Flaherty - Superintendent of Queensbury Water Dist. Mr. & Mrs. William H. Dietz - Visitors Juliette Ellingsworth Harwood Beaty - Visitor Jerry Greenberg - Visitor The public opening of bids on the purchase of 12" cast iron pipe for the Water Department was declared open at this time. Proof of publication was presented and read aloud by the clerk. The clerk announced that he had received(2) 1jids which were opened and presented as follows: BIDDER QUOTED PRICE Warren Pipe & Foundry Co. $4.72 per foot United States Pipe & Foundry Co. $4.80 per foot The Superintendent of Queensbury Water District announced that the actual awarding of the bid would be consummated at a later date. Supervisor Solomon announced a recent conference with the New York State Traffic Commission to do with the installation of the 12" pipe at the Aviation Road and Route 9 location. The public hearing was declared open on the application of Mr. Wayne Holcomb for a permit to locate a Mobile Home on the East side of Leo Street, Bennettville, Town of Queensbury. The clerk presented proof of publication of the notice.of the { public hearing. Supervisor Solomon requested a voice from any person present who is interested in the authorization or refusal of the granting of the permit. Mrs. Wayne Holcomb stated that she and her husband, who is close to retirement age, cannot pay the excessive rental in the Mobile Court where they now reside. The public hearing closed at 8:12 p.m. 41 The public hearing on the application of Mrs. Georgia Bennett for a permit to locate a mobile home at the corner of Luzerne Road and Rhode Island avenue was opened at this time. The clerk presented and read aloud the proof of publication of the notice of the public hearing. The Supervisor requested a voice of opinion from any person present in favor of or in opposition to the granting of the permit. Mr. Fred Bennett stated that his wife is ill and this time and the cost of doctering has exhausted his finances. The public hearing was closed at 8:14 p.m. Councilman Austin stated that thh permits should be granted as a result of the approval of the Zoning Enforcement Officer. Councilman Demboski questioned Mrs. Holcomb as to her present health condition. Mrs. Holcomb stated that her health is poor. Mrs. Geneva Elmore stated that the applicants need the,,-,help of their family who live in the area. Councilman Robertson stated that by granting the permits, the intent of the Mobile Home Ordinance is being abused. Mrs. Geneva Elmore discussed the sewage installations in certain mobile homes in the area. Councilman Roabertson discussed the plans of the Town Board to investigate all areas of the town in hopes of making use of lands for mobile homes when the land owner and the Planning Board could agree on the locations. Mrs. Geneva Elmore discussed the construction of low-cost housing being conducted at this time through the efforts of Dr. Byron Howe. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION NO. 154, introduced by Mr. Austin, seconded by Mr. Solomon. WHEREAS, Wgyne E. Holcomb of 19 Briwood Circle, Forest Park Trailer Court, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled: ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, TO Locate a mobile home outside of a duly licensed mobile home court at property situated East side of Leo Street, Bennetville, and WHEREAS, this town board has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and r WHEREAS, it is hereby determined that the facts presented in said E application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: There were no persons in appearance in opposition to the granting of the permit, The application to the granting of the permit was approved by the Zonftg Enforcement Officer. therefore be it x!42 RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to Wayne E. Holcomb of 19 Briwood Circle, Queensbury to locate a mobile home outside of a licensed mobile home court, at property situated at East side of Leo Street, Bennetville, and that the Town Clerk is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Austin, Mr. Robillard and Mr. Solomon. Noes - Mr. Robertson. RESOLUTION TO AUTHORIZE PERMIT FOR MOBILE HOME RESOLUTION NO 155, introduced by Mr. Austin, seconded by Mr. Solomon. WHEREAS, Mrs. Georgia Bennett of 61 Briwood Circle, Forest Park, has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled: ORDINANCE FOR THE REGULATION OF MOBILE HOMES and MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Corner Luzerne Road & Rhode Island Avenue, and WHEREAS, this town has conducted a public hearing in connection with said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, for the following reasons: i There were no persons in appearance in opposition to the granting of the permit. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Austin and Mr. Solomon Noes - Mr. Robillard and Mr. Robertson Supervisor Solomon, at this time, appointed Councilman Austin and Councilman Robertson as a committee of two to investigate locations within the town for suitable mobile home placements. Mrs. Geneva Elmore discussed a reviousl p y granted mobile home permit as issued by the Town Board edir Mr. Harold Balfour. Mrs. Elmore statedthat the mobile home is not being cared for in respect to water and sewage. 248 The public hearing was opened on the proposal to adopt an ordinance which would restrict parking in a section of Sunnyside Road. Proof of publication was presented and read aloud by the clerk. On invitation from the Supervisor for any comments to do with the adoption of the ordinance from any persons present the following person spoke. Mr. Ralph Chambers explained the need for the No-Parking restriction to be of assistance for entry and exit from the Bay-Ridge Fire Company. RESOLUTION NO. 156, introduced by Mr. Austin, seconded by Mr. Robillard. The Town Board of the Town of Queensbury, Warren County, New York, pursuant to subdivisions 5 and 7 of Section 130 of the Town Law, does hereby enact and ordain the following ordinance: ORDINANCE TO REGULATE PARKING ON SUNNYSIDE ROAD IN THE TOWN OF QUEENSBURY. BE IT ENACTED AND ORDAINED BY THE TOWN BOARD OF THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, AS FOLLOWS: Section 1. The parking of vehicles is hereby prohibited in the following location: (a) On the south side of Sunnyside Road (County Road No. 54) from a point commencing seventy= five (75) feet east of the intersection of Sunnyside Road and Route 9L and for a distance of two hundred seventy-five (275) feet along the south side of said Sunnyside Road. Section 2. All ordinances or parts of ordinances of the Town of Queensbury inconsistent with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be in addition to the other ordinances regulating and governing the subject matter covered by this ordinance. Section 3. Any person violating any provision of Section 1 of this ordinance shall upon conviction be punishable for a first offence by a fine not to exceed Ten ($10 .00) dollars and for asecond offence by a fine not less than Ten ($10.00) Dollars or more than Twenty-five ($25.00) Dollars, or by imprisonment for not less than two nor more than ten days. The third or any subsequent offence within one year shall be punishable by a fine not to exceed one Hundred ($100.00) or by imprisonment not to exceed thirty days or by both such fine and imprisonment. In addition to the aforesaid penalties, the Town Board of the Town of Queensbury may institute any proper action, suit or proceeding to prevent, restrain, correct or abate any violation of this ordinance. Section 4.This ordinance shall take effect on the date of its publication and posting as required by Town Law. Latham of R.F.D. #1 Bay Road, Town of Queensbury has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensrtt'y entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Glen Lake Road intersection of Route 1, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further condideration by this board, therefore be it .245 RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said application on July 24, 1969, at 8:00 p.p. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Noes - None RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOTTTTION NO. 158, introduced by Mr. Austin, seconded by Mr. Solomon. WHEREAS, William H. & Patricia Dietz of 93 Gregwood Circle has made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated Lots #11 and #12 Pinello Road, Town of Queensbury, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the town board shall conduct a public hearing on said ! application on July 24, 1969, at 8)00 p.m. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Noes - Mr. Robillard and Mr. Robertson The clerk presented the application of Mrs. Duell for a permit to replace a mobile home on her property in West Glens Falls. The application will be referred to the Building & Zoning Inspector for clarification as to the removal of the present owned trailer on the property. RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION NO. 159, introduced by Mr. Robillard, seconded by Mr.Robertson. WHEREAS, Mr. & Mrs. Gary L. Miner of 20 Briwood Circle, Forest Park Mobile Home Court has made application to this Board for a permit to locate a Mobile Home at property situated at Luzerne Road - 100 yds. west of VanDusen Road and owned by Mr. & Mrs. LeRoy LaCross, and WHEREAS, upon proper investigation it appears that the applicant has complied with all of the requirements of the Ordinance Regulations relating to Mobile Homes in the Town of Queensbury, therefore be it 246. RESOLVED, that there was no hardship shown on the original application, therefore be it further RESOLVED, that the application of Mr. & Mrs. Gary Miner be and is hereby disapproved and that the Town Clerk is hereby directed to notify Mr. & Mrs. Gary L. Miner of the decision of this Board. Duly adopted by the following vote: Ayes - Mr. Demboski, Mr. Robillard and Mr. Robertson Noes - Mr. Austin and Mr. Solomon. The Police Report for the month of June, 1969 was received and placed on file. Councilman Robertson and Supervisor Solomon discussed- the activity of the police department to date. Supervisor Solomon read the report as presented by the Chief of Police on the results of his investigation of all Junk Yards within the town in operation at this time. The report of the Zoning and Building Inspector was received and placed on file. The Supervisor' s Monthly Report for the month of June was received and placed on file. The total receipts for the month were $54,671.50, the total disbursements for the month were $148,447.42. Mr. Pliney Tucker questioned the Town Board as to the towns share in the cost of the proposed study to be conducted by Allen Associates. Mr. Tucker stated further that in his opinion all of the Junk Yards within the town are being neglected at present. Councilman Austin reported on the result of a recent meeting with the State Traffic Department, which will result in a traffic safety study within the town. The department will present re- commendations to the Town Board in the near futhre. It is under- stood that all areas of the town will be investigated. RESOLUTION NO. 160, introduced by Mr. Demboski, seconded by Mr. Robillard. RESOLVED that, the Audit of Claims as listed in Abstract #69-7 numbered #745 through #855 inclusive and totaling $30,147. 19 is hereby approved.
