Supervisor Solomon announced the opening of the Town Board Meeting at 8:00 p.m. The Supervisor greeted the following visitors: Martin Mosher. Walter Chatterton Mr. & Mrs. Pliney Tucker Mr. & Mrs. Sterling Ronald G. St.Germain Mrs. Gladys W. Bradbear - League of Women Voters John Austin,Jr. - Radio Station WWSC The public hearing on the application of Ronald St.Germain for a permit to locate a Mobile Home on Mountain View Lane was opened at this time. Proof of Publication was presented and read aloud by the clerk. Supervisor Solomon requested a voice from any person present in favor of or in opposition to the granting of the permit. There was none. Public hearing closed at 8:05 p.m. The Public Hearing on the application of Donald R. Walker for a permit to locate a Mobile Home on Foutth Street Extension was opened at this time. Proof of Publication was presented and read aloud by the clerk. Following a request for a voice from any person present in favor of or against the granting of the permit to which there was none, the public hearing was closed at 8:07 p.m. The Public Hearing was ceclared open on the application of Walter and Margaret Chatterton for a permit to locate a Mobile Home on Minnesota Avenue, West Glens Falls, New York. Following a request for an opinion from any persons present either for or against the granting of the permit, to which there:. -..was >uone, the public hearing was closed at 8:10 p.m. Mr. Pliney Tucker, Division Road, West Glens Falls, questioned the Town Board as to what the present status is on the problem of the location of a refuse disposal area in the Town of Queensbury. Mr. Tucker questioned that possibility of a recreational area on the site, which was originally planned for a refuse disposal area. Mr. Sterling Akins questioned as to the proposed roadway, which would reach the area of the proposed land fill area. Discussion ensued with Mr. Plyney Tucker and Mr. Sterling Akins as to the possible purchase of land in the area of the present Ridge Road Refuse Disposal Area. 84 Lengthy discussion on the facts of all problems of the proposed land fill area in any parts of the Town of Queensbury. Mr. Martin Mosher questioned as to why the Town of Queensbury cannot control the operation of the City of Glens Falls dumping area. RESOLUTION TO ISSUE JUNK YARD LICENSE RESOLUTION NO. 247, introduced by Mr. Demboski, seconded by Mr. Robillard. WHEREAS, the following applicant has made application to the Town Board of the Town of Queensbury for a Renewal of his Junk Yard License for the year 1969, and said applicant was accompanied by the proper License Fee of $25.00 in accordance with the Queensbury Junk Yard Ordinance as adopted June 9th, 1966: NAME ADDRESS APPLICATION DATE Roland Mandigo Luzerne Road 11/19/1968 WHEREAS, the applicant has agreed to comply with all of the provisions of said Ordinance, therefore be it RESOLVED, that the Renewal of the Junk Yard License of the above named applicant for the year 1969, be and the same is hereby approved, and be it further resolved that the Supervisor is hereby authorized and directed to issue such Renewal License and deposit the fees in the General Town Fund Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Robillard, Mr. Robertson and Mr. Solomon. Noes - None Councilman Robertson stated that the area of the application of Ronald StGermain to locate a Mobile Home on Mountain View Lane, should be rejected. Decision of the Town Board was to table the granting of the permit for one week. Councilman Robillard moved that the permit of Donald Walker and Walter and Margaret Chatterton be approved. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION NO. 248, introduced by Mr. Robillard, seconded by Mr. Robertson. WHEREAS, Donald Walker of P.O. Box 791, Glens Falls, N. Y. , has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled; ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home out- side of a duly licensed mobile home court at property situated Fourth Street Extension, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: 85 There were no persons in appearance in opposition to the issuance of the permit. There was no objections from neighbors in the area, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to Donald R. Walker of P.O. Box 791, Glens Falls, N. Y. , to locate a mobile home outside of a licensed mobile home court, at property situated at Fourth Street Extension, and that the Town Clerk is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance. Noes - None At a Special meeting of the Town Board of the Town of Queensbury, Warren County, New York, held at Town Hall in said Town, on the 21st, day of November, 1968. The meeting was called to order by Supervisor Gerald Solomon, and upon roll being called, the following were PRESENT: Loyd Demboski - Councilman Harold Robillard - Councilman Hammond Robertson, Jr. - Councilman Gerald Solomon - Supervisor r..j„ 86 The following resolution was offered by Councilman Robertson, who moved its adoption, seconded by Councilman Robillard, to-wit: RESOLUTION DATED November 21, 1968 Number 250 A RESOLUTION APPROPRIATING SEVEN HUNDRED FIFTY DOLLARS ($750.00) FOR THE JOINT SURVEY COMMITTEE OF THE HUDSON RIVER BEND MUNICIPALITIES WHEREAS, Section 239-n, Article 12-C of the General Municipal _ Law provides for the formation of a joint municipal survey committee to make a comprehensive study and report for the collection, treatment and disposal of sewage, and WHEREAS, on the 17th day of October 1963, there was duly formed a joint municipal survey committee entitled "Joint Municipal Survey Committee of the Hudson River Bend Municipalities" pursuant to resolutions by the Common Council of the City of Glens Falls; the Board of Trustees of the Village of Hudson Falls, -the Board of Trustees of Fort Edward, the Board of Trustees of South Glens Falls; the Town Board of the Town of Moreau, the Town Board of Fort Edward, the Town Board of Kingsbury and the Town Board of Queensbury, and WHEREAS, the New York State Pure Waters Authority pursuant to Title 12 of the Public Authorities Law is authorized to contract with joint municipal survey committees to provide advisory and engineering administrative services, and WHEREAS, the Joint Municipal Survey Committee of the Hudson River Bend Municipalities desires to contract with the New York State Pure Waters Authority for advisory and engineering administrative services for the sum of $6000, and WHEREAS, said joint municipal survey committee of the Hudson River Bend Municipalities recommends that each participating municipality pay its equitable share in the sum of $750.00. NOW THEREFORE, be it RESOLVED, SECTION 1. That the Town of Queensbury, New York, hereby authorizes a contract between the Joint Municipal Survey Committee of the Hudson River Bend Municipalities and the New York State Pure Waters Authority in the total amount of $6000.00. SECTION 2. That the Town of Queensbury, New York, hereby appropriates the sum of $750.00 as its equitable share and authorizes the supervisor of the Town of Queensbury, New York, to pay to the Joint Municipal Survey Committee of the Hudson River Bend Municipalities the sum of $750.00. SECTION 3. This Resolution is to take effect immediately. The question of the adoption of the foregoing Resolution was duly put to a vote on roll call, which resulted as follows: --. WHEREAS, the Police Department of the Town of Queensbury did on'the 21st day of November, 1968 recommend the purchase of one 1969 - 4 door Sedan - Ford, Chevrolet or Plymouth Class, therefore be it RESOLVED, that the Town Clerk be and he is hereby authorized and directed to cause to be published once in the Glens Falls Times and the Post Star a notice to read in substantially the following form: NOTICE TO BIDDERS Notice is hereby given that the Town Board of the Town of Queensbury will receive sealed proposals up to 5:00 P.M. on the 12th day of December 1968 at the Town Clerk' s Office in the Queensbury Town Office Building, Bay and Haviland Roads, Glens Falls, New York 12801, Town of Queensbury, to supply the Police Department with the following: One (1) 1969-4 door sedan-Ford, Chevrolet or Plymouth Class. A copy of the detailed specifications for the car to be purchased may be obtained during office hours at- the Queensbury Town Office Building, Bay and Haviland Roads, Glens Falls, New York, Towniof Queensbury. Bids must be submitted in sealed opaque envelopes plainly marked "Police Car Bid" and there shall be included in such bid the certificate as to Non-Collusion required by Section 103d of the General Municipal Law, and the bidder must state approximate delivery date of the truck to be supplies. RESOLUTION TO AUTHORIZE CONTRACTS RELATING TO Y E S PROGRAM FOR 1969 RESOLUTION NO. 253, introduced by Mr. Demboski, seconded by Mr. Robillard. RESOLVED, that the Town of Queensbury continue joint participation in the Y E S Program during 1969 with the City of Glens Falls and the Village of South Glens Falls, and that the Supervisor is hereby authorized and directed to apply for State Assistance under such program and be it further RESOLVED, that the Supervisor is hereby authorized to execute contracts with the City of Glens Falls and the Village of South Glens Falls, to provide for the joint municipal sponsorship of the program, under which arrangement the City of Glens Fallswould be the disbursing municipality for all three communities. ROBERTSON who moved its adoption, seconded by MR. SOLOMON TAX ANTICIPATION NOTE RESOLUTION OF NOVEMBER 21, 1968 FOR THE ISSUANCE OF A NOTE OF THE TOWN OF QUEENSBURY, NEW YORK, IN THE AMOUNT OF $156.40 IN ANTICIPATION OF THE COLLECTION OF TAXES FOR THE FISCAL YEAR 1969. WHEREAS, by resolution duly enacted September 12, 1968, the Town Board of the Town of Queensbury duly created and established the South Queensbury Lighting District Extension 1 in said Town, and WHEREAS, said South. Queensbury Lighting District Extension 1 has incurred costs and expenses for the operation thereof and said costs and expenses are not provided for in the current town budget, and no surplus funds are available for the payment of same, and WHEREAS, the cost and expenses to be incurred by said district until the next fiscal year have been established at $156.40, now therefore BE IT RESOLVED by the Town Board of the Town of Queensbury, New York, as follows: v Section 1. That the Town of Queensbury, New York, in anticipation of the collection of real estate taxes to be levied for the fiscal year commencing January 1, 1969, and pursuant to the Local Finance Law of the State of New York, shall issue and sell a tax anticipation note in the amount of $156.40 to mature on November 21, 1969, and that the date of maturity of such note shall not and does not extend beyond the applicable period provided by Section 24.00 of the said Local Finance Law for the maturity of such notes, to wit, beyond one year from date of issuance. Section 2. That, except as herein specifically pre- scribed, said note shall be of the date, terms, form, contents and place of payment and at a rate of interest not exceeding four per centum per annum, as may be determined by the Supervisor of the Town of Queensbury, consistent, however, with the pro- visions of the said Local Finance Law of the State of New York; and shall be executed in the name of the said Town by its Supervisor and the seal of the Town shall be attached thereto. Section 3. That said note shall be sold at private sale by the Town Supervisor at a price of not less than par value and accrued interest, if any, and upon the due execution and sale of said note the same shall be delivered to the purchaser upon the payment by him of the purchase price in cash to the Town Supervisor; and the receipt of such Supervisor shall be a full acquittance to such purchaser who shall not be obliged to see to the application of the purchase money. Section 4. The full faith and credit of the Town of Queensbury, New York, are pledged to the punctual payment of principal of and interest on said note. Section 5.
