuance of such permits has been upheld by the courts of this State and has been recommended by the Planning Board of this Town, and WHEREAS, a public hearing has been held on said question after due notice, pursuant to Section 265 of the Town Law and Section 11.100 of said Zoning Ordinance, now THEREFORE, BE IT RESOLVED that Section 5.505 (b) of said Zoning Ordinance is amended to read as follows: b. Garages and Filling Stations. In a C-1, C-2 or C-3 District or in an M-1 or M-2 Manufacturing District, plans for the erection or structural alternation of any garage for more than five motor vehicles, or of a filling station may be approved by the Board of Appeals, only when said plans are accompanied by the written consent of sixty (60) _ per cent or more in number of the owners and mortgagees of all property within three hundred (300) feet of any portion of the lot or plot on which said garage or filling station is, or is proposed to be, located. Said Board may require such change therein in relation to yards, locations of pumps and buildings, and construction of buildings to mini- mize traffic difficulties and to safeguard adjacent properties. Duly adopted this 9th day of April, 1970, by the following vote: Ayes: Mr. Demboski, Mr. Austin, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes: None The public hearing was declared open at 8:30 P.M. on an amendment to the Zoning Ordinance regarding granting special permits for gasoline filling stations or large garages in commercial: and manu- facturing districts. Mr. Austin explained this amendment would require written consent of sixty per cent of the property owners or mortgagees within 300 feet of the proposed location of a filling station or garage. Councilman Austin asked that the Town Clerk personally serve the amended ordinance upon any corporation or individual- with an application outstanding. He noted that without such personal service the change would not be in effect for 10 days. No one wished to speak in favor of or against the amendment from the public audience. The hearing was declared closed at 8:35 P.M, Resolution No. 97 was adopted as stated prior. The Activity Report of the Queensbury Police Department for the month of March 1970 was placed on file. The Highway Report for the Month of March 1970 was submitted by the Supervisor and placed on file. The Settlement of Water Rents was submitted by Betty Eggleston, Receiver of Taxes and Assessment, and placed on file. The Activity Report of the Town Clerk's Office for the month of March was placed on file. The Monthly Statement of Supervisor for March 1970 was placed on file. It showed total receipts of $50,085.43 and total disbursements of $115,701.21 Supervisor Solomon stated that he had been informed by the Civil Service Bureau that Gilbert Schlierer had passed the examination for police chief with a mark of 80%. It was stated that the examination was very diffi- cult and only two persons passed the exam. Councilman Robillard said the Town was fortunate to have a man of Chief Schlierer' s calibre heading the department and said he had done an outstanding job in the short time he had served. He said he. expected that a cooperative application from the two municipalities and Warren County would be made for a federal grant. Councilman Robillard brought up the problem of litter on Luzerne Road. He said individuals going to the dump, rather than truckers, appeared to be responsible and added that the city land fill opera- tion is within 75 feet of Luzerne Road now. Supervisor Solomon urged public cooperation in tracing litter dumpers and gave assur- ance that the town police would pursue complaints.
