52 Veranda Lane thereafter, "the Property'} is a 1.64 acre parcel irnprovcd by a single family
dwelling and a storage shed. The Property is located in aft MDR wriing district and is at the end
of a dead-end road_
Projeci Summary
The project involves the installation of a 566 square foot in-ground swimming pool in the side
(south) yard. Section 179-5020 (C) ( ) of the Town of Quftnsbury Zoning Code provides in
part, "[p]ools may be erected only in the rear yard _ , , ." Due to placement of the home and the
topography of the Property,placement of the pool in the rear yard is impracticable.
Veranda Lane rums east-west and dead-ends at the front(east) yard of the Property. The drive
way loops around through the north/side yard. While there is over 135 f6et from the rear of the
house to the western lot line, it encompasses significant grade changes (West Fountain).
Accordingly, the only practical location for the pool is on the south/side yard which covers over
92 Feet from the side of the house to the southern, lot line,
The Property has three direct neighbors. The lot to the south consists of IN umimproved acres
and is currently owned by the Irvine Applicants, The lot to.the east is across the suet and is
significantly down grade from the Property. The lot to the nodhleast is also across the street and
down grade from the Property. The proposed location of the pool would only have an impact on
one neighbor, the property to the east(lot . "rhe impact to this neighbor will be reduced by the
difference in natural grade, the fact that the pool is in-ground as well as the fencing and
landscaping requirements.
Requesi or Waiver
The area variance application materials require a current property survey. Due to the nature of
the project and the type of variance being requested along with the fact that a pre-existing survey
and property condition map has been provided, the applicants respectfully request a waiver from
this rf quiremerrt.
