WHEREAS, the fact has became evident that repairs are needed in the Storm Sewer System on Fort Amherst Road, and WHEREAS, the materials for this re-construction have been purchased and are on hand at present, therefore be it RESOLVED, that the Highway Department of the Town of Queensbury will make the necessary repairs to the Storm Sewer System on Fort i Amherst Road at which time as the Highway Department can, accomplish the repairand replacements. Mrs. Theresa Brewster spoke in favor of granting of the permit. There was no persons spoke in opposition. The public hearing was closed at 8:10 p.m. Supervisor Solomon announced the opening of the public hearing on the petition of residnets on Lower Warren Street, Town of Queensbury also Green Street and Brayton Avenue for an extension of the lighting district on those streets. WHEREAS, Teresa Brewster of R.F.D. #2 Lake George, New York, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensburyentitled; ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Route #9, Lake George Road, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: There were no persons in appearance in opposition to the granting of the permit. M. Eastern Standard Time. The meeting was called to order by Supervisor Gerald B. Solomon, and the following were present, namely: Gerald B. Solomon, Supervisor Hammond Robertson, Jr. , Councilman Harold Robillard, Councilman Theodore Turner, Councilman Lloyd Demboski, Councilman The following resolution was moved, seconded and passed: WHEREAS, Resolution No. 179 was duly adopted by the Town Board of the Town of Queensbury on the 15th day of August, 1968, reciting the boundaries of the proposed extention to the South Queensbury Lighting District and specifying the 12th day of September, 1968 at 8:00 P. M. on that day as the time and the Town Office Building of the Town of Queensbury located in Queensbury, New York, as the place where the Town Board would meet to consider and hear �all persons interested in the subject thereof concerning the same; and WHEREAS, such order was duly published and posted as required by law; and WHEREAS, a hearing was duly held by said Town Board on the 12th day of September, 1968, beginning at 8:00 P.M. at the Town Office Building of the Town of Queensbury, at Queensbury, New York, and full discussion of the matter having been had and all persons desiring to be heard having been duly heard; now upon the evidence given at such hearing, it was RESOLVED AND DETERMINED: A. That the notice of hearing was duly published and posted as required by law and is otherwise sufficient. B. That all property and property owners within the proposed district are benefited thereby. C. That all the property and property owners benefited are included within the limits of the proposed district. D. That it is in the public interest to extend said South Queensbury Lighting District; and be it further RESOLVED AND DETERMINED, that the South Queensbury Lighting District be and the same is hereby extended as proposed: that the service therein mentioned be provided for upon the F required funds being made available or provided for; that such district extension shall be designated and known as the South Queensbury Lighting District Extension of the Town of Queensbury -and shall be bounded and described as follows: All that certain piece or parcel of land situate, lying and being in the Town of Queensbury, Warren County, N. Y. , more particularly bounded and described as follows: BEGINNING on the northerly bank or shore of the Hudson River at the southwesterly corner of the present South Queensbury Lighting District, running from thence in a westerly direction along the northerly bank or shore of the same to the southeasterly corner of the City of Glens Falls' thence running in a northerly direction along �8 The easterly bounds of the City of Glens Falls to a point therein 200.00 feet from the southerly bounds of Dix Avenue, measuring at right angles therefrom; thence running in a southeasterly direction, parallel to the southerly bounds of Dix Avenue and 200.00 feet distant therefrom measuring at right angles, to the westerly bounds of the present South Queensbury Lighting District; thence running in a generally southerly direction along the several courses of the present South Queensbury Lighting District to the northerly bank or shore of the Hudson River at the point and place of beginning. Bearings given in the above description are as given in deeds or are as shown on survey maps. And it further appearing that since it is not proposed or required that the cost of such improvement be financed by bonds, notes or other evidence of indebtedness and that, therefore, the permission of the State Department of Audit and Control to create such district is not required; and it is further RESOLVED that this resolution shall be subject to a referendum as provided in Section 209-e. TAX ANTICIPATION NOTE RESOLUTION OF SEPTEMBER 12, 1968 FOR THE ISSUANCE OF A NOTE OF THE TOWN OF QUEENSBURY, NEW YORK, IN THE AMOUNT OF $707.50 IN ANTICIPATION OF THE COLLECTION OF TAXES FOR THE FISCAL YEAR 1969. WHEREAS, in 1967 the Town Board purchased a blueprinting machine from Ray Supply Company, Inc. of Glens Falls, New York for the sum of $707.50, and WHEREAS, provision for the payment of said charge was not made in the current town budget and no funds are available for the payment of said claim, and WHEREAS, demand for payment has been made by said Ray Supply Company, Inc. , now therefore BE IT RESOLVED by the Town Board of the Town of Queensbury, New York, as follows: Section 1. That the Town of Queensbury, New York, in anticipation of the collection of real estate taxes to be levied for the fiscal year commencing January 1, 1969, and pursuant to the Local Finance Law of the State of New York, shall issue and sell a tax anticipation note in the amount of $707.50 to mature on September 12, 1969, and that the date of maturity of such note shall not and does not extend beyond V the applicable period provided by Section 200 of the said Local Finance Law for the maturity of such lo-tes, to wit, beyond one year from date of issuance. Section 2. That, except as herein specifically pre- scribed, said note shall be of the date, terms form, contents and place of payment and at a rate of interest not exceeding four per centum per annum, as may be determined by the Supervisor of the Town of Queensbury, consistent, however, with the provisions of the said Local Finance Law of the State of New York; and shall be executed in the name of the said Town by its Supervisor and the seal of the Town shall be attached thereto. Section 3. That said note shall be- sold at private sale by the Town Supervisor at a price of not less than par value and accrued interest, if any, and upon the due execution and sale of said note the same shall be delivered to the purchaser upon the payment by him of the purchase price in cash to the Town Super- visor,;t d the receipt of such Supervisor shall be a full acquittaan to such purchaser who shall not be obliged to see to the application of the purchase money. Section 4. The full faith and credit of the Town of Queensbury, New York, are pledged to the punctual payment of principal of and interest on said note. Section 5. TAX ANTICIPATION NOTE RESOLUTION FOR THE ISSUANCE OF A NOTE OF THE TOWN OF QUEENSBURY, NEW YORK, IN THE AMOUNT OF $1550.00 IN ANTICIPATION OF THE COLLECTION OF TAXES FOR THE FISCAL YEAR 1969. WHEREAS, there is established in the Town of Queensbury a Town Police Department, and WHEREAS, there has been appropriated and budgeted funds for the operation of said police department for the fiscal year commencing January 1, 1968, and WHEREAS, the demands upon the services of said police department, were grossly underestimated in the 1968 budget appropriation, and WHEREAS, said demands upon personnel and equipment have created an immediate emergency, and WHEREAS, the Town Board deems it immediately necessary to acquire an additional patrol car to be available to supplement the patrol car presently in use, and WHEREAS, the Town Board is advised that a fully- equipped, used patrol car can be purchased from the Village of Lake George, New York, at a considerable saving to the town, and WHEREAS, the cost of said patrol car is $1550.00 for which no provision has been made in the 1968 budget and no surplus funds are available to defray said cost, now therefore BE IT RESOLVED by the Town Board of the Town of Queensbury, New York, as follows: Section 1.
