Please be advised that I have beers retained lay Kris D. Roglieri relative to the area variance
he is seeking for his property at 40 North Road. Mr_ Roglied was last before the Board in Marcie,
for his proposed pergola as well as in December for a garage he had constructed for the purpose of
storing his automobile collection. You may recall that although Mr. Rog]ieri's parcel is 14 acres in
size, any additional accessory structure requires relief due to the number of accessory structures
currently existing on the parcel. This gazebo is 144 square feet in size, and is associated with the
pool project that is currently underway. The borne was constructed in the 1960s and the properly
currently has 5 accessory structures approved for the parcel,which includes the recently approved
pergola_
This property, as was discussed at the March and December Zoning Board meeting, is a
ser,luded parceI with along private driveway. The property has a Number of existing mature trees
which creates a very private setting. Although there are a number of accessory structures on the
parcel,they ail Serve a purpose. Ti hme is a MC,stall garage,C1 DSeSt to the Tesidence which is utilized
for lawn equipment which is said to have been constructed in the 1960s. Along the western property
line there is a wood shed that is riot enolosed and holds fire o o d for the numerous fireplaces in the
residence. Further north along the western property line is a second shed whi ch is used exclusively
to store the cover for the fountain in the winter. t mistakenly had identi fled that it stores the fauntasn
and was corrected after the March mtding. This cover for the fountain is very large and this
building is used to store this very large cover. In December, the 3000 square foot garage was
approved [bat was constructed in the rear of the parcel for the storage of the applicant's sports car
collection. In March,the IODD square foot pergola was approved for the pool project.
The proposed gazebo would be decorative in mature and should be more considered as part
of the landscaping than an accessory structure. It would be similar in design to the pergola with

matching columns and it will not have any walls to enclose the stricture. it would also be for
seasonal use, In reviewing the criteria for these variances, tht benefit to the Applicant absolutely
outweighs any detriment that can be considered in granting this relief, The property at issue,
although in a densely populated area, is very large at 14 ages in size, 1oFeover, the property is
protected by many mature trees on site and on the adjacent lands. The vegetation together with the
setback of the existing structure W� H wake the improvement hard to see from adjamt properties.
s noted in the prior application,that in addition to the large parcel being in a s ecluded setting, the
adjacent uses include KeyBank, Hannaford Supemarket, a"forever wild" forest, a bike path, CR
Bard and Aldis. As a result, this accessory structure will not have an adverse impact on these
adjacmt uses and or their values. Due to thest reasons,the granting of this relief cannot be deemed
to create a undesi rabl a change or have an advers a impact. Although it may be considered substanti al,
this should not be the case when considering the mount of land that is owned by the Applicant,
Overall,it would be reasonable and equitable for the Zoning Board to grant the variance requested,
