A retaining wall at the rear of the home has been eliminated and the rear foundation of the home has been heightened to replace the retaining wall. The modification does not require any additional dimensional variances. In fact, the change has made the project more compliant. We are back before you because the change results in a vertical expansion within the 50 ft. shoreline setback area. The total height will still be compliant at 28 ft., but there is more area occupied at 28 ft. This is what I call a volume variance. There is an appearance difference, but, again, the height, side setback, and permeability are within the envelop of the prior variance.
