Mr. Dwyer purchased these parcels, Tax Map Parcel 289.4-65 and 69.11, with his father in 2012. Tax Map Parcel 288.4-65 is located along West Mountain Road and is where both structures are located, The parcel is 1.39 acres in size. Tax Map Parcel 288.-1-69.11 is a vacant 1.9 acre parcel, immediately adjacent to parcel 288.4-65, but it does not have roars frontage. The structures were both existing at the time of purchase. However, the one structure was classified as a boat storage facility when constructed in 1999, but at same point in time was converted to an apartment. Both units have public water and private septic systems. The Applicant is in the process of selling the property and was not aware until recently that the second dwelling required relief from the Town o I'Q ueensbury Zoning Code. The Applicant has maintained the property with I-aultiple.dwellings since its ownership in 2012. Although this would be considered an after the fact variance, it will result in no physical changes since the uses have been in existence for some time. To maintain two dwelling units in the N4DR Zone with public water and private septic require 4 acres. Although these two structuirs are located on the tax map parcel 288.-1-65, the Applicant is willing to merge the two parcels together to lessen the relief requested, since combined the total size will be 3.2.9 acres. With this merger, the relief being sought should not be considered substantial. Although modifying the boundaries of the parcels and keeping each structure on its own parcel was considered an option, it required even more relief than the application being sought.
